"'4'"092 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE I OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 1075: CHANGE LOTS 4 THROUGH 9• BLOCK 6, AND LOTS 1 THROUGH 7, BLOCK 5, McLARTY'S CIRCLE VIEW ADDITION. CITY OF LUBBOCK,. LUBBOCK COUNTY .. TEXAS AND A TRACT OF LAND OUT OF SEC- I TION 2, BLOCK E, LUBBOCK COUNTY., TEXAS, FROM AN 11R-111 TO AN "R-3" ZONING DISTRICT: SUBJECT TO CONDITIONS: THAT USE BE LIMITED TO APARTMENTS AND/OR SUBJECT TO SPECIFIC USE PERMIT FOR PROFESSION L TYPE OFFICES. WHEREAS., the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommendation, i which was received by the City Commission and after due consideration, the City Commission finds that making the proposed change as hereinafter set out will be in the public interest; and. II WHEREAS. all conditions precedent required by 1 aw for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, amended in 1953, and notice was duly published in the Lubbock Morning Avalanche Journal more than fifteen (15) days prior to the date of the public rear:hg before the City Commission on such proposed amendment. and the public hearing according to said notice was duly held in the City Commission Room on the second floor of the City Hall, Lubbo · k. Texas, at which time persons appeared in support of the proposal; and. after said hea:ring, it was by the City Commission determined that it would be in the public interest, due to changed conditions~ that the Zoning Ordinance and the Zoning Map be amended in the ma:nner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced in final written form prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Map BE and the sam are hereby amended as follows~ to-wit: ZONE CASE NO. 1075 Change Lots 4 thru 91 Block 6, and Lots 1 thru 7. Block 5, McLarty's Circle View Addition, City of Lubbock, Lubbock Co mty, Texas, and a tract of land out of Section 2, Block E, Lubbock County~ Texas, said tract of land out of Section 2, Block E, Lubbock County, Texas is further described by metes and bounds as follows, to-wit: BEGINNING at a point approximately 600 feet north and 30 feet east of the Northwest corner of Section 5, Block E, Lubbock County. Texas. said point being in..the north line of Wolfforth Road and the east line of Avenue P, Lubbock, Texas; THENCE North along the east line of Avenue P approximately 350 feet to a point in the south line of the alley in Block 6, Carlton Heights Addition, City of Lubbock. Lubbock County, Texas; THENCE East approximately 1240 feet to a point in the west line of Avenue L; THENCE Southeasterly approximately 100 feet along the west line of Avenue L to a point in the north line of Wolfforth Road; THENCE Southwesterly approximately 1362 feet along the North line of Wolfforth Road to the PLACE OF BEGINNING .. from an 11R-1 11 to an "R-3" zoning district, SUBJECT TO THE FOLLOWING CONDITIONS: That the use of said property be restricted only to de;v,elopment for apartment dwellings and/or subject to specific use permit for professional type offices as provided in Section 14-A. 1 of the Com- prehensive Zoning Ordinance of the City of Lubbock and the further condition that 1, 500 square feet of lot area shall be provided for each apartment unit if the said property is developed for and used for apart- ments. SECTION 2. THAT from and after passage and effective date of this Ordi-I nance, said lots, tracts, and parcels of land described in Section 1 hereof shall be1 changed to the zoning district indicated and the Official Map is amended in accord- ance herewith.
