AN ORDINANCE DIRECTING DESIGN ANnCONSTRUCTION OF A TRAFF C
DIVERTER WITHIN 5.rHE INTERSECTION OF 48TH STREET AND SALEM ~ VENl E
SETTING THE REQUIREMENTS AND LOCATION THEREOF; DEFINING THE
TERM "TRAFFIC DIVERTER11; DIRECTING PLACEMENT OF WARNING AND
DIRECTIONAL SIGNS AND DEVICES; DEFINING THE VIOLATIONS OF THIS
ORDINANCE AND DECLARING VIOLATIONS TO BE A MISDEMEANOR AND
SETTING A PENALTY THEREFOR; DIRECTING PUBLICATION, DECLARING
AN EMERGENCY. AND PROVIDING AN EFFECTIVE DATE.
WHEREAS.,. the City Commission finds that the existing traffic flow, spee<
and volume at the intersection of Salem Avenue and 48th Street in the City of Lub
bock is such as to constitute a serious hazard and danger to the drivers and pas-
sengers of all vehicles passing through such intersection, and to the residents
living near or adjacent to such intersection; and,
WHEREAS, the City Commission finds that the dangers existing at such
intersection cannot be adequately controlled or eliminated by the customary use
of traffic signs, signals and devices; and, ·
WHEREAS. in the exercise of the police power of the City of Lubbock, thE
City Cqr.nmission finds that it is reasonable and necessary that a traffic diverter
be installed at such intersection, to adequately promote and protect the health,
safety, property and general welfare of the citizens of the City of Lubbock; and
WHEREAS. the City Commission finds that the construction of said traffic
diverter is necessary immediately to protect the lives, safety and property of
the citizens of the City of Lubbock, which creates an emergency; NOW THERE-
FORE,.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Traffic Engineer of the City of Lubbock, BE and
he is hereby, authorized and directed to design and cause to be constructed with-
in the intersection of Salem A venue and 48th Street in the City of Lubbock, a traf
fie diverter of sufficient size and design as to require all vehicular traffic enter-
ing such intersection to turn from a straight course. Such traffic diverter shall
run from a point at or near the Southeast corner of such intersection to a point a1
or near the Northwest corner of such intersection.
By the term 11Traffic divertern as used herein shall mean a structure_.
median or improvement, which shall be higher than the existing surface of the
main traveled portion of such intersection, and so designed and constructed as
to prevEnt the p~.ssage of any motor vehicle through, over or around such diverter
SECTION 2. The Traffic Engineer is authorized and directed to cause thE
placing of such warning and directional signs and devices as may be necessary to
give vehicular traffic on all streets entering such intersection notice of the exis-
tence of such diverter and of the direction each vehicle is to follow.
SECTION 3. Any person operating a motor vehicle on, over or across
such traffic diverter1 or who shall drive over any adjacent corner of the inter-
section described in Section 1 hereof to avoid such diverter~ shall be guilty of
a misdemeanor and upon conviction thereof shall be fined in any sum not exceed-
ing TWO HUNDRED ($200. 00) DOLLARS.
SECTION 4. The City Secretary-Treasurer is authorized and directed to
cause the publication of the descriptive caption of this Ordinance together with
the penalty provision hereof as an alternative method of publication as provided
by law.
SECTION 5. The rule requiring an ordinance to be read on two readings
before final passage is hereby suspended~ and this ordinance is declared to be
an emergency measure for the reasons set forth in the preamble hereof1 to take
effect immediately after its passage.
