No 1695, Zone Case No. 1138. - 09/12/1963ORDINANCE NO. 4177 ------ AN ORDINANCE.AMENDING ZONING ORDINANCE NO., 1695 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 1138: CHANGE LOT 10• BLOCK 8" MORNINGSIDE ADDITION• CITY OF LUBBOCK. LUBBOCK COUNTYa TEXAS• FROM AN "R-311 TO AN "M -111 ZONING DISTRICT; SUBJECT TO THE FOLLOWING CONDITIONS. WHEREAS• the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommendatio which was received by the City C&nmission and after due consideration, the City Commission finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS. all conditions precedent required by law for a valid amendmen~ to the Zoning Ordinance and Map have been fully complied with., as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices pro- vided by Article 1011f, Vernonts Annotated Civil Statutes, amended in 1953., and notice was duly published in the Lubbock Morning Avalanche Journal more than fifteen { 15) days prior to the date of the public hearing before the City Commission on such proposed amendment. and the public hearing according to said notice was duly held .. · in the City Commission Room on the second floor of the City Hall., Lubbock., Texas, at which time persons appeared in support of the proposal; and., after said hearing, it was by the City Commission determined that it would be in the public interest. due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Or- dinance and this Ordinance having been intorduced in final written form prior to first reading hereof; NOW • THEREFORE,. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 169 5 and the Official Zonipg Map BE and the same are hereby amended as follows. to-wit: ZONE CASE NO,. 1138 Change Lot 10" Block 8., Morningside Addition, City of Lubbock,. Lubbock County., Texas" from an "R-3" to an .. M-111 Zoning District. SUBJECT TO THE FOLLOWING CONDITIONS: 1. That a building permit for a masonry building be obtained within 6 months from the effective date of approval. 2. That the building be completed within one year after the effec- tive date of approval and that it be built to cover as much of the lot as the Zoning Ordinance will allow. SECTION 2. THAT from and after passage and effective date of this Or- dinance, said lots. tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance herewith. · AND IT IS SO ORDERED. , Passed by the Commission on first reading this 12th day of -----September • 1 6i Passed by the Commission on second reading this 26th day of September • 1 6 ~ ..
