ORDINANCE NO. 3960 -----
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING
CHANGE: ZONE CASE NO. 1050: CHANGE A TRACT OF LAND OUT OF THE
NORTHEAST 1/4 OF SECTION 10, BLOCK B,. LUBBOCK. LUBBOCK COUNTY,
TEXAS FROM "R-2" and "C-2" TO uR-3n ZONING DISTRICT; SUBJECT TO
CONDITIONS:
WHEREAS, the proposed change in zoning districts as hereinafter made has
been duly presented to the Zoning and Planning Commission for its recommendation.
which was received by the City Commission and after due consideration, the City
Commission finds that making the proposed change as hereinafter set out will be
in the public interest; and.,
WHEREAS, all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with., as well as giving :1
notices in compliance with Section 20 of Ordinance No. 1695 as well as notices 1
provided by Article 10llf., Vernon's Annotated Civil Statutes, amended in 1953, and
notice was duly published in the Lubbock Morning Avalanche Journal more than
fifteen ( 15) days prior to the date of the public hearing before the City Commission
on such proposed amendment, and the public hearing according to said notice was
duly held in the City Commission Room on the second floor of the City Hall,
Lubbock, Texas, at which time persons appeared in support of the proposal; and, I after said hearing, it was by the City Commission determined that it would be in
the public interest, due to changed conditions, that the Zoning Ordinance and the
Zoning Map be amended in the manner hereinafter set forth in the body of this
Ordinance and this Ordinance having been introduced in final written form prior to
first reading hereof; NOW, THEREFORE~
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE
and the same are hereby amended as follows, to-wit:
ZONE CASE NO. 1050
Change a tract of land out of the Northeast 1 I 4 of Section 10,
Block B, Lubbock, Lubbock County, Texas from an 11R-2" and
a 11 C-211 to an 11R-3n zoning district. Said property is further
described by metes and bounds as follows:
BEGINNING at a point in the South boundary line of 34th Street,
which point is 1803. 7 5 feet West and 40 feet South of the North-
east corner of said Section 10, Block B, for the Northeast and
beginning corner of this tract;
THENCE South 448.751 to a point, the Southeast corner of this
survey and the Northeast corner of a 6. 3 acre tract heretofore
conveyed to J. L. Badly;
THENCE West with the North line of said J. L. Badly tract, 330r
to a point for the Southwest corner of this tract~ mid point being
also the Northwest corner of the J. L. Badly 6. 3 acre tract;
THENCE North 448. 75' to a point in the South line of 34th Street
for the Northwest corner of this tract;
THENCE East 3301 to the PLACE OF BEGINNING;
(Said property is located in the vicinity of 34th Street and Avenue T.}
SUBJECT TO THE FOLLOWING CONDITIONS:
1. that an apartment project only be constructed on the property; and
2. that the project be developed according to the plan submitted at
the hearing~ said plan being on file in the office of the Secretary
of the Planning and Zoning Commission.
SECTION 2. THAT from and after passage and effective date of this
Ordinance~ said lots, tracts and parcels of land described in Section 1 hereof shall
be changed to the zoning district indicated and the official map is amended in
accordance herewith.
AND IT IS SO ORDERED.
