SPEED LIMIT ON THE WEST SIDE OF NORTH COLLEGE AVENUE BEGINNING 1.353 MILES NORTH FROM THE CLOVIS ROAD (U.S. 84) AND EXTENDING NORT fi FOR 1. 231 MU..ES; AUTHORIZING THE PLACING OF SPEED LIMIT SIGNS; PRE- SCRIBING A PENALTY; PROVIDING FOR PUBLICATION; REPEALING ALL OR- DINANCES IN CONFLICT HEREWITH; PROVIDING THAT STREET OR HIGHWAYS l o: SPECIFICALLY SET FORTH HEREIN SHALL NOT BE AFFECTED BY THE PRO- VISIONS HEREOF AND THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER PRIMA FACIE SPEED LIMIT ORDINANCES EXCEPT THOSE WITH WHICH IT SPECIFICALLY CONFLICTS; PROVIDING A SAVINGS CLAUSE; DECLARING AN EMERGENCY; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANC ~. WHEREAS~ the governing body of the City of Lubbock, as authorized by Article 6701d,. Section 169 (b) Vernonts Texas Civil Statutes, finds that certain prima facie speed limits on certain highways are different from what is reasonable or safe and should be altered and the immediate preservation of public health and safety requires immediate alteration of said prima facie speed limits as hereafter set forth., which creates an emergency.., NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. The prima facie speed limit established by Article 6701d, Section 166 (a) 1 -Vernonts Texas Civil Statutes is altered and changed for all vehicles to thirty-five ( 35} miles per hour on the following designated highway or street in the corporate limits of the City of Lubbock. Lubbock County, Texas., to-wi : On both sides of North College Avenue beginning at the intersection of Clovis Road (u.s. 84} and extending North for o. 200 miles. SECTION 2. The prima facie speed limit established by Article 670ld, . u MP:jlm ection 166 (a) 1 -Vernonts Texas Civil Statutes is altered and changed for all vehicles to forty-five ( 45) miles per hour on the following designated highway or street in the corporate limits of the City of Lubbock~ Lubbock Countyl' Texasl' to-wi : On both sides of North College Avenue beginning o. 200 miles north from the Clovis Road ( u .. S. 84) and extending North for o. 212 miles. SECTION 3. The prima facie speed limit established by Article 6701d~ ection 166 (a) 1 -Vernonts Texas Civil Statutes is altered and changed for all ehicles to fifty (50) miles per hour on the following designated highway or street in the corporate limits of the City of Lubbock. Lubbock County. Texas~ to-wi : On the East side of North College Avenue beginning o. 412 miles North from the Clovis Road ( U,. S. 84) and extending North for 0,. 200 miles. On the West side of North College Avenue beginning o. 412 miles North froJn the Clovis Road (u.s. 84) and extending North for 0. 941 miles. SECTION 4. The prima facie speed limit established by Article 670ld. Section 166 (a) 1 -Vernonts Texas Civil Statutes is altered and changed for all vehicles to fifty-five (55 ) miles per hour on the following designated highway or street in the corporate limits of the City of Lubbock. Lubbock County~ Texas., to-wi : On the East side of North College Avenue beginning o. 612 miles North from the Clovis Road (U-.S., 84) and extending North foro. 741 miles. SECTION 5. The prima facie speed limit established by Article 6701d., Section 166 (a) 1 -Vernonts Texas Civil Statutes is altered and changed for all vehicles to sixty (60) miles per hour on the following designated highway or street in the corporate limits of the City of Lubbockl' Lubbock County. Texas. to-: On the West side of North College Avenue beginning 1. 353 miles N>rth • from the Clovis Road (U.S,. 84) and extending North for 1. 231 miles. SECTION 6. The City Manager is authorized and directed to cause the placing of signs so as to clearly define the limits of the prima facie areas set out in this Ordinance. SECTION 7. Any persona firm or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined any sum not to exceed TWO HUNDRED ($200. 00) DOLLARS and for subsequent violations within one year thereafter shall be prosecuted as prescribed for such violations by Sec. 15 of Article 827a. Vernon1s Annotated Penal Code. SECTION 8. The City Secretary is authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty provision as an alternative method of publication as provide d by law. SECTION 9. That all Ordinances or parts or Ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 10. All highways or streets not specifically set forth in the pre- ceeding sections hereof shall not be affected by the provisions hereof,. and this Ordinance shall be cumulative of all other prima facie speed limit Ordinances excep thosewith which it specifically conflicts. SECTION 11. Should any section,. paragraph~ sentence~ clauseJI phrase or word of this Ordinance be declared unconstitutional or invlaid for any reason,. the remainder of this Ordinance shall not be affected thereby. SECTION 12. The fact that public necessity and convenience requires that this Ordinance be pased as an emergency measure for reasons set forth in the preamble hereof» the rule requiring that no Ordinance shall be finally passed on the day of its introduction be suspended, and this Ordinance is declared to be an emergency meausre to take effect from and after its passage.
