AN ORDINANCE AUTHORIZING THE ALTERING AND CHANGING OF THE
PRIMA FACIE SPEED LIMIT TO 30 MILES PER HOUR ON THOSE PORTIONS OF
THAT STREET DESCRIBED AS FOLLOWS: PARK ROAD 18,_ TRAVERSING
MACKENZIE STATE PARK IN THE CITY OF LUBBOCK,. LUBBOCK COUNTY •
TEXAS,. SAID PARK ROAD 18 CONSISTING OF ALL PAVED,, HARD-SURFACED
OR GRAVELED ROADWAYS OPEN TO VEHICULAR TRAVEL WITHIN THE BOU:ND-
ARIES OF SAID MACKENZIE STATE PARK. AS MORE PARTICULARLY SHOWN'
IN RED ON THE MAP OF SAID MACKENZIE STATE PARK ATTACHED HERET~
SAID MAP BEING INCORPORATED HEREIN BY REFERENCE FOR ALL PUR-
POSES; AUTHORIZING THE PLACING OF SPEED LIMIT SIGNS; PRESCRIBING
A PENALTY; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGEN< Y~
AND PROVIDING FOR THE EFFECTIVE DATE OF TinS ORDINANCE.
·WHEREAS,. the governing body• as authorized by Article 827a~ Sec. Sa
Vernon1s Annotated Penal Code1 finds that certain prima facie speed limits on
certain highways are different from what is reasonable or safe and should be
altered and the immediate preservation of public health and safety requires
immediate alteration of said prima facie speed limits as hereafter set forth,.·
which creates an emergency; NOW THEREFORE.~
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION I. The prima facie speed limit established by Article 827a, Sec.
81 Subsection 1 (b),. Vernon's Annotated Penal Code is altered and changed for
all vehicles to 30 miles per hour on the following designated highway or street
in the corporate limits of the City of Lubbockl' Lubb~ck County, Texas~ to-wit:
Park Road 18, traversing Mackenzie State Paik in the
City of Lubbock, Lubbock County, Texas said Park Road
18 consisting of all paved, hard-surfaced or graveled
. roadways open to vehicular travel within the boundaries
of said Mackenzie State Park,. as more particularly shown
in red on the map of said Mackenzie State Park attached
hereto, said map being incorporated herein by reference
for all purposes.
SECTION 2. The City Manager is authorlzed and directed to cause the plac
ing of signs so as to clearly define the limits of the prima facie areas set out in
this Ordinance.
SECTION 3. Any person, firm or COfpOration '\lolating the prima facie speer
limit established by this Ordinance shall upon conviction be fined in any sum not t
exceed TWO HUNDRED DOLLARS ($200. 00) and for subsequent violations within
one year thereafter shall be prosecuted as prescribed for such violations by Sec.
15 of Article 827a:l Vernon1s Annotated Penal Code.
SECTION 4. The City Secretary is authorized and directed to cause the
publication of the descriptive caption of this Ordinance together with the penalty
provision as an alternative method of publication as provided by law.
SECTION 5. The fact that public necessity and convenience requires that
this Ordinance be passed as an emergency measure for reason~ set forth in the
preamble hereof• the rule requiring that no Ordinance shall be finally passed on
the day of its introduction be suspended~ and this Ordinance is declared to be an
emergency measure to take effect for and after its passage.
