ORDINANCE NO. 2001-00023
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING
CHANGES: ZONE CASE NO. 2908; A ZONING CHANGE FROM T TO IHI AND
IHC ZONING ON TRACTS OUT OF SECTION 31, BLOCK AK, LUBBOCK
COUNTY, TEXAS; PROVIDING A PENALTY; SUBJECT TO CONDITIONS,
PROVIDING A SA VIN GS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been duly
presented to the Planning and Zoning Commission for its recommendation which was
received by the City Council and, after due consideration, the City Council found that due
to changed conditions, it would be expedient and in the interest of the public health,
safety and general welfare to make those proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amendment to
the Zoning Ordinance and Map have been fully compiled with, including giving notices
in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas,
and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990),
and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15)
days prior to the date of the public hearing before the City Council on such proposed
amendment, and the public hearing according to said notice, was held in the City Council
Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in
support of the proposal; and after said hearing, it was by the City Council determined that
it would be in the public interest, due to changed conditions, that the Zoning Ordinance
and the Zoning Map be amended in the manner hereinafter set forth in the body of this
Ordinances and this Ordinance having been introduced prior to first reading hereof;
NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 2908
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are
amended as follows:
A change of zoning under the provisions of Section 29-29 of the Code of
Ordinances of the City of Lubbock from T to IHI and IHC zoning district on
Tract A, Tobasco Valley No. 3, City of Lubbock, Lubbock County, Texas,
located at Southwest corner of 66th Street and Upland Avenue. Subject to
conditions and being further described as follows:
Tract 1: Interstate Industrial
METES AND BOUNDS DESCRIPTION for a 7.6 acre tract of land located
in Section 31, Block AK, Lubbock County, Texas, being further described as
follows:
BEGINNING at the Northeast corner of Section 31, Block AK, Lubbock
County, Texas;
THENCE South along the East line of Section 31, Block AK, an approximate
distance of361.7 feet to a point in the East line of Section 31, Block AK;
THENCE West an approximate distance of 70.0 feet to a point of tangency in
the North right-of-way line of 67th Street;
THENCE Southwesterly, along the North right-of-way line of 67th Street,
around a curve to the left, said curve having an approximate radius of 256.1
feet, an approximate central angle of 36°05'36", approximate tangent lengths
of 83.5 feet, and an approximate chord distance of 158.7 feet, to a point of
tangency in the North right-of-way line of 67th Street;
THENCE S. 53°53'32" W., along the North right-of-way line of 67th Street,
an approximate distance of 364.5 feet pass the West end of the North right-
of-way line of 67th Street, continuing for an approximate total distance of
543.4 feet to a point in the West line of the Lubbock City Limits, Lubbock
County, Texas;
THENCE North, along said City Limits, an approximate distance of 730.5
feet to a point in the North line of Section 31, Block AK;
THENCE East, along the North line of Section 31, Block AK, an
approximate distance of 660.0 feet to the Point of Beginning.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. The Interstate Industrial portion shall be limited to the
operations of SPEC or a subsequent utility company.
2. Any future proposed use for other than permitted in the
Interstate Commercial District be subject to a new zone case.
Tract 2: Interstate Commercial
METES AND BOUNDS DESCRIPTION for a 4.3 acre tract of land located
in Section 31, Block AK, Lubbock County, Texas, being further described as
follows:

BEGINNING at a point in the East line of Section 31, Block AK, and in the
North right-of-way line of Santa Fe Railroad, which bears South an
approximate distance of 571.6 feet from the Northeast corner of Section 31,
Block AK, Lubbock County, Texas;
THENCE S. 53°54'06" W., along the North right-of-way of Santa Fe
Railroad, an approximate distance of 758.6 feet;
THENCE N. 36°05'54" W., along the North right-of-way of Santa Fe
Railroad, an approximate distance of 25.1 feet;
THENCE S. 53°54'24" W., along the North right-of-way of Santa Fe
Railroad, an approximate distance of 39.5 feet to a point in the West line of
the Lubbock City Limits, Lubbock County, Texas;
THENCE North, along said City Limits, an approximate distance of 290.6
feet;
THENCE N. 53°53'32" E. an approximate distance of 178.9 feet pass the
West end of the North right-of-way line of 67h Street, continuing along the
North right-of-way line of 67th Street for an approximate total distance of
543.4 feet to a point of tangency in the North right-of-way line of 67th Street;
THENCE Northeasterly, along the North right-of-way line of 67th Street,
around a curve to the right, said curve having an approximate radius of
256.1 feet, an approximate central angle of36°05'36", approximate tangent
lengths of 83.5 feet, and an approximate chord distance of 158. 7 feet, to a
point of tangency in the North right-of-way line of 67th Street;
THENCE East an approximate distance of 70.0 feet to a point in the East line
of Section 31, Block AK;
THENCE South an approximate distance of 209.9 feet to the Point of
Beginning.
SECTION 2. THAT violation of any provision of this Ordinance shall be deemed
a misdemeanor punishable by fine not to exceed Two Thousand and N oil 00 Dollars
($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of
Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of
this Ordinance be declared unconstitutional or invalid for any reason, the remainder of
this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause publication
of the descriptive caption of this Ordinance as an alternative method provided by law.
