HomeMy WebLinkAboutOrdinance - 3645-1961 - Amending Zoning Ordinance 1695 And Official Zoning Map Of The City Zone Case 872 - 11/09/1961JW :wg ====~· :==l=====================::=ciiJ;:[)..9-=-lSlto j -=====~~ u ORDINANC;E 11,0. 36'4.5" H -~ 1 -rc:ru 1 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 ANb THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO :MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 872 : CHANGE CERTAIN PROPERTY LOCATED IN THE 3400 AND 3500 BLOCKS OF PARKWAY DRIVE FROM AN "R-1" TO A 11C-4" ZONING DISTRICT: SUBJECT TO THE FOLLOWING CONDITION: AS A CONDITION PRECEDENT TO THE ISSUANCE OF ANY BUILDING PERMIT, A SOLID SIX AND ONE-HALF {6 1/2) FEET SCREENING FENCE SHALL BE PLAC ALONG THE NORTH AND WEST SIDES OF THE PROPERTY CONSIDERED BY TillS CASE, AS FOLLOWS: A. THE CONSTRUCTION OF SAID FENCE SHALL TAKE INTO ACCOUNT THE LOCATION OF STREETS AS SAID STREETS ARE LOCATED BY PLATTING OF THE PROPERTY, AND SHALL PROVIDE FOR ADEQUATE VISUAL CLEARANCE AT STREET INTERSECTIONS IN CONFOR- MANCE WITH THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF LUBBOCK. B. SAID FENCE SHALL BE CONSTRUCTED ALONG THE NORTH PROPERTY LINE, EXTENDING WEST FROM A POINT WHERE THE WESTERN- MOST RIGHT OF WAY LINE OF TEXAS HIGHWAY LOOP 289 ADJOINS THE EDWARDS NORTH PROPERTY LINE. C. SAID FENCE SHALL BE CONSTRUCT ED ALONG THE PROPERTY LJNE OF THE NORTH ONE-HALF (1/2) OF THE WEST SIDE OF THE PROPERTY. WHEREAS, the change in zoning districts in Zone Case No. 872 has been duly presented to the Zoning and Planning Commission for its recommendation, which was received by the City Commission and after due consideration, the City Commission finds that making the change as hereinafter set out will be in the public interest; and, I WHEREAS, all conditions precedent required by law for a valid amendment II to the Zoning Ordinance and Map have been fully complied -with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Al'ticle 1011£, Vernon's Annotated Civil Statutes, amended i nl l953, and notice was duly published in the Lubbock Morning Avalanche Journal more than fifteen (15) days prior to the date of the public hearing before the City Com- mission on such proposed amendment, and the public hearing according to aaid notice was duly held in the Assembly Room of the Central Fire Station Building, located at 503 Avenue Kin Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Commission determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced in fin3'll written form prior to first reading hereof; NOW THEREFORE; BE IR ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 8 72 Change the following described property, to-wit: Being a part of the Southwest 1/4 of Section 3, Block A, Lubbock County, Texas, described by metes and bounds as follows: BEGINNING at a large iron pipe at the Northeast corner of the Southwest 1/4 of Section 3, Block A:; THENCE South 89°4St West, ak>ng the North line of said South- west l/4 of Section 3, Block A, and the North line of the original J. L. Edwards Tract, at 46.3 feet past a point in the present Northwesterly right of way line of U. S. Highway Nos. 62 and 82, in all 499. 5 feet to a point in the North line of the Southwest I/4 of Section 3, Block A, and the North ltil.e of the Ori.~tnal J. L. Edwards tract, a corner of the newly acquired right of way for U. S. HighwafS Nos. 62 and 82, the Northeast and beginning corner of this tract; THENCE South 89°45' West, along the North line of the Southwest 1/4 of S ection 3, Block A, and the North line of the original J. L. Edwards Tract, 1150. 5 feet to a point, the o:ci.Ejnal Northwest corner of the said J. L. Edwards Tract, and the Northwest corner of this tract; THENCE South 0°07t West, along the original West line of said J. L. Edwards Tract, 340. 0 feet to a point in the North line of the present right of way of U.S. Highway Nos. 62 and 82, the Southeast corner of this tract; THENCE South 83 °19f East, along the North right of way line of the present U. S. Highways NOS. 62 and 82, about 365 feet to a point at the Southwest corner of the newly acquired right of way for U.S. Highways Nos. 62 and 82 a corner of this tract; . THENCE Northeasterly around a circular curve to the left which has a radius of 919. 9 feet, and along the Northwest right of way line of said newly acquired right of way for U.S. Highways Nos. 62 and 82, a distance of 770. 7 feet to the end of the curve, a corner of said newly acquired right of way, and a corner of this tract; THENCE North 48°411 East, along the Northwest line of said newly acquired right of way, Ill. 6 feet to .a point, a corner of said newly acquired right of way, and a corner of this tract; THENCE North 0°151 West, along the West line of said newly acquired right of way, 85 feet to the besinning corner of this tract; from an 11R-111 to an "C-411 zoning district. {Said property bEing located in the 3400 and 3500 Blocks of Parkway Drive). SUBJECT TO THE FOLLOWING CONDITION: As a condition pre\Cedent to the issuance of any building permit. a solid six and one-half {6 1/2) feet screening fence shall be placed along the North and West sides of the property considered by this case, as follows; A. The construction of said fence shall take into account the location of streets as said streets are located by platting of the property, and shall provide for adequate visual clearance at street intersections in conformance with the comprehensive zoning ordinance of the City of Lubbock. B. Said fence shall be constructed along the North property lines extending West from a point where the Westernmost right of way line of Texas Highway Loop 2.89 adjoins the Edwards North property line. C. Said fence shall be constructed along the property line of the.North one-half {1/2.) of the West side of the property. SECTION 2.. THAT from and after passage and effective date of this Ordi- nance,. said lots~ tracts and parcels of land described m.5ection 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accord ance herewith.
