MENTS OR THEIR AGENTS OR EMPLOYEES WITH RESPECT TO ALLOWING SUB-MINORS TO REMAIN ON THE PREMISES BETWEEN THE HOURS OF 11 0 1CLOCK P .. M. AND 6 0 1CLOCK A. M. OF THE FOLLOWING DAY, OFFICIAL CITY TIME, EXCEPT THAT ON FRIDAYS AND SATURDAYS AND NIGHTS NEXT PRECEDING SCHOOL HOLIDAYS THE HOURS SHALL BE FROM 12 0 1CLOCK P. M. MIDNIGHT TO 6 O'CLOCK A. M.; PROVIDlliG FOR PENALTIES; AND PROVIDING FOR AN ALTERNATIVE METHOD OF PUBLICATION AS PRO- VIDED BY LAW; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDI- NANCE.' WHEREAS, the City Commission finds that in the interest of the health, safety, and general welfare of sub-minors under seventeen years of age the cur- few hours with respect to such sub-minors should be revised as hereinafter set forth; NOW THEREFORE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Sections 19-22~ 19-23~ and 19-24 respectively of Volume I of the Lubbock City Code be and the same are hereby amended to read as follows: 11Sec. 19-22. Unlawful conduct of sub-minor. (a) No s~b-minor shall remain in or upon any public place or any establishment between the hours of 11 o 1clock p.m. and 6 o 1clock a.m. of the following day, official city) time~ except that on Fridays and Saturday s and nights next preceding school holidays the hours shall be from 12 o'clock p.m. midnight to 6 o'clock a.m. (b) The provisions of this section shall not apply to any sub-minor accompanied by a parent .. or to a sub-minor upon an errand or other legitimate business directed by such sub-minorts parent~ or to any sub-minor who is engaged in gainful lawful employment during the curfew hours. Sec. 19-23. Unlawful conduct of parents. (a) No parent shall knowingly permit any sub-minor to remain in or upon any public place or any establishment between the hours of 11 o'clock p.m. and 6 o'clock a.m. of the following day~ official city time, except that on Fridays and Saturdays and nights next preceding school holidays the hours shall be from 12 o'clock p.m. midnight to 6 o 1clock a.m.; {b) The provisions of this section shall nbt apply to any parent who accom- panies a sub-minor or to a parent who directs a sub-minor upon an errand or other legitimate business or to any parent of a sub-minor engaged in gainful lawful employment during the curfew hours. u Sec. 19-24.. Unlawful conduct of owners or operators of establish- ments. No operator of an establishment or their agents or employees shall knowingly permit any sub-minor to remain upon the premises of said establishment between the hours of 11 o 1clock p. m. and 6 o 1clock a. m. of the following day, official city time, except that on Fridays and Saturdays and nights next preceding school holiday s the hours shall be from 12 o'clock p .. m. midnight to 6 o'clock a. m." SECTION 2. PENALTIES: Any parent who shall violate any provision of section 19-23 after having received notice of a prior violation shall be fined upon con- viction pursuant to section 1-5 of this Code. Any operator of an establishment and any agent or employees of any operator who shall violate the provisions of section 19-24 shall be fined upon conviction pursuant to section 1-5 of this Code. Each violation of the provisions of this article shall constitute a separate offense. SECTION 3. The City Secretary-Treasurer is hereby authorized and directed to cause the publication of the descriptive caption of this ordinance and the penalty provisions contained in Section 2 of this ordinance in a newspaper regularly published in the City of Lubbock once a week for two consecutive weeks as an alternative method of publication as provided by law~ and this ordinance shall become effective ten days after its last publication.
