THIS IS THE FIRST AMENDMENT TO THE AGREEMENT dated and entered into on the 14th day of February, 2023, Contract No. 17130, by and between the City of Lubbock ("City") and Kimley-Horn and Associates, Inc. ("Engineer"). Engineer is providing professional design services for the reconstruction of 34`h Street from Upland Avenue to Milwaukee Avenue (the "Activities"). The Parties entered into a six (6) month extension for services on February 2, 2024. Now the Parties desire to enlarge the scope of services to be performed by the Engineer while completing the Activities. WITNESSETH: The City and Engineer now agree to enlarge the scope of services in this Agreement, details of which are as set forth in Exhibit "A" and incorporated herein. The cost of said services shall not exceed one hundred fifty-eight thousand dollars and NOI100 ($158,000.00). The contract term shall be extended for, and Engineer shall complete the services in Exhibit "A" within, three hundred sixty-five (365) days. All other portions of the original Agreement shall remain in place and are not altered by this amendment. IN WITNESS HEREOF, the parties have executed this Agreement as of this llth day of June 2024. Keenum, P.E., Division Director of Engineering/City Engineer APPROVED AS TO FORM: elli Leisure, Senior Assistant City Attorney Page 2 of 2 EXHIBIT A — Amendment 01 Engineering Scope of Services 34th STREET RECONSTRUCTION From Upland Avenue to Milwaukee Avenue City of lubbock PROJECT UNDERSTANDING The project consists of providing the following services to revise the design of the 34th Street project due to unforeseen utility conflicts and is related to Professional Services Contract 17130 for Engineering Services: • Project management o Coordination with the City's Upland Avenue (50�h to 34th) project team o Coordination with the City's Upland Avenue (34th to 19th) project team • Design Survey • Design of 5-Lane Roadway o Includes 10' Shared-Use Path (SUP) on the south side of the road where feasible o Includes 6-lane approaches at Upland Avenue Intersection o Includes 8-lane eastbound approach at Milwaukee Avenue Intersection • Drainage Analysis • Design of Drainage Channel where required • Three cross culvert designs o Near the Upland intersection 0 80-ft east of Quincy intersection 0 550-ft east of Quincy intersection • Design of City water line relocation • Plan set development from 30% to Final Design (100%) • This supplemental will consist of two design submittals (90% and Final Design) and consist of addressing one round of comments from the 90% and Final Design review meetings respectively. Exhibit A - SCOPE 1. 34th Street — Upland Ave to Milwaukee Ave 1.1. Project Management 1.1.1 Administration/Correspondence 1.1.2 Prepare an updated design schedule that reflects additional time due to utility issues 1.1.3 Progress Meetings 1.1.4 Coordination with City's Upland project team 34th Street Engineering Scope of Services April 2024 2. Design Survey (By Subconsultant) 2.1. Revise the 34th street existing boundary survey to include recently constructed development at the southeast corner of Upland and 34th street. Updated boundary survey shall consist of: 2.1.1 Property boundary 2.1.2 Existing pavement, curbs, sidewalks, barrier free ramps, etc. 2.1.3 Driveways (including material) 2.1.4 Parking lots within 20-ft of proposed ROW. 2.1.5 Existing culvert sizes, invert elevations, including cross sections approaching culvert crossings and headwalls/wingwalls 2.1.6 Existing driveways and swales 2.1.7 Visible utilizes consisting of: manholes, vaults, water valves, water meters, telephone poles, power poles, utility markers, water well features, other public utilities, and franchise utilities. 2.1.8 Signs (excluding temporary signs) 2.1.9 Buildings and permanent structures Collect additional survey data for Temporary Construction Easements (TCEs) at three (3) driveways 3. Final Design 3.1. QA/QC 3.1.1 Engineer will perform an internal review prior to all submittals (90°/a and Final) in accordance with quality assurance standards established for this project. QA/QC comments will be collected from each internal reviewer, documented, and comments addressed prior to each plan submittal to the City. 3.2. Coordination with Subconsultants 3.3. Roadway Design (PS&E) - Roadway plans consisting of the updated design for the following: 3.3.1 Proposed easement locations (if any) 3.3.2 Proposed sidewa�k and SUP locations 3.3.3 Proposed residential and commercial driveways 3.3.4 Project layout 3.3.5 Typical sections 3.3.6 Traffic control phasing plans 3.3.7 Horizontal alignment data 3.3.8 Vertical alignment data 3.3.9 Plan and profile sheets 3.3.10 Pavement marking layouts 3.3.11 Barrier free ramps 3.3.12 Intersection layouts 3.4. Revised centerline alignment and horizontal curve data 3.5. Revised centerline profile 3.6. Revised roadway linework 34th Street Engineering Scope of Services April 2024 3.7. Reanalyze all driveways within the project and develop driveway profiles as needed. Driveways will typically be defined vertically by spot elevations. 3.8. Update Final 3D roadway model. 3.9. Updated design cross-sections 3.9.1 Develop on 50-ft station intervals and at driveway centerlines. 3.9.2 Show pavement and subgrade, right-of-way limits, side slopes, pavement cross slopes, curbs, and sidewalks. 3.9.3 Cross-sections will not be provided in the bid documents but will be made available to prospective bidders 3.10. Traffic Control 3.10.1 Develop construction sequence plan showing: • Travel lanes and construction area for each phase of construction. • Temporary signing and striping, barricades, and other channelization devices. • Develop TCP typical intersection staging plans for similar intersections. • Develop custom intersection staging layouts for special conditions. 4. Drainage Analysis 4.1. Drainage Analysis 4.1.0 Perform hydrologic and hydraulic modeling using ICPR4 for proposed channel improvement alternatives on the north side of 34t'' Street. 4.1.1 Recommend drainage improvements consisting of: • Roadway profile, • Channel cross section materials, • Sizing of culverts, • Channel outfall design recommendations. 4.2. Deliverables 4.2.0 Updated Hydrologic and hydraulic data sheets, 4.2.1 Stormwater routing sheets documenting proposed flow depths. 5. Drainage Plans 5.1. Revised drainage plans to consist of the following: 5.1.1 Provide Drainage Area Map complete with time of concentration routes, curve numbers calculated as per the Drainage Criteria Manual (DCM) for each drainage area, drainage area denoted in acres, and all necessary points of interest labeled. 5.1.2 Provide hydrologic and hydraulic data sheets showing the necessary calculations and assumptions. 5.1.3 Provide drainage channel grading plan. 5.1.4 Provide drainage culvert plans, profiles, and supporting details. 5.1.5 Provide depth of flow indications for the 100-year design storm within ROW and any corresponding finished floor elevations. 34th Street Engineering Scope of Services April 2024 6. Water Line Relocation 6.1. The Engineer will prepare engineering plans, specifications, and construction contract documents for project bidding and regulatory approval. Plans will consist of 11"x17" plan and profile sheets. The Engineer will design up to 6,270 linear feet of water line. The Engineer will provide the following information on the plan sheets: 6.1.1 General Sheets � • Location Map • General Notes • Water Line Site Schematic • Horizontal/Vertical Control 6.1.2 Water Line Plan and Profile Sheets • Plan View o Control data o Existing right-of-way and easements o Existing topography o Existing pavement o Existing trees o Existing driveway locations o Existing storm drain and culvert locations o Existing water lines and appurtenances o Existing sanitary sewer lines and manho�es o Existing franchise utility locations (based upon SUE and franchise utility information) o Proposed roadway improvements o Proposed drainage improvements o Proposed centerline alignment • Profile View o Existing ground profile o Proposed roadway profile o Proposed water line alignment ➢ A profile view for the proposed water line alignment will be designed for all water lines. o Existing utility crossings o Proposed drainage crossings 6.1.3 Construction Details • Engineer will utilize applicable City standard details. 6.2. Prepare preliminary opinion of construction costs (OPCC) 6.2.1 Because the Engineer does not control the cost of labor, materials, equipment, or services furnished by others, methods of determining prices, or competitive bidding market conditions, and opinions rendered as to costs, including but not limited to opinions as to the costs of construction and materials, shall be made on 34th Street Engineering Scope of Services April 2024 the basis of its experience and represent its judgment as an experienced and qualified professional, familiar with the industry. The Engineer cannot and does not guarantee that proposals, bids, or actual costs will not vary from its opinions of cost. 6.3. Preliminary design review meeting 6.3.1 Engineer will prepare for and attend one (1) virtual meeting with the City to review preliminary design plans and OPCC. 6.4. The Engineer will prepare the final plans and OPCC by incorporating the comments received from the preliminary design review meeting (one (1) round of comments is anticipated for this effort). 6.5. Contract Documents 6.5.1 Prepare specifications, which will consist of technical specifications for materials and installation of the proposed facilities. Specifications shall consist of City standard and non-standard technical specifications for materials and installation of the proposed facilities. 6.6. Prepare final OPCC. 6.7. Deliverables 6.7.1 One (1) .pdf copy of the preliminary design complete plans and OPCC for review and comment. 6.7.2 One (1) .pdf copy of final plans, specifications, contract documents and an OPCC for bidding. 7. Additional5ervices Services not specifically identified in the Scope of Services above shall be considered additional and shall be performed on an individual basis upon authorization by the City. All permitting, application and similar project fees will be paid directly by the Client. Lump Sum fees will be invoiced monthly based on the overall percentage of services performed. Payment will be due within 25 days of your receipt of the invoice and should include the invoice number and Kimley-Horn project number
