No 1695: Zone Case No 1009. - 06/28/1962JW'F:wg ~Ll4J_62!==-"""""'"'--=====--.-:=::====--=======-=====-=-=====::=:o~-.!0~£J~-Z6-19l/2___ :11 / ORDINANCE NO. 38"70 01--/'J.-lQ(J2 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE 24 6-28-62 OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO., 1009 : CHANGE CERTAIN PROPERTY LOCATED ON THE WEST SIDE OF AVENUE Q IN THE 4600 BLOCK FROM A 11C-2" TO A "C-311 ZONING DISTRICT~ SUBJECT TO CONDITIONS. ~ WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommenda- tion, which was received by the City Commission and after due consideration, the I City Commission finds that making the proposed change as hereinafter set out will be in the public interest; and, j I WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1953, and notice was duly published in the Lubbock Morning Avalanche Journal more than fifteen (15) days prior to the date of the public hearing before the City Com- mission on such proposed amendment, and the public hearing according to said notice was duly held in the City Commission Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Commission determined that it would ~ be in the public interest, due to changed conditions, that the Zoning Ordinance and 1he Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced in final written form prior to first reading hereof; NOW a THEREFORE: ~ BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: ~ SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 1009 Change the following described property, to-wit: The following described portion of the E. R. Little Subdivision of Lot Two (2), Block...-'!Wenty-five (25) of theW. D. Crump Five Acre Addition to the City of Lubbock, Lubbock County, Texas, and being a subdivision out of the South part of Survey 10, Block B, Lubbock County, Texas; BEGINNING at a point in the East line of said E. R. Little Subdivision five feet South of the Northeast corner of said subdvision; THENCE West paralle~ to the North line of said Little Subdivision a distance of 178.59 feet; THENCE South parallel to the East line of said Little Subdivision a distance of 272 feet to a point in the South line of said E. R. Little Subdivision; THENCE East along the South line of said subdivision to the Southeast corner thereof; THENCE North 272 feet to the PLACE OF BEGINNING and being the South 272 feet of all of said E. R. Little Subdivision lying East of the alleyway dedicated by E. R. Little, et ux, et al. , dated April 4, 1957, recorded in Volume 660, Page 203, Deed Records of Lubbock County, Texas; from a "C-211 to a "C-3" zoning district. (Said property being located on the West side of Avenue Q in the 4600 Block.); Subject to the following conditions: 1. That the eevd>pment of this property shall observe a 43 foot building line along Avenue Q. 2. That all lights used in connection with the development of this property shall be so shielded as to eliminate annoyance to residentially zoned areas. 3. That a six foot screening wall or fence be constructed along the West side of the property. SECTION 2. THAT from and after passage and effective date of this Ordinance, said lots, tracts and parcels of land described in Section 1 hereof shall be changect to the zoning district indicated and the Official Map is amended in accordance herewith.
