ORDINANCE NO. '36"32
AN ORDINANCE AMENDING ORDINANCE NO. 3420 TOADD THE
FOLLOWING DESCRIBED SCHOOL ZONE SPEED LIMITS IN SECTION 1 OF
ORDINANCE NO. 34ZO. ESTABLISIDNG PRIMA FACIE SPEED LIMITS AT
20 MILES PER HOUR DURING SCHOOL HOURS IN SUCH ZONES; DEFINING
"SCHOOL HOURS"; MAKING IT UNLAWFUL TO PASS WITHIN SCHOOL ZONES;
PRESCRIBING PENALTY FOR VIOLATIONS, PROVIDING FOR PUBLICA-
TION AND DECLARING AN EMERGENCY.
WHEREAS, the governing body of the City of Lubbock, upon the basis of
an engineering and naffic investigation finds it nee e s sar y to alter prima facie
speed limits established by Acts 1931~ 42nd Legislature~ p. 507~ Ch. 282 8 9,
as amended~ and compiled as Article 827a~ Section 8~ subsection 1 (b) l:t
Vernonts Penal Code~ within the corporate limits of the City o£ Lubbocl<; and
in the immediate vicinity of school areas as particularly described in the body
of this Ordinance~ during periods of time when schools are in session and when
school children are going to or from schools and playgrounds; and~
WHEREAS,. the governing body finds it necessary to make provisions for
the regulation of moving vehicular traffic within such areas regarding passing
and stopping for the protection and safety of pedestrians crossing the streets
within such area; and,
WHEREASa it is necessary to the immediate preservation of the public
health and safety to provide for the immediate enactment of such measure con:-
stituting an emergency; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 1 of Ordinance No. 3420~ City of Lubbock~
Texas• BE and the same is hereby amended by the addition thereto at the end
thereof of the following locations and areas which are hereby declared to be
school zones and the prima facie speed limits of thirty (30) miles per hour as
established by ARTICLE 827a~ Section 8~ Subsection 1 (b) l~is hereby altered
and changed to twenty (20) miles per hour for all ve bicles~ during school hours
as herein defined on the following described streetst to-wit:
113 7. On Boston Avenue b~inning 170 feet North from
the North side of the inter section of 42nd Street,
and extending South on Boston Avenue for 410 feet. 11
SECTION 2. The Traffic Engineer is hereby authorized and directed to
cause the placement of traff:ic.c..ontr.d signals and/ or portable 'lJigns at each
approach to each school zone herein designated. The signs shall be placed in
the center of the Street or at the most advantageous point within the traffic
lanes to be conspicuous to approaching vehicular traffic.
SECTION 3. 11Schoo1 hours11 as that term is used herein• shall be the
hours between 7:30A.M.; and 4:30P.M. of each Monday through Friday
throughout the c alendar year when the school nearest the school zone is. in
session.
SECTION 4. It shall be unlawful for any person to drive or operate a
vehicle through a school zone as designated and established herein during school
hours in such a manner as to overtake and pass another vehicle by change of lane,
being driven in the same direction upon the same street within said school zone.
SECTION 5. It shall be unlawful for any person to drive or operate a vehic e
through the school zones herein designated during school hours at a rate of speed
in excess of the prima facie speed limits herein designated for such school zones.
SECTION 6. Any person violating the prima facie speed limit established
by this Ordinance shall upon conviction be fined as prescribed by the provision of
Article 827a, Vernon's Annotated Penal Code for violations of Section 8 thereof
and any person violating any other Section of this Ordinance shall upon conviction
be fined in a sum not exceeding $200. 00.
SECTION 7. If any part or parts of this Ordinance shallbe:held unconstitu-
tional or invalid by any court of competent jurisdiction, such part or parts shall
be deemed a separate, distinct and independent provision and such holding shall
not affect the remaining portions hereof.
SECTION 8. That all Ordinances or parts of Ordinances conflicting with
any of the provisions hereof are hereby repealed insofar as such conflict exists.
SECTION~. That the City Secretary is hereby directed to cause publica-
tion of the descriptive caption of this Ordinance together with the penalty clause
as an alternative method provided by law.
SECTION 10. That the enactment of this Ordinance being necessary to the
public safety and welfare of the pedestrian use of the streets in the school zones
herein designated and established is hereby declared to be an emergency measure
creating a public.necessity that the rule providing that proposed ordinance be pre-
sented at two separate meetings be dispensed with and this Ordinance is declared
to be an EMERGENCY MEASURE to take effect from and after the date of its first
publication.
AND IT IS SO ORDERED
On motion of Commissioner Thompson , seconded by Commissioner
Chappell , this Ordinance was unanimously passed the 26th day
