J823 OCP-I L1--f..9(o~ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 990 : CHANGE LOTS 14, 15, AND 16, BLOCK 15 {EXCEPT THE WEST 25 FEET OF LOT 14) AND LOTS 12 AND 13, BLOCK 16, (EXCEPT THE WEST 25 FEET OF LOT 13), MC CRUMMEN SECOND ADDITION l TO THE CITY OF LUBBOCK, LUBBOCK COUNTYt TEXAS, FROM AN"R-211 TO A "C-311 ZONING DISTRICT. (SAID PROPERTY IS LOCATED ON THE EAST SIDE OF AVENUE Q AT 23RD STREET .. ) SUBJECT TO CONDITIONS. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission fo r its recommenda- tion, which was received by the City Commission and after due consideration, the! City Commission finds that making the proposed change as hereinafter set out will be in the public interest; and, I WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 f>f Ordinance No. 1695 as well as notices provided by Article 10llf, Vernon1s Annotated Civil Statutes, amended in 1953, and notice was duly published in the Lubbock Mornit/g Avalanche Journal more than fifteen (15) days prior to the date of the public hearing before the City Com- mission on such proposed amendment, and the public hearing according to said notice was duly held, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Commission determined that it would Qe in the public interest, due to changed conditions, that the Zoning Ordinance and I the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced in final written form prior to first reading hereof; NOW~ THEREFORE: 'BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 990 • ----· Change Lots 14, 15, and 16, mock 15 (except the West 25 feet of Lot 14) and Lots 12 and 13, Block 16, (except the West 25 feet of Lot 13). McCrummen Second Addition to the City of Lubbock, Lubbock County, Texas, from an "R-211 to a "C-311 zoning district. (Said property is located on the East side of Avenue Q at 23rd Street.) Subject to the following conditions: A. The following regulations shall apply to Lots Fourteen (14), Fifteen (15) and Sixteen (16) (except the West 25 feet of Lot 14, which has been designated for street purposes) in Block Fifteen (15), McCrummen Second Addition to the City of Lubbock, Lubbock County, Texas. 1. That Lot 14 (except the West 25 feet) and Lot 15 be used for business purposes with the present improvements thereon. This property shall be used for any purpose permitted in a 11C-311 zone, except those specifically prohibited hereinbelow, so long as no new improvements are added thereto. 2. That at such time as aqy...additional improvements or new im- provements are placed on the property herein first described in section 1~ then conformance with the.following requirements must be had: I a. That the lots~ as above described which are abutting be developed as a unit with a 20-foot set-back and frontage on Avenue "Q", and that sufficient off-street parking be provided as hereafter set out. b. That a permanent screening wall or fence of 6 feet in height be constructed and m aintained along the East pro- perty line in conformance with zoning regulations. c. That an offstreet parking lot be constructed with a mini- mum ratio of one parking space for each 400 square feet of gross floor area in the building if an office building is constructed on the property; if retail use i's made of the property,~ then an offstreet parking lot of sufficient size to maintain a three to one ratio in parking area to build- ing area be constructed. Such parking lot to be paved with an asphalt hardtop surface. d. That all lights used in connection with the parking lot be hooded and faced away from existing residences in the area. e. That the permissible uses on this property not include a drive-in restaurant and/or a trailer coach park(a conditional use). SECTION 2. THAT from and after passage and effective date of this Ordi- nance, said lots~ tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accord- ance herewith.
