AND DECLARING AN EMERGENCY; I WHEREAS~ Ordinance No. 4001 was passed by the City Commission of the City of Lubbock on January 10, 1963 placing 62.1 acres out of Block E-2.., Lubbock [County, Texas in Fire Zone No. 2 and . , I WHEREAS.., the legal description for said 62. 1 acres included a tract of land, being. a golf course,.to-wit, Treasure Island Golf Course which should have not been included in Fire Zone No. 2, but was inadverently included therein by virtue of said legal rescription and Ordinance,and, WHEREAS.., the City Commission finds that Ordinance No. 4001 ·.should be amended so that the legal description contained therein shall exclude the said golf course; NOW THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: .. SECTION 1. THAT Ordinance No .. 4001 of the City Commission of the City of Lubbock Texas be and the same is hereby amended to read as follows to-wit: ORDINANCE NO. 4001 AN ORDINANCE AMENDING THE FIRE ZONE MAP OF THE CITY OF LUBB~C ISO AS TO PLACE CERTAIN PROPERTY IN FIRE ZONE NO.· 2, WHICH PROFERT ' IS DESCRIBED IN A SPECIFIC USE PERMIT FOR A COMMERCIAL USE 'IN ZONE CASE NO. 1061 DECLARING AN EMERGENCY AND EFFECTIVE DATE OF THIS ORDINANC~. WHEREAS.., the City Commission finds that in the granting of all Specific 11 use Permits for Commercial uses pursuant to Section 14A of Zoning Ordinance 'No. 1695 of the City of Lubbock" that property covered by such Permit should lbe placed in Fire Zone No. 2 to protect the lives, safety.., and property of the citizens of the City of Lubbock.., which creates an emergency; NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: 1 SECTION 1. THAT the following described property which is property de- !l scribed in Zone Case No. 1061 for which a Specific Use Permit for a commercial use is authorized by Ordinance No. 4000 ... to-wit: A tract of land out of the Northwest 1/4 of Section 4~ Block E-2# Lubbock County,. Texas, further described by metes and bounds as follows: BEGINNING at 40f south & 1540r East of the N. W. corner of Section 4~ Block E-2i THENCE East 490. 7t to a point; THENCE South 10 t to a point; THENCE around a curve to the right in the right of way line of Loop 28 9 to a point; THENCE S. 47° 201 West 165. 2 to a point; THENCE 553° 03t W. a distance of 1480t; THENCE along a curve to the left along the north bound line of Loop 289 a distance of 1183. 51 to a point in the west line of Section 4., Block E-2; THENCE N. along the west line of Section 4, Block E-2 840. 31 to a point; THENCE East 335. or to a point; THENCE N. 60° 34' East 437. 5t to a point; THENCE N. 236t to a point; THENCE East 597. 61 to a point; THENCE N. 52° 27r East 285.5 to a point; THENCE North 690t to PLACE OF BEGINNING., (Property is located in the vicinity of Frankford Avenue and 4th Street.} ~ BE AND THE SAME IS hereby changed and/or placed in Fire Zone No. 2 an r the "FIRE ZONE MAP OF THE CITY OF LUBBOCK" duplicate original located in 1 the Building Inspectorts Office shall be amended in accordance herewith by the Building Inspector or at his direction., and this change shall constitute an amend- ment to Fire Zoning Ordinance No. 1447 and Section 1601., Part IV., Chapter 16 of the Lubbock City Code., relative to fire zones. SECTION 2. The rule requiring an ordinance to be read on two readings before final passage is hereby suspended., and this Ordinance is declared to be an emergency measure for the reasons set forth in the preamble hereof .. to take effect immediately after its passage. THAT public necessity and the preservation of the safety and welfare of the lives and property of the citizens of Lubbock requires the immediate passage of this ordinance and thereby creates an emergency making it necessary that the rule requiring the ordinance to be read on two separate I occasions be suspended and the same is hereby suspended and this ordinance shall tal4e effect and be in force from and after its passage.
