HomeMy WebLinkAboutOrdinance - 4188-1963 - Amending Zoning Ord No 1695, Zone Case No. 1134 - 09/12/1963MP:jlm .Q..::_(_z -' • oq-zu-lq v~ ORDINANCE NO~· 4188 AN ORDINANCE AMEND~NG ZONING ORDINANCE NO. 1695 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 1134: CHANGE A TRACT OF LAND OUT OF SECTIO 4., BLOCK 0~ LUBBOCK COUNTY. TEXAS, FROM A~ "R-1" TO A "C-411 ZONING DISTRICT; SUBJECT TO THE FOLLOWING CONDITIONS. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommendation which was received by the City Commission and after due consideration, the City Commission finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices prov de by Article lOllf, Vernonts Annotated Civil Statutes, amended in 1953, and notice w 1 s duly published in the Lubbock Morning Avalanche Journal more than fifteen{15) day prior to the date of the public hearing before the City Commission on such proposed amendment, and the public hearing according to said notice was duly held in the Cit Commission Room on the second floor of the City Hall, Lubbock, Texas, at which I time persons appeared in support of the proposal; and, after said hearing, it was b~ 1 the City Commission detemnined that it would be in the public interest, due to chanilj d conditions., that the Zoning Ordinance and the Zoning Map be amended in the manne hereinafter set forth in the body of this Ordinance and this Ordinance having been in traduced in final written form prior to first reading hereof; NOW~ THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ,. ZONE CASE NO. 1134 Change ~a tract of land out of Section 4, Block 0, Lubbock County, Texas.., from an "R-1" to a "C-4" Zoning District. BEGINNING at a point 1233 feet North and 1555 feet East of the Southwest corner of the Northeast One-quarter of Section 4, Block 0, Lubbock, County: Texas; THENCE s. 35° 201 w. along the Highway Right-of-way {Idalou Road) a dis- tance of 646. 40 feet for the North east and beginning point of this tract; THENCE West a distance of 404.5 feet; THENCE S. 35° 20t w. a distance of 161,. 53 feet; THENCE East a distance of 404. 5 feet; -..... THENCE N. 35° 201 E. a distance of 161. 53 feet to the PLACE OF BE- GINNING,. SAVE AND EXCEPT A strip 220 feet in width off the East side thereof, SUBJECT TO THE FOLLOWlNG CONDITIONS: 1. That a solid 6t permanent type screening fence be erected and permanently maintained along the west property line to within 20 feet of the south property line. 2. That no access be permitted from the west side except utility access within 201 of the south property line. SECTION 2. THAT from and after passage and effective date of this Ordinance~ said lots~ tracts and parcels of land described in Section 1 hereof sha be changed to the zoning district indicated and the Official Map is amended in accordance herewith.
