AN ORDINANCE ABANDONING AND CLOSING A PARKING LOT AREA, IF
ANY, LOCATED IN BUENAS CASAS ADDITIONOTO THE CITY OF LUBBOCK,
LUBBOCK COUNTY, TEXAS, 'AS MORE PARTICULARLY DESCRIBED IN THE
BODY OF THIS ORDINANCE; AND DIRECTING THE CITY ENGINEER TO MARK
THE OFFICIAL MAP OF THE CITY OF LUBBOCK TO INDICATE THE CLOSING
AND ABANDONMENT OF SAID PARKING LOT, IF ANY, AS AFORESAID.
WHEREAS, the dedication, if any, herein considered is not certain and clea
enough to say without reservation that it is a binding dedication, due to the fact
that the dedication deed makes mention of a parking area, but on the final plat
there is not lettered in as 11Parking Area" or some other designation to delineate
what is the parking area; and,
WHEREAS, the City of Lubbock has taken no formal action as a matter of
public record accepting the dedication, nor has it by its conduct with regard to
the area accepted the dedication by conduct; and,
WHEREAS, it is questionable whether the dedication, if any, considered
herein was intended by the developers to dedicate this aroEB. as a parking area for
0 the public use; and, 0
WHEREAS, said area was dedicated, if it is so construed, to the City of
Lubbock, and to the public without solicitation or request on the part dthe City
of Lubbock; and,
WHEREAS, it is questionable whether the d~dication of a "Parking Area11 is
a proper use for a dedication to a city, and to the public; and,
WHEREAS, a "Parking Area" has not been, and is not now, necessary for
construction, maintenance, or use for public purposes; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT a portion of Buenas Casas Addition, as hereinafter
described, shall BE and the same is hereby closed, vacated and abandoned for
parking lot purposes and for public use; aaid tract of land being particularly
described as follows, to-wit:
BEGINNING at the Northwest corner of Lot 156, Buenas Casas
Addition to the City of Lubl:>ock, Lubbock: County, Texas;
THENCE North 89°59'3011 East 140 feet to the Northeast corner
of Lot 156;
THENCE South 0°00t3011 East 147.57 feet to the Southeast corner
of Lot 156;
THENCE North 89°34' East 350 feet to the Southwest corner of
Lot 146;
THENCE North 0°00t3011 West 194.95 feet to the most Westerly
Northwest corner of Lot 139;
THENCE North 44°59f3011 East 90 feet to the most Northerly corner
of Lot 139;

THENCE North 45°00'3011 West 60 feet to the most Easterly
corner of Lot 119;
THENCE South 44059'3011 West 90 feet to the most Southerly
corner of Lot 119;
THENCE North 45°00'3011 West 137. 96 feet to the Southeast
corner of Lot 114;
THENCE South 89°59f3011 West 350 feet to the Southwest
corner of Lot 101;
THENCE South 0°00'301' East 190 feet to the PLACE OF
BEGINNING.
SECTION 2. But without prejudice to any public or private easements heret -
fore granted by instrument, or instruments of record, and expressly without
prejudice to the drainage easement of record in Volume 839 P. 28, and Volume
841 P. 677, D eed Records of Lubbock County, Texas, bound and described par-
ticularly as follows, to-wit:
BEGINNINCi at a point which is 12 feet South 4S000'3011 1East of
the Southeast corner of Lot 119, Buenas Casas Addition to the City
of Lubbock, Lubbock County, Texas;
THENCE South 45°00'3011 East 36. 0 feet;
THENCE South 0°00'3011 East 2.03. 50 feet;
THENCE South 89°34' West 24.45 feet;
THENCE North 0°00'3011 West 229. 15 feet to the POINT OF
BEGINNING.
SECTION 3. THAT the City Engineer is hereby authorized and directed to
mark the official map of the City of Lubbock to indicate that the portion of Buenas
Casas Addition as described in Section 1 hereof, has been closed and abandoned,
showing the number of this Ordinance and the date of its final passage.
AND IT IS SO ORDERED
