HomeMy WebLinkAboutOrdinance - 3627-1961 - Amending Section 3-26 Code Of Ordinances Air-Traffic Rules - 10/26/1961l _ q JP :wg ~ --- ID-21 /)-trW ORDINA'NC-E "'NO. 3627 AN ORDINANCE AMENDING SECTION 3-26 OF THE CODE OF ORDINANCES CITY OF LUBBOC~ TEXAS, SO AS TO REVISE AND ADD TO THE AIR-TRAFFI RULES GOVERNING CONDUCT AND OPERATION OF THE LUBBOCK MUNICIPA I AIRPORT; ESTABLISHING FLIGHT PRIORITIES, TAXIING SPEED, AND PARK- ING REQUIREMENTS; REQUIRING CONFORMANCE TO TAXI PATTERNS AND CONTROL OF TAXIING AND TAKE-OFF BY TOWER OR SIGNALS; ESTABLISH- ING LANDING REQUIREM.ENTS AND TRAFFIC DIRECTION; DESIGNATING CAL WIND RUNWAY AND SETTING RULES FOR LANDINGS AND TAKE-OFF; ESTAB- LISHING PROCEDURE WHEN AIRCRAFT LEAVES TRAFFIC PATTERN AND FORl AIRCRAFT ENTERING TRAFFIC PATTERN; DESIGNATING ZONE OF APPLJCAJI TION OF THESE RULES; REQUIRING TWO-WAY RADIOS; SETTING ALTITUDE AND PATTERN FOR AIRCRAFT WITH PECULIAR CHARACTERISTICS; REQUIR- ING TWO-WAY RADIO IN CERTAIN ADDITIONAL CIRCUMSTANCES;AUTHORIZI G DEVIATION FROM THESE RULES WITH PERMISSION FROM TOWER OR IN EMERGENCY; PROVIDING A PENALTY; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission finds that the changes in the air-traffic rules at the Lubbock Municipal Airport are necessary and essential to the safe opera- tion of said airport and are for the protection of the health, safety and property of the citizens of the City of Lubbock; and, WHEREAS, this Ordinance affects the daily operation of the Lubbock Municipa Airport~ a department of the City of Lubbock, which creates an emergency; NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Sec. 3-26, of the Code of Ordinances, City of Lubbock, Texas, BE, and the same is hereby amended to read hereafter in full as follows, to-wit: 11Sec. 3-26. Air-traffic rules. (1) Flight Priorities. The following flight priorities are established for the Lubpock Municipal Airport: First priority: Arriving and departing • .a.ir craft, both scheduled and non scheduled shall be accorded first priority, shall have the right-of- way over aircraft flying locally, and local flight traffic patterns shall be diverted to permit their arrival and departure in safety and without undue delay. Second priority: Local flying civilian aircraft shall be accorded second priority. The priorities established by this section shall be void in the event of any emergency. {2) Taxiing speed. All aircraft in motion on the ground at the Lubbock •.. L:,":Municipal Airport shall be taxied at a safe and reasonable speed, with due regard for other aircraft, persoa.s and property. (3) Parkins. Aircraft awaiting take-off from the Lubbock Municipal Airport shall park at least one hundred feet from any runway in use and in a position so as to have a direct view of aircraft approaching for landing. (4) Aircraft must conform to taxi patterns. Taxiing aircraft shall conform to the taxi patterns set forth on the taxi chart, copies of which are on filed in the offices of the Director of Aviation and the city secre- tary, unless otherwise authorized by the Lubbock tower .. · (5) Taxiin and take-off to be controlled b tower or Air- craft wit operatlng ra io equipment s all contact the Lu oc Tower for instructions prior to taxiing or taking off from the Municipal Airport. Aircraft without operating radio equipment shall be~governed by standard light sig nals used for the control of air traffic. (6) Aircraft with radio to contact tower for landing instructions. Aircraft with operating radio equipment, which intend to land at the muni- cipal airport shall contact the Lubbock Tow~er for instructions fifteen miles out, or at least outside the control zone. Aircraft flying locally sha remain 1.n constant ra 10 commumcation wit the Lub- bock tower while in the traffic pattern or the Lubbock control zone. · (9) Caution to be exercised when entering traffic attern. Aircraft entering the ra c pat ern s a 1 exercise extreme caution so as not to cause aircraft already in the pattern to deviate from their course. (10) Traffic Direction. The traffic direction shall be left hand or counter clockwise unless otherwise authorized by the control tower. (11) Calm wind runway. Runway number three at the Municipal Airport shall be designated as the calm wind runway. (12) Landings and take-offs. Landings and take-offs shall be made directly into the wind or on the r unway or landing strip most nearly aligned with the wind unless otherwise authorized by the Control Tower. (13) Landings and take-offs. No landings or take-off shall be made except at a safe distance from buildings and other aircraft. (14) Landings and take-off. No turn shall . be made after take-off until the airport boundary has been reached, the aircraft has attained an altitude of at least 400f above the surface and it has been ascertained there will be no danger of collision with other aircraft. (15) Take-off when aircraft remains in traffic pattern. All light or slow aircraft intending to remain in the traffic pattern shall continue to climb to traffic altitude b£ 1, 000 feet above the surface after the first 90° turn and shall thereafter follow the pattern as set forth on the "traffic pattern chart", c~pies of which are on file in the offices o£ the Director of Aviation and the City Secretary. {16) Take-of£ -when aircraft remains in traffic attern. All large or fast aircra t 1nten ing to remain 1n t e ra ic pattern shall continue to climb to traffic altitude of 1, 500 feet above the surface after the first 900 turn and shall thereafter follow the pattern as set forth on the "Traffic Pattern Chartrr, copies of which are on file inthe offices of the Director of Aviation and the City Secretary. (17) Procedure-when aircraft leaves traffic attern. All large or fast aircraft entering the traffic pattern sha o so at an angle of 45° midway of the downwind leg at an altitude of 1, 500 feet above the surface. (22) Aircraft below fifteen hundred feet and within three miles of airport must conform to rules and local traffic. All aircraft in flight below fifteen hundred feet above the surface, within a three mile radius of the Lubbock Municipal Airport~ shall conform with local traffic and with the rules set out in this section and the traffic diagrams shown on the traffic pattern chart copies of which are on file , in the offices of the Director of Aviation and the City Secretary, unless otherwise authorized by the Lubbock Tower. {23) All aircraft based at the Lubbock Municipal Airport and/or regularly using the Lubbock Municipal Air.p:<tt.it 1or the conduct of Com- mercial flying, locaULying practice, student instruction And/or regularly domiciled at the h;ubbock Municipal Airport shall be equipped with an adequate operating two-way radio communications system capable of receiving and acknowledging a irport traffic cont:rol instructions. { {24) Altitude and Pattern for aircraft with peculiar characteristics. Scheduled air carriers and aircraft having flight characteristicfi which make the procedures set out in this section impractical shall be flown at an altitude of two thousand feet and shall conform to the rectangular pattern shown on the traffic pattern chart. (25) No person shall operate an airplane, or being the owner of an air- plane based or domiciled at the Lubbock Municipal Airport, permit the operation of such airplane on, over or within the traffic pattern of the Lub- bock Municipal Airport for local flying practice, student instruction or any commercial flight operation unless that aircraft is eguipped with an adequate operating twp-way radio communications system capable of receiving and acknowledging airport traffic instructions issued for the control of air and/ or surface traffic at the Lubbock Municipal Airport by the con- trol tower. ' (26} Deviation from rules-with permission from tower. Aircraft in two-way radio communication with the tower may deviate from any of the rules set out in this section when authorized by the Lubbock tower. (27} ,Same-in cases o£ emergency. The rules set out in this section may be deviated from when an immediate emergency presents itsel! that requires such deviation in the interest of safey. 11 SECTION 2. Any person~ firm or corporation violating the terms of this Ordinance shall upon conviction be fined in any sum not exceeding $200~ 00. SECTION 3. The rule requiring an Ordinance to be read on two readings be- fore final passage is hereby suspended, and this Ordinance is declared to be an emergency measure for the reasons set forth in the preamble hereoft to take effect immediately after its passage. SECTION 4. The City Secretary shall cause the publication of the caption and pena,lty clause of this Ordinance (said penalty clause being Section 2 of this Ordinance) once a week for two consecutive weeks in a newspaper regularly pub- lished in the City of Lubbock as an alternative method of publication as provided by law.
