AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE
RESULT OF AN ELECTION HELD IN THE CITY OF LUBBOCK, TEXAS, ON
NOVEMBER 7~ 1961~ PURSUANT TO ORDINANCE NO. 3607 CALLING FOR A
SPECIAL ELECTION ON CERTAIN PROPOSED AMENDMENTS TO THE CHAR•
TER OF THE CITY OF LUBBOCK, TEXAS, AS SUBMITTED AND VOTED ON
BY THE QUALIFIED ELECTORS OF THE CITY OF LUBBOCK•
WHEREAS, propositions 1D amend the Charter of the City of Lubbock were
submitted by ballot to the qualified voters of the City of Lubbock on November 7,
1961.7 after due notice pursua.nt to Section 1, Artisle 1170, Revised Civil Statutes 1
of Texas~ 1925, as amended by the 57th Legislature of the State of Texas, pub ..
lished in accordance with and-as directed therein; and I
WHEREAS. said proposed amendments are set out in full in Ordinance No.
3607, pursuant to which ordinance said proposed amendments were submitted;
and
WHEREAS, as directed and in compliance with Chapter 1, Article IX,
Section 6 of the charter of the City of Lubbock and the laws of the State of Texas
the returns of the special charter amendment election held November 7, 196 ~~
should be opened and canvassed and the results thereof declared, NOW THERE-
FORE:
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT there was submitted to the qualified voters of the City
of Lubbock;r, Texas~ on November 7, 1961~ in accordance with the lawa for the
purpose of passing on the question of adopting amendments to the City Charter
of the City of Lubbock;. Texas •. the questions reading as follows:
Amendment No. 1.
Do you vote to amend the present City Charter of the City of Lubbock, Texas,. by
amending and changing Section 15(i), Chapter 1~ Article n~ relating to time a
property owner may contest1he assessment of cost for improvements of public
streets~ alleys and other public ways over which the City o£ Lubbock has juris ...
diction to provide that such right of Conte at shall be within the period of time
provided by Law of the State of Texas.

Do you vote to amend the present Gity Charter of the Gity of J..ubbock, Texas, by1
amending and changing Sec. 22, Chapter 1, Article II, relating to the Park Com.-
mission to require the City Commission to c;reate and establish by Ordinance a
Park and Recreation Board for the City of Lubbock subject to approval by the
City Commission of any delegated control and supervision of the parks within the

amending Section zz, Chapter 1, Article IX which relates to administrative
departments of the City affairs and provides for the creation and consolidation
of appointive offices by the City Commission as it may deem advisable to divide
the administration of City affairs into departments and eliminate any one parti-
cular Commissioner having charge of the executive duties over a single adminis-
trative department.

fund of the City of Lubbock one half (1/Z) mill on the one dollar valuation of the
taxable property of the City of Lubbock for a period of fifteen years and levying
a tax sufficient to raise such amount for a period of fifteen years beginning with
the fiscal year 196Z .. 1963 to 1976•1977 inclusive, suchan.nual appropriation of
one half {1/Z) mill on the dollar valuation of taxable property of the City of
Lubbock to thereafter cease and operation and maintenance to be provided by

1 through lZ~ and that a majority thereof was cast in the negative in answer to
amendment No. 13.
SECTION 3. (a) THAT the City Commission has duly canvassed the elec ..
tion returns and find t~t a majority of the qualified voters favor the adoption of
amendments No. 1 through 12, aforesaid and that they have legally carried;a been
adopted and approved. (b) And the City Commission further finds that a majority
o£ the qualified voters do not favor the adoption of amendment No. 13 and that
said amendment has been legally rejected.
SECTION 4. (a) It is ordered that said proposed amendments 1 through
12. be and the same are hereby approved and adopted and made a part of the
charter of the aty of Lubbock,_ Texas and that a copy of said ordinance ordering
the e1ectio~ to•wit Ordinance No. 3607 as well as this ordinance be recorded in
full in the records of the City of Lubbock. (b) It is further ordered that said
proposed amendment No. 13 be considered as diSapjroved and rejected and is
therefore .ordered that same be declared hereby to bedsapproved and rejected
by the voters of the City of Lubbock.
AND IT IS SO ORDERED.
