CITY OF LUBBOCK~ SO AS TO PROHIBIT THE CONTINUOUS PARKING OF A VEHICLE FOR A LONGER PERIOD OF TIME THAN 120 MINUTES IN 2 HOUR AND 1 HOUR PARKING METER ZONES, 48 MINUTES IN 24 MINUTE METER ZONES,~o AND 24 MINUTES IN 12 MINUTE PARKING METER ZONES; PROVIDING THAT PROVISIONS OF THIS ORDINANCE SHALL NOT CON- STITUTE A REPE~ OF THAT SECTION OF CODE OF ORDINANCES OF CITY OF LUBBOCK REQUIRING DEPOSIT OF COINS IN 12~ 24~ 60 AND 120 MINUTE METERS; DIRECTING THE PUBLICATION OF THE DESCRIPTIVE CAPTION OF THIS ORDINANCE WITH THE PENALTY CLAUSE AS PROVIDED BY LAW; DE- CLARING AN EMERGENCY. WHEREAS,. the parking of vehicles for an entire day or major portions there- of in parking meter zones by depositing coins in parking meters so as to continuous park a vehicle for a longer period of time than the parking limits provide in the I various parking meter zones has created a serious parking condition in downtown Lubbock, resulting in parking spaces in various parking meter zones being unavail- able to many persons who desire to transact business in downtown Lubbock, and such conditions having created an emergency, and; WHEREAS~ it is the desire of the City Commission to provide a maximum continuous parking period of 120 minutes in 2 hour and 1 hour parking meter zones# 48 minutes in 24 minute parking meter zones and 24 minutes in 12 minute parking I meter zones so as to make available parking spaces for a greater number of person~ who desire to transact business in downtown Lubbock; and., WHEREAS. these parking limits for parking meter zo:re s will provide a more efficient method of enforcement by the Police Department by marking the tires of parked vehicles; and, WHEREAS. such enforcement will be cumulative of parking meter violations and will not extend the time required to violate the parking time limits as registere(i by the parking meters~ ,NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 18-105, Article VII, Division 2~ of the Code of Ordinances,. City of Lubbock, is hereby amended to read as fdlows: Sec. 18-105. Hours of operation; maximum parking time permitted. When parking meter spaces are indicated by lines or metal markers upon the surface of the streets in the parking meter zones and when parldng meters are installed adjacent to or adjoining such respective parking spaces# no vehicle shall remain parked within any spaces within any zone for a longer continuous period than one hundred and twenty minutes at any time between the hours of eight o 1 clock a. m. and five o 1clock pl m. on any day, except Sundays and holidays officially designated in Chapter 2, Article 1, Section 2-11 of this Code provided, however that in every twenty-four minute parking meter zone no vehicle shall remain continuously parked in such parking space for a period of time greater than forty-eight minutes and that in vvery twelve minute parking meter zone, no vehicle shall remain continuously parked in such parking space for a period of time greater than twenty-four minutes, during the hours and days aforesaid. SECTION 2. Any person who shall suffer or permit any vehicle registered in his name or any vehicle owned or operated or in his charge or control to be parked or left standing in volation of the terms of this Ordinance shall, upon conviction, be fined in any sum not exceeding TWO HUNDRED {f200. 00) DOLLARs;:,.~ SECTION 3. It shall not be construed that the provision of this Ordinance repeals or has il:e affect of repealing or changes in any manner Section 18-109 Article VII, Division 2, of the Code of Ordinances of the City of Lubbock, providingJ and reqliring the deposit of coins in meters controlling twelve, twenty-four, sixty and 120 minute parking limits. I SECTION 4. That the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance., together with the penalty clause, as an alternative method provided by law. SECTION 5. Since this Ordinan-aecis an emergency measure f>r the reasons se forth in the preamble hereof, the rule requiring two readi1133l>efore final passage 1 1 is hereby suspended, and this ordinance shall take effect immediately after ils passage.
