AND DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAP OF THE CIT OF LUBBOCK TO INDICATE THE CLOSING AND ABANDONMENT OF SAID PORTIONS OF 42ND STREET, 44TH STREET AND A VENUE W AS AFORESAID. WHEREAS, the City Commission finds that a portion of 42nd Street, 44th Street and Avenue W. as hereinafter more particularly described is no longer needed for street purposes; and, WHEREAS, the City Commission finds it would be to the public interest to close, vacate and abandon same for street. purposes; NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT a portion of 42nd Street, as hereinafter described, shall be and the same is hereby closed, vacated and abandoned for street purpose ; said tract of land being more particularly described as follows, to-wit: A parcel of.land in Crump Five Acre Addition, an addition to the City of Lubbock, Texas; more fully described as follows: BEGINNING at a point in the North right of way line of 42nd Street said point being 270 feet East of the East right of way line of College Avenue; THENCE East along the North right of way line of 42nd Street a distance of 1655.0 feet more or less to a point; THENCE South 50 feet to a point; THENCE West along the South right of way line of 42nd Street a distance of 1655.0 feet more or less to a point 270 feet East of the East right of way line of College Avenue; THENCE North 50 feet to the POINT OF BEGINNING; SECTION 2. THAT a portion of 44th Street, as hereinafter described, shall be and the same is hereby closed, vacated and abandoned for street purpose said tract of land being more particularly described as follows, to-wit: A parcel of land in Crump Five Acres Addition, an addition to the City of Lubbock, Texas; more fully described as follows: BEGINNING at the point of intersection of the West right of way line of Avenue U with the South right of way line of 44th Street; THENCE West along the South right of way line of 44th Sreet a distance of 1927. 5 feet to a point; THENCE North 50 feet to a point in the North rightof way line of 44th Street; THENCE East along the North rightof way line of 44th Street a dis- tance of 1927.5 feet to a point in the West right of way line of Avenue U. THENCE South 50 feet to the POINT OF BEGINNING.· SECTION 3. THAT a portion of Avenue W, as hereinafter described, shall be and the same is hereby closed, vacated and abandoned for street purposes; said tract of land being more particularly described as follows, to-wit: A parcel of land in Crump Five Acres Addition, an addition to the City of Lubbock, Texas; more fully described as follows: BEGINNING at the Southeast corner of Block 21, Crump Five Acres Addition and the North line of 46th Street; THENCE North along Avenue W, a distance of 1930. 0 feet more or less to a point in the South right of way line of 40th Street; THENCE E.as':t .50 feet to a point; THENCE South along the East rightof way line of Avenue W a distance of 1930 feet more or less to a point in the North line of 46th street; THENCE West 50 feet to the POINT OF BEGINNING. SECTION 4. It is the express intention of the City Commission by the passage of this Ordinance only to abandon such streets as public streets, and not in any fashion to remove from the land involved its character as a public park, and the land within the above described areas, having never been physical! opened on the ground as streets but having been used in fact for park purposes, shall remain dedicated by use a a public park in connection with the land abutting and adjacent thereto; provided however, that this Ordinance shall never in any way be construed as limiting the right of any public utility company to repair and or maintain any character of improvements which are now located within the areas above described and abandoned. SECTION 5. THAT the City Engineer is hereby authorized and directed to mark :. the official map of the City of Lubbock to indicate that the p :ortion of streetr as described in Section 1, Section 2 and Section 3 hereof, have been closed and abandoned, showing the number of this Ordinance and the date of its final passage AND IT IS SO ORDERED Passed by the Commission on first reading this 11th llay of January ~ 1962. ------------4 Passed by theCommission on second reading this 25th day of January 1962.
