TO-WIT: 34TH STREET BETWEEN COLLEGE AVENUE AND AVENUE x. AND 34TH STREET BETWEEN COLLEGE AVENUE AND AKRON AVENUE; ESTABLISHING REQUIREMENTS AS TO SIZE AND DESIGN OF SUCH DIVIDERS; DEFINING THE TERM ;'MEDIAN DIVIDER11; AUTHORIZING SUCH WARNING AND DIRECTIONAL SIGNS, DEVICES, STRUCTURES OR IMPROVEMENTS AS NECESSARY; DEFINING THE DRIVING OF A MOTOR VEHICLE ON. OVER OR ACROSS SUCH CONCRETE DIVIDER AS 1 A MISDEMEANOR#. ANI_) PROVIDING A PENALTY THEREFOR; DIRECTING PUB- LICATION AND PROVIDING AND EFFECTIVE DATE FOR THLS ORDINANCE. - WHEREAS, the City Commission finds that the existing traffic flow~ speed ani volume on the street hereinafter described in the City of Lubbock is such as to constitute a serious hazard and danger to the drivers and passengers of all vehicle passing on such street, and to the residents living near or adjacent to such inter- section; and, WHEREAS,. the City Commission finds that the dangers existing on such street cannot be adequately controlled or eliminated by the customary use of traffic signs,. signals and devices; and, ~ WHEREAS~ in the exercise of the police power of tlte City of Lubbock, the City Commission finds that it is reasonable and necessary that a system of concret~ dividers be installed on the approaches on such street, to adequately promote and protect the health, safety, property and general welfare of the citizens of the City of Lubbock; NOW THEREFORE~ BE IT ORDAINED BY THE. CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT a system of concrete dividers be located, constructed and/ or maintained on the following described street in the City of Lubbock to-wit: 34th Street between College Avenue and Avenue X 34th Street between College Avenue and Akron Avenue Such concrete dividers to be of sufficient size and design as to separate on such street vehicles passing in opposite directions. By the term 11median divider11 as used herein shall mean a structure, median or impl'ovement, which shall be highe:r;- than the existing surface of the main traveled portion of the streets upon which it is placed. and so designed and constructed as to prevent the passage of any motor vehicle through or over such divider. SECTION 2. The Traffic Engineer is authorized and directed to cause the placing of such warning and directional signsJ devices,~~ structures or impvovements either at ground level or above as may be necessary. SECTION 3. Any person operating a motor vehicle who shall drive up, over or across such median divider~~ or across or over. any sign, devic~ structure or improvement placed or constructed so as to give warning or notice of such concrete divider shall be guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not exceeding TWO HUNDRED {$200. 00) DOLLARS ... SECTION 4. The City Secretary-Treasurer is authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty provision hereof as an alternative method of publication as provided by law~ L and this Ordinance shall become effective ten {10) days after the second publication thereof.
