AN ORDINANCE AMENDING CHAPTER 18 OF THE CODE OF ORDINANCES g.,. 1~' OF THE CITY OF LUBBOCK. TEXAS, SO AS TO ADD THERETO ARTICLE IX DEALING WITH SCHOOL CROSSING GUARDS; ESTABUSIDNG THE POSITION AND SETTING QUALIFICATIONS THEREFORE; SETTING OUT THE DUTIES OF SUCH SCHOOL CROSSING GUARDS; REQUIRING THEIR OBSERVATION AND REPORTING OF TRAFFIC LAW VIOLATIONS; PROVIDING FOR UNIFORMS AND OTHER EQUIPMENT; SPECIFICALLY DECLARING THAT SUCH GUARDS ARE NOT PEACE OFFICERS AND DECLARING AN EMERGENCY. WHEREAS, the City Commission finds it necessary and essential to provide for school crossing guards for the protection of school children going to and from school;and, ~ WHEREAS, it is necessary for the immediate preservation of the public healt and safety due to the imminent b eginning of a new school year to enact such measures, which constitutes an emergency; NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Chapter 18 of the Code of Ordinances of the City of Lub- bock, Texas, BE and the same is hereby amended by the addition thereto of Article XI, entitled 11School Crossing Guards", which shall read hereafter a in full as follows, to-wit: Article XI. School Crossing Guards Sec. 18-154. School Crossing Guards There is hereby established and created the position of "school crossing I guard". Such positions may be filled by either men or women whose qualifica- 1 tions, both physical and educational, will permit the performance of the duties of school crossing guards as defined hereinafter and in accordance with such require ments that may be established from time to time by the city manager. All school crossing guards shall be under the immediate supervision and control of the traffic engineer and shall be a part of the traffic engineering department, and l shall receive such salaries as may from time to time be established by the Budget of the City of Lubbock. Sec. 18-155. Same---Duties. It shall be the duty of each school crossing guard to assist the crossing by I school children in the safest manner possible at the cross-walk to which he or she is assigned, assisting the crossing of such children individually or in groups, as the volumes of pedestrian and vehicular traffic may dictate. Such school crossing guard, having a child or children to escort across such crosswalk,shall, before allowing such children to enter such cross-walk, himself step from the curb or shoulder of the roadway into such cross-walk, when such movement may be made with safety, and by the use of his or her hands, or such flags, whistles or hand- t signs a s may be furnished, attract the attention of approaching motorists and wait I until all vehicles immediately approaching such cross-walk are stopped before ~: 1 t: signalling the waiting children to enter such cross-walk. The school crossing guard shall remain in such cross-walk until the crossing child or children shall have reached the opposite curb, then himself 4).liC.kly resume his post and allow the flow of vehicular traffic to resume. School crossing guards, when not attempting to stop vehicular traffic for the crossing of children, shall stand back from the cro s- walk and keep all flags or handsigns furnished him furled or hidden from the view of approaching traffic. - Sec. 18-156. Same---Observance of Law Violations. It shall be the duty of school crossing guards to observe and write down the name~ if known, the license number, and the description of all drivers violating traffic laws or ordinances in the vicinity of their assigned post, and to report sue information to the Police Department as soon as possible. Sec. 18-157. Same---Uniform and Equipment. School crossing guards shall perform their duties only in such uniforms, gar , dress or other clothing as approved by the traffic engineer with the consent of the] city manager. School c.,ossing guards may further be issued such badges or other forms of identification, and equ:i,.pped with such whistles, flags, or handsign j as deemed by the traffic engineer with the approval of the city manager most likely,; to catch the attention of motoristsand warn such motorists that they are approach- ing a school crossing. Provided however~ that no uniform, badge or other item of equipment issued such school crossing guards shall be of the aame design, shape or color as the uniforms or equipment worn or carried by members of the Police Department of the City o£ Lubbock. Uniforms and badges shall be worn by such school crossing guards only while at their assigned post of duty and while traveling between such assigned post to their place of residence. Sec. 18-158. Same---Not Peace Officers Nothing in the preceeding four sections shall in any manner be construed as granting or establishing in school eros sing guards the powers or authority of a peace officej:', and such school crossing guards shall be strictly limited and con- fined to the exercise and performance only of those duties provided for in the preceeding four sections. SECTION 2. Due to the traffic conditions creating a hazard injurious to the public and the public1 s use of the streets, the enactment of this Ordinance is declared to be an emergency measure, thereby creating a public necessity that the rule requiring proposed Ordinances to be presented at two (2} separate meetin s be dispensed with; and this ordinance shall be effective from the date of its passage.
