AN ORDINANCE AUTHORIZING THE ALTERING AND CHANGING OF THE PRIMA FACIE
SPEED LIMIT FROM 30 MIL'ES PER HOUR TO 35 MIT.FS PER HQUR ON. THAT PORTION
OF THE STREETS DESCRIBED AS FOLLOWS: On the west side of Avenue L -be-
ginning at the south side of 44th Street and extending south to
50th Street. On the east side of Avenue L beginning at 50th Street
and extending north to 34th Street
AUTHORIZING THE PLACING OF SPEED LIMIT SIGNS~ PRESCRmiN'G A PENALTY; PROVIDING
FOR PUBLICATION; AND DECLARING AN EMERGENCY~ AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
~EASp the governing body1 as authorized ~ Article B27a, Sec. S,
Vernon~s Annotated Penal Code, finds that certain prima facie speed limits on
certain highways are different from wh~t is reasonable or safe and should be
altered and the immediate preservation of public health and safety requires
immediate alteration of said prima facie speed limits as hereafter set forth,
which creates an emergency; NOW THEREFORE~
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
S:&:TION 1.. The prima facie speed limit established by Article B27a,
Sec. B, S'Ubsection 1 (b).l' Vernon~s Annotated Penal Code is altered and changed
for all vehicles to 3 5 miles per hour on the following designated highways
or atreet in the cor]X)rate limits of the City of Lubbock, Lubbock County,
Texas.9 to-witg On the west side of Avenue L -beginning at the south
side of 4~th Street and extending south to 50th Street. On the
east side of Avenue L beginning at 50th Street and extending north
to 34th Street.
SECTION 2. The City Manager is authorized and directed to cause the
placing of signs so as to clearly define the limits of the prima facie areas
set out in this Ordinance&
SECTION 3. Any person~ firm or corporation violating the prima facie
speed limit established by this Ordinance shall upon conviction be fined in
any sum not to exceed TWO HUNDRED DOLlARS ($200~00) and for subsequent viola-
tions within one year thereafter shall be prosecuted as prescribed for such
violations b.Y See. 15 of Article S27a, Vernon's Annotated Penal Code.
SECTION 4~ The City Secretary is authorized and directed to cause
the publicaj:,ion of the descriptive caption of this Ordin~nce together with
the penalty provision as an alternative method of publication as provided by law.
SECTION 5o The fact that public necessity and convenience requires
that this Ordinance be passed as an emergency measure for reasons set forth in
.the preamble hereof, the rule requiring that no Ordinance shall be finally
passed on the day of its introduction be suspendedp and this Ordinance is de-
clared .to be an emergency measure to take effect for and after its passageo
