WHEHEAS .. the governing body of the City of Lubbock,. as authorized by rticle 6701d, Section 169 (b) Vernonts Texas Civil Statutes. finds that certain rima facie speed limits on certain highways are different from what is reasonable r safe and should be altered and the immediate preservation of public health and afety requires immediate alteration of said prima facie speed limits as hereafter et forth~ which creates an emergency, NOW THEREFORE: E IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. The prima facie speed limit established by Article 670ld, ection 166 (a) 1 .. Vernonts Texas Civil Statutes is altered and changed for all ehicles to forty {40} miles per hour on the following designated highway or street n the corporate limits of the City of Lubbock, Lubbock County, Texas, to-wit: On the East side of the Idalou Road (U"·s. 62) beginning 0.100 miles South of East Broadway and extending Northeast foro. 921 miles. On the West side of the Idalou Road (u;s. 62) beginning 0.100 miles South of East Btoadway and extending Northeast for o. 717 miles. SECTION 2. SECTION 10. The prima facie speed limit established by Article 6701d, ection 166 (a) 1 .. Vernonts Texas Civil Statutes is altered and dlanged for all ehicles to sixty (60) miles per hour on the following designated highway or treet in the corporate limits of the City of Lubbock, Lubbock County, Texas, to-wit On the West side of the Amarillo Highway (u.s. 87) beginning at the North City limits and extending South for 1. 763 -miles. On the East side of the Amarillo Higl1way (u.s. 87) beginning at the North City limits and extending South for 1. 400 miles. SECTION 11. The City Manager is authorized and directed to cause the lacing of signs so as to clearly define the limits of the prima facie areas set out n this Ordinance. I SECTION 12. Any person_ firm or corporation violating the prima facie peed limit established by this Ordinance shall upon conviction be fined any sum otto exceed TWO HUNDRED {$200. 00) DOLLARS and for subsequent violations ithin one year thereafter shall be prosecuted as prescribed for such violations by 15 of Article 827a~ Vernonts Annotated Penal Code. SECTION 13. The City Secretary is authorized and directed to cause the 1 ublication of the descriptive caption of this Ordinance together with the penalty rovision as an alternative method of publication as provided by law. SECTION 14. That all Ordinances or parts of Ordinances conflicting with ny of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 15. All highways or streets not specifically set forth in the pre eeding sections hereof shall not be affected by the provisions hereof.~ and this rdinance shall be cumulative of all other prima facie speed limit Ordinances exce oeewith which it specifically conflicts. SECTION 16. Should any section.~ paragraph,. sentence, clause~ phrase o ord of this Ordinance be declared unconstitutional or invlaid for any reaso~ the emainder of this Ordinance shall not be affected thereby. SECTION 17. The fact that public necessity and convenience requires tha is Ordinance be passed as an emergency measure for reasons set forth in the reamble hereof., the rule requiring that no Ordinance shall be finally passed on u e day of its introduction be suspended.. and this Ordinance is declared to be an mergency measure to take effect from and after its passage.
