HomeMy WebLinkAboutOrdinance - 3607-1961 - Orderiong Special Election Held On Nov 7, 1961 - 09/28/1961AN ORDINANCE ORDERING A SPECIAL ELECTION IN THE CITY OF LUBBOCK TO BE HELD ON THE 7TH DAY OF NOVEMBER, 1961, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF THE CITY OF LUBBOCK FOR ADOPTION OR REJECTION PROPOSED AMENDMENTS TO THE EXISTING CHARTER OF THE CITY OF LUBBOCK; PROVIDING FOR PUBUCA· T!ON OF NOTICE OF ELECTION IN SOME NEWSPAPER OF GENERAL CIRCU- LATION TO BE PUBLISHED IN THE CITY OF LUBBOCK ON THE SAME DAY IN I EACH OF TWO {2) SUCCESSIVE WEEKS; PROVIDING FOR BALLOTS; DESIGNA-II TING THE PlACES AT Wl:llCH SAID ELECTION WILL BE HELD AND APPOINT- ING PRESIDING OFFICERS THEREOF. WHEREAS, the Charter of the City of Lubbock has not been altered, changed, or amended within the two (2) years prior to the 7th day of November, 1961, and; I WHEREAS, at the request of the City Commission of the City of Lubbock, I a Charter Study Committee, has, after many sessions of study and conferences, I submitted and proposed certain amendments to the existing Charter of the City of Lubpock, which it considered to be somewhat necessary to the general welfare of the inhabitants of the City of Lubbock; and, WHEREAS, certain other interested citizens have requested submission of a Charter provision to establish and maintain a municipal museum for the City of Lubbock to be established and maintained by annual appropriations from the general funds of an amount equal to 1/2 mill per one dollar valuation of the tax- able property of the City of Lubbock and to levy a tax thereon to provide for such appropriation for a period of fifteen years; and, II WHEREAS, the proposed amendments submitted on unanimous approval of II quorutms. present and voting by the Charter Study Committee appear to be neces-ll sary to the general welfare of the City of Lubbock; and, I WHEREAS~ it appears out of fairness and in accord with the democratic I way of life of our community, State and Nation that the proposition to establish· : _ and maintain a municipal museum should be included in a call of a Special I Election for the purpose of altering and amending the Charter of the City of II Lubbock; and, · ~ WHEREAS, it appears that the laws of the State of Texas governing and II controlling the qualifications of voters at elections voting on questions of a genera~ nature concerning the general weliare are different from those qualifications for voters voting at an election for purpose of issuing bonds or otherwise lending credit, or expending money or assuming any debt; and, WHEREAS, because there exists under the law of the State of Texas this difference in qualification of voters it appears to the City Commis1f1on1~at the 1 proposed amendments proposed by the Charter Study Committee/be ~raced on ll ballot separate and apart from the amendment to establish and maintain a muni- cipal museum; and, WHEREAS~ the City Commission of the City of Lubbock, Texas, deems it proper to submit to the qualified voters of said City of Lubbock proposed amend- ments to the present existing Charter of the City of Lubbock1 as hereafter provide , at a Special Election for the purpose of adoption or rejection such amendments, to NOW THEREFORE: . be held on the 7th day of November, 1961, at the places hereafter designated; L / .·. BE IT ORDAINED BY THE CITY COMl\AlSSION OF THE CITY OF LUBBOCK: SECTION 1. THAT a Special Electinn be and is hereby ordered to be held on the 7th day of November, 1961, for the purpose of submitting to the qualifi ~d voters of the City of Lubbock for adoption or rejection, the following proposed amendments to the existing Charter of the City of Lubbock: AMENDMENT NO. 1 THAT Section 15 (i)~ Chapter 1, Article II, of the Charter of the City of Lubpock, Texas, which now reads as follows, to-wit: "(i) Any property owner, or railway or street railway, or anyone else interested or affected and against whom or whose property an assessment or re-assessment has been made, shall have the right within twenty days thereafter to bring suit in any court having jurisdiction, to set aside or correct the same either in whole or in part for or on account of any error, irregularity or invalidity in the amount thereof or in any proceeding with reference thereto, but thereafter such owner and all others in anywise interested or affected shall be barred and estopped from any such action and from in anywise contesting the validity or enforcement of any such assessment or re-assessment in any action in which the same may be brought in question. If such suit be brought, the construction of the improvements may be suspended until the final determination thereof. 11 BE amended to read hereafter as follows, to-wit: "(i) Any property owner, or railway or street railway, or anyone else interested or affected and against whom or whose property an assessment or re-assessment has been made, shall have the right within the period of time provided by law of the State of Texas to bring suit in any court having jJrisdiction, to~a..et aside or correct the same either in whole or in part for or on account of any error, irregularity or invalidity in the amount thereof or in any proceeding with reference thereto, but thereafter such owner and all others in anywise interested or affected shall be barred and estopped from any such action and from in anywise contesting the validity or enforcement of any such assessment or re-assessment in any action in which the same may be brought in question. If such suit be brought, the construction of the im- provements may be suspended until the final determination thereof. 11 .. j AMENDMENT NO. 2 THAT Section 2,, Chapter 1, Article n~ of the Charter of the City of Lubbock, Texas, which now reads as follows, to-wit: ''There is hereby created and established a Park Commission to be composed of five (5) members, all residents of the City of Lubbock, and who shall be officially designated as ParkCom- missioners of said City. Said Park Commissioners shall hold their offices for terms of one, two, t hree, four and five years, respec- tive ly, and until t~eir successors are appointed. The general control and supervision of the parks within the City of Lubbock, now or hereafter to be acquired, is heYeby vested in said Park Commission and all funds set apart for said parks, subject to the ~pproval of the governing authorities, shall be under the control of said Commissioners, any three of whom shall constitute a quorum for the transaction of business of said Park Commission. 11 11 Upon the death, r esignation, removal or expiration of term of office of any of said Park Commissioners, the two remaining Park Commissioners sha ll nominate a third member for his suc - cessor, and upon approval by the governing authorities of such nomination, such persons shall b ecome a member of said board and shall hold his position for the term of f our years; provided, that if it appears to the governing authorities, that the person s o nominated is an unfit or unsuitable person for such b oard, the governing authorities may elect a member of its own choice. No salary or compensation of any sort shall be paid to said Park Commissioners, or any of them, for their services. 11 "The amount appropriated out of the general funds each fiscal or current year for the support and maintenance of the public parks within the City, shall be delivered to the Park Commissioners and their receipt taken therefor, and w arrants on said funds shall b e drawn by the Park Commissioners upon the signature of at least two of its said members. And no debt shall be contracted by said Park Commission nor any member thereof, on account of the public parks and playgrounds of the City, unless so directed and authorized by the governing authorities, nor shall any d ebts ever be created by said Park Commission on account of the maintenance and operation of the parks and public grounds of the City in any one year~ in excess of the appropriation for such purposes for the current year. 11 "The Park Commission shall make reports of the expenditures of said funds entrusted to them, from time t o time as requested by the governing authorities of the City, and shall in any event, make an annua l report of the receipts and disbursements of all funds coming into their hands for the support and maintenance of the public parks and playgrounds of the City, which report S.b:all be filed with the person exercising the duties of City Secretary, and shall be open to public inspection at all times. 11 BE amended to read hereafter in full as follows, to-wit: "Section 22. The City Commission shall by Ordinance create and establish a Park and Recreation Board,and may from time to time delegate all or any part of the general control and supervision of the parks within the City of Lubbock, now or hereafter to be ac- quired, to said Park and Recreation Board, but the exercise of any such delegated authority shall be subject to the final approval of the City Commission. 11 AMENDMENT NO. 3 THAT the twenty-seventh paragraph of Section 23, Chapter 1, Article II of the Charter of the City of Lubbocl<:, Texas, which now reads as follows, to-wit: "To provide for the enforcement of all ordinances enacted by it, by a fine not to exceed one hundred {$100) dollars, or by imprisonment for not exceediqg fifteen (15) days or both such fine and imprisonment provided that no ordinance shall prescribe a greater or less penalty taan is indicated for a like offense by the laws of the State, except that the Commission may provide a different penalty for the obstruction and encum- brance of its streets, alleys, avenues, and highways, from that provided by the State law. 11 BE amended to read hereafter as follows, to-wit: "To provide for the enforcement of all ordinances enacted by it, by a fine not to exceed two hundred {$200. 00) dollars, provided that no ordinance shall prescribe a greater or less pen- alty than is indicated for a like offense by the laws of the State. 11 AMENDMENT NO. 4 THAT Chapter 1, Article II, of the Charter of the City of Lubbock, Texas, Be amended by the addition thereto of a new and additional section, to be designate ~ Section 25, which shall read hereafter in full as follows, to-wit: 11Section 25. The City of Lubbock shallnot permanently abandon the land, or buildings s used and known as the Lubbock Municipal Auditorium-Coliseum, unless such abandonment is authorized by a majority vote of the qualified tax-paying voters at a general or special election held in accordance with law; provided, however, that no election shall be required prior to the sale or other disposition of fixtures, equipment, furnishings or appurtenant structures which have become obsolete or which are no longer necessary or desirable to the-continued operation of such Lubbock Municipal Auditorium-Coliseum. 11 AMENDMENT NO. 5 THAT Chapter 1, Article III of the Charter of the City of Lubbock, Texas, BE amended by the addition thereto of. a new section to be designated Section lA, which shall read hereafter as follows, t&-wit: 11Section lA. The City Commission may by.; Ordinance establish such Corporation Courts as may be determined necessary. Such Courts shall each be presided over by a judge to be known as the Judge or Recorder of such Court, whose appointmlent shall be made, term of office established, duties defined and compensation fixed by the governing authority of the City. In the case of absence or dis- qualification for any cause or reason of the regular or acting judge of any of said Courts, the City Commission may designate a Special Judge to fill such temporary vacancy." AMENDMENT NO. 6 THAT Section 8, Chapter 1, Article VII, of the Charter of the City of ' Lubbock, Texas',. which now reads as follows, to-wit: "The Mayor and other four Commissioners of the City shall constitute the Board of Equalization, whose duties shall be to equalize, upon proper notice and hearing, the values of all property rendered for taxation in the City of Lubbock1 and the Commissioners may enact and enforce all ordinances neces- sary to regulate and control the equalization of such values." BE amended to read hereafter as follows, ti>-wit: "The City Commission shall annually apoint not less than five {5} members, each a qualified voter, a residen:t, and pro- perty owner of the City, who shall constitute a Board of Equaliza- tion, and such Board of Equalization shall have the duty to equalize in the manner provided by law the values of all property rendered for taxation in the City of Lubbock. The Board of Equalization shall further exercise all duties and all powers by law and by ordinance for a Board of Equalization and the City Commission may enact and enforce all ordinances necessary to regulate and control the equalization of such values." u AMENDMENT NO. 7 THAT Section 2, Chapter 1, Article IX, of the Charter of the City of Lub- bock, Texas, which now reads as follows, to-wit: 11 The Mayor shall serve for a term of two years, and each Commissioner shall serve for a ter~ of four years, and until their successors are elected and qualified, unless sooner removed from office as herein provided. Upon their qualifications after the first election after the adoption of this amendment the com- missioner shall draw lots for the term of office, two of them shall dr aw for the term of two years and two of them shall draw for the term of four years, those drawing for the twO" years term shall hold office for the said term of two years, and those drawing for the four year term shall hold office for said term of four years. 11 BE amended to read hereafter as follows, to-wit: 11 The Mayor shall serve for a term of two years, and each Commissioner shall serve for a term of four years, and until their successors are elected and qualified, unless sooner re- ll)oved from office as herein provided. Upon their qualification...'l after the first election after the adoption of this amendment the com- missioners shall draw lots for the term of office, two of them shall draw for the termd two years and two of them shall draw for the term of four years, those drawing for the two year term shall hold office for the said term of two years, and those".drawing for the four year term shall hold office for said term of four years. 11 AMENDMENT NO. 8 THAT the second paragraph of Section 5, Chapter I, At-ticle IX of the Charter of the City of Lubpock, Texas, which now reads as follows, to-wit: "Each candidate for Commissioner shall designate in the announcement of his candidacy, and in this request to have his name placed on the official ballot, the number of the place on the Board of Commissioners for which he desires to become a candidate, and such request to be placed on the official ballot shall be filed in writing with the person exercising the duties of City Secretary at least ten days before such election shall be held. 11 BE amended to read hereafter as follows, to-wit: 11Each candidate for Commissioner shall designate in the announcement of his candidacy, and in the request to have his name" placed on the official ballot, the number of the place on the City Commission for which he desires to become a candidate, and such request to be placed on the official ballot shall be filed in writing with the person exercising the duties of City Secretary at least thixty (30) days before such election skall be held." AMENDMENT NO. 9 THAT Section 17, Chapter 1, Article IX, of the Charter of the City of Lub bock, Texas, which now reads as follows, to-wit: 11An emergency measure is an ordinance or resolution for the immediate preservation of the public peace, property, health, or safety, or providing for the usual daily operation of a municipal department, in which the emergency is set forth and defined in a preamble thereto. Ordinances appropriating money, not exceeding Two Hundred and Fifty ($250. 00) Dollars, and ordinances for the payment of salaries and wages, may be passed as emergency measures, but no measure making a grab.t, renewal or extension of a franchise, or other special privilege, or regulating the rate to be charged for its eervices by any pub- lic utility, saall ever be passed as an emergency measure." Ordinances appropriating money not exceeding $2, 000. 00 and ordinances for the payment of salaries and wages, may be passed as emergency Bleasures, but no measure making a grant, renewal or extension of a franchise, or other special privilege, or regulating the rate to be charged for its se:r.vices by any public utility, shall ever be passed as an emergency measure. 11 AMENDMENT NO. 10 THAT Section 2?-j Chapter 1, Article IX of the Charter of the City of Lub- bock, Texas, which now reads as follows, to-wit: "The Commission shall create and consolidate such appoin- tive offices as may divide the admini~tration of the City affairs into such departments, as they may deem advisable, and may discontinue any such appointive officer or department at their discretion, except the office of City Manager. 11 liThe Commission, at its first meeting after election, or as soon thereafter as may be practicable, shall, by a majority vote, designate from among their members. 11 HOne Commissioner who shall be known as "Police and Fire Commissioner," and who shall have under his special charge the enforcement of all police regulations of said City, and general supervision over the first department thereof. 11 "One Commissioner to be known as the 11Commissioner of Streets and public property, 11 who, except as herein otherwise provided, shall have under his special charge the supervision of the streets, alleys public grounds and oth:~er property of said City, and be charged with the duty of lighting the streets and keeping the streets, alleys, public grounds and property in a clean and sanitary condition, and with the enforcement of all rules and regulations necessary to, these ends, and who shall also have under his special charge the supervision of all public improvements, except as herein otherwise provided, and shall see that all contracts therefor are faithfully complied with. 11 "One Commissiorer1ob.eknown as the "Commissioner of Public Utilities,'' who shall have under his special charg.e the construction, maintenance and operation of the waterworks, sewer system, electric light and power plant and departments, of said City, and shall see to the enforcement of all regula- tions with respect to said departments and with respect to all the revenues pertaining thereto. 11 "One Commissioner who shall be known as the "Commissioner of Finance and Revenue," who shall have under his special charge the enforcement of all laws for the assessment and collection of taxes of every kind and collection of all such revenues belonging to said City from whatever source the same may be derived, and who shall also examine into and keep informed as to the finances of said City. 11 11It is expressly provided that the number by which a Commis- sioner was designated upon the official ballot shall bear no relation to and shall in no manner be considered in the determination of the particular position or office to be assigned to any Commissioner. Sam Commissioner shall perform all of the executive duties of the respective departments to which they may be assigned1 as above provided, but said Commission, as a whole, shall have supervision of and be responsible for the administration of each of said depart- ments. 11 "The Commissioner named as the head of each department shall audit all accounts o.~.· claims against it, unless he be absent or fail or refuse to do so, in whi.ol:u event the Mayor shall appoint another Commissioner to act in his stead during his absence or to audit such claims and accounts as the said Commissioner shall fail or refuse to act upon; but before payment all accounts shall be acted upon and approved by the whole Commission at a meeting of said Commission. '1 BE amended to read hereafter in full as follows, to-wit: 11 The City Commission shall create and consolidate such appointive offices as may divide the administration of the City affairs into such departments, as it may deem advisable, and may discontinue any such appointive officers or departments at its discretion, except the office of City Manager. 11 AMENDMENT NO. 11 THAT Section 27, Chapter 1, Article IX, of the Charter of the City of ·Lubbock, Texas, which now reads as follows, to-wit: 11All contracts for public pdnting, public improvement and public works of every kind and character, and the purchase of supplies for use in any de.rartment of the CityJ exceeding an expenditure of One Hundred l$1 00. 00} Dollars shall be let on sealed competitive bids. 11 BE amended to read hereafter as follows, to-wit: 11All contracts for public printing improvements and public works of every kind and character, and the purchase of supplies for use in any department of the City, exceeding an expenditure of Two Thousand ($2, 000. 00} Dollars shall be let on sealed competitive bids, all other contracts of similar kind and character for less than Two Thousand ($2, 000. 00} Dollars shall be let on such terms and conditions as may be established by the City Commission of the City of Lubbock. 11 AMENDMENT NO. 12 THAT Section 30, Chapter 1, Article IX of the Charter of the City of Lub- bock, Texas, which now reads as follows, to-wit: 11 The Mayor shall give an official bond in the sum of Five Thousand Dollars {$5, 000. 00) and each Commissioner shall give an official bond in the sum cl. Twenty-five Hundred Dollars ($2, 500. 00) and the person exercising the duties of City Tax Collector shall give an official bond in the sum of Ten Thousand Dollars ($10, 000. 00) and the City Secretary shall give an official bond in such sum as the City Commission from .fi111.;e to time shall prescribe. All bonds referred to in this Charter shall, in each instance, be conditioned for the faithful discharge of the duties of such officer. or _ employee for the faithful accounting of all moneys and things of value coming into the hands of such officer or employee. All such bonds shall be procured from some . - regulaiyaccredited surety company authorized to do business under the laws of the State of T exaj~, the premium therefor-shall be paid by the City of Lubbock provided that the Commission may require an official bond from any other appointive officer or employee of the City in such amount and condition as they deem best for the efficiency of public service. All official bonds shall be approved by the Commission, and filed and recorded with the person exercising the duties of City Secretary. 11 and all of that Section 5, Chapter 1; Article X of the Charter of theCity of Lub- bock, Texas, which now reads as follows, to-wit: 11 The City Manager shall give an official bond in the sum of Five Thousand ($5, 000. 00) Dollars, payable to the City of Lub- bock, conditioned as may be prescribed by resolution or ordinance of the Commission. Such bond shall be procured from some regularly accredited surety company, authorized to do business under the laws of the State of Texas, and the premiums to such surety company shall be paid by the City of Lubbock. 11 BE combined and amended to appear hereafter as Section 30, Chapter 1, Article IX, and read hereafter in full as follows, to-wit: "The Mayor shall give an official bond in the sum of Five Thousand ($5, 000. 00) Dollars and each Commissioner.·shall give an official bond in the sum of Twenty-five Hundred ($2, 500. 00) Dollars and the persons exercising the duties of City Tax Collector, City Secretary and City Manager, shall give official bonds in any sum,not less than Twenty-five Thousand ($25, 000. 00) Dollars, as. the City Commission from time to time shall prescribe. All bonds referred to in this Charter shall, in each instance, be conditioned for the faithful discharge of the duties of such officer or employee for the faithful accounting of all moneys and things of value coming into the hands of such officer or employee. All official bonds shall be approved by the I· Commission1 and filed and recorded with t4e peBson exercising the / duties of City Secretary. 11 ~~~----================--=====-=--=--====~~ AMENDMENT NO. 13 THAT Chapter 3 be amended by adding Ai'ticle II as follows: liThe City Commission is authorized to establish and main- tain a municipal museum~ including site, buildings~ equipment~ collections and shall by Ordinance provide for maintenance~ op- eration, control and supervision over the establishment and maintenance of such municipal museum, and appropriate annually from the general fund of the City of Lubbock one half (1/2) mill on the one dollar valuation of the taxable property of the City of Lubbock for a period of fifteen years from fiscal year 1962-1963 to 1976-1977 inclusive, and levy a tax sufficient to raise such amount; thereafter such annual appropriation of one (1/2) half !Jlill on the one dollar valuation of the taxable property of the City of Lubbock shall cease and the operation and maintenance of the museum may be provided for by the City Commission in the annual budget for the City of Lubbock." SECTION 2. Said. II which relates to the establishment and maintenance of a municipal museum by the annual appropriation from the general fund of the City of Lubbock one half (1/2) mill on the one dollar valuation of the I taxable property of the City of Lubbock for a period of fifteen years and !eying a tax sufficient to raise such amount for a period of fifteen years beginning with the fiscal year 1962-1963 to 1976-1977 inclusive, such annual appropriation of one half (1/2) mill on the dollar valuation of taxable property of the City of Lubbock to thereafter cease and operation and maintenance to be provided by the .City Commission in the annual budget for the City of Lubbock. SECTION 7. THAT pursuant to Section 1, Article 1170, Revised Civil Statutes of Texas, 1925, as amended by the 57th Legislature of the State of Texas and as directed therein notice of the election herein ordered shall be given by pub" j lication of this Ordinance in some newspaper of general circulation published in the City of Lubbock and the City Secretary-Treasurer is hereby directed and authorized to cause to be published, in such newspaper this Ordinance on the same day in each of two (2) successive weeks; the date of the first publication to be not less than fourteen {14) days prior to November 72 1961, the date set for said Special Election as herein ordered and provided for. SECTION 8. The Chief of Police is hereby directed to post a properly ex- ecuted copy of this Ordinance as notice of election at the polling places hereinabove designated in Section 2 hereof at least twenty (20) days before said Election date an the officer posting notices shall make due return showing such posting in accordance with this order. The City Secretary-Treasurer shall serve a duly certified copy of this Ordinance ordering and calling the special Election herein provided for upon each of tl;le Election Judges and Assistant Judges named herein. Such service shall be znade by registered mail addressed to each official within twenty (20) days from the date of passage of tl:is Ordinance. SECTION 9.
