/r ~ AN ORDINANCE AUTHORIZING THE ALTERING AND CHANGING OF THE PRIMA FACIE
SPEED LIMIT FROM 30 MILES PER HOUR TO 45 MILFS PER HOUR ON THAT PORTION
OF THE STREE'l'S DESCRIBED AS FOLLOWS: On the south side of $2nd Street
beginning at the east side of Elgin Avenue and extending east to
College Avenue.
AUTHORIZING THE PLACING OF SPEED LIMIT SIGNS; PRESCRmiNG A PENALTY; PROVIDING
FOR PUBLICATION; AND DECLAR1NG AN 1!MERGENCY; AND PROVIDING F.OR THE EFFECTlVE
DATE OF THIS CRDINANCE.
WHEREAS~ the governing body, ae authorized ~ Article B27a, Sec. B,
Vernonss Annotated Penal Code, finds that certain prima facie speed limits on
certain highways are different from what is reasonable or safe and should be
altered and the immediate preservation of public health and sa.fety requires
immediate alteration of said prima facie speed limits as hereafter set forth,
which creates an emergency; NOW THEREFORE,
BE IT ORDADJED BY THE CITY COMMISSION OF THE CITY OF LUBl30CK :
SEnTION 1. The prima facie speed limit established by Article 827a,
See. B, Subsection 1 (b), Vernon's Annotated Penal Code is altered and changed
for all vehicles t o 1.;5 miles per hour on the following designated highways
or street in the corporate limits of the City of Lubbock2 Lu~boqk County~ Texas~ to-witg On the south side of $2nd Street oeg~nn1ng at ~he east
side of Elgin Avenue and extending east to College Avenue.
SECTION 2. The City Manager is authorized and directed to cause the
placing of signs so as to clearly define the limits of the prima facie areas
set out in this Ordinance.
SE<n'IOO 3. Any person, firm or corporation violating the prima facie
speed limit established by this Ordinance shall upon conviction be fined in
any sum not to exceed TWO HUNDRED DOLlARS ($200.00) and for subsequent viola-
tions within one year thereafter snall be prosecuted as prescribed for such
violations ~ See. 15 of Article 827a, Vernonva Annotated Penal Code.
SECTION 4.. The City Secretary is authorized and directed to cause
the publication of the descriptive caption of this Ordinance together with
the penalty provision as an alternative method of publication as provided by law.
SECTION 5. The fact that public necessity and convenience requires
that this Ordinance be passed as an emergency measure for reasons set forth in
the preamble hereof, the rule requiring that no Ordinance shall be finally
passed on the day of its introduction be suspended, and this Ordinance is de-
clared to be an emergency measure to take effect for and after its passageo
