AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AN:d ¥
OFFICIAL MAP OF THE CITY. OF LUBBOCK SO AS TO MAKE THE FOLLOW-
ING CHANGE: ZONE CASE NO. 914 : CHANGE LOT ZOa BLOCK 13, 0 1NEAL
TERRACE ANNEX. AN ADDITION TO THE CITY OF LUBBOCK,. LUBBOCK
COUNTY • TEXAS,. FROM AN 11R-Z11 TO A "C-3" ZONING .DISTRICT.; (SAID
PROPERTY BEING LOCATED ON THE NORTH SIDE OF Z8TH STREET IN THE
1700 BLOCK); SUBJECT TO CONDITIONS:
WHEREAS,, the proposed change in zoning districts as hereinafter made has
been duly presented to the Zoning and Planning Commission for its recommenda-
tio~ which was received by the City Commission and.after due consideration, the
City Commission finds that making the proposed change as hereinafter set out wil
be in the public interest; and#
WHEREAS6 all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with,. as well as giving
notices in compliance with Section ZO of Ordinance No. 1695 as well as notices
provided by Article 10 11£~ Vernon1s Annotated Civil Statutes; amended in 1953,
and notice was duly published in the Lubbock Morning Avalanche Journal more
than fifteen (15) days prior to the date of the public hearing before the City Com-
mission on such proposed amendment, and the public hearing according to said
notice was duly held in the Assembly Room of the Central Fire Station Building,.
located ~t 503 Avenue Kin Lubbock1 Texas, at which time persons appeared in
support of the proposali and,. after said hearing" it was by the City Commission
determined that it would be in the public interest,, ·due to changed conditions~ that
the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter
set forth in the body of this Ordinance and this Ordinance having been introduced
in final written form prior to first reading hereof; NOW,. THEREFORE,.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE an
the same are hereby amended as follows, to-wit:
ZONE CASE NO.; 914
Change Lot ZO~ Block 13:~~ 0 1Neal Terrace Anne~ an addition
to the City of Lubbock,. Lubbock County, Texas, from an
"R-2" to a 11C -3" zoning district. (Said property being located
on the North side of 28th Street in the 1700 Block}; Subject to
the following condition:
Applicants for Zone Change in Zon~ Case No. 914 have pro-
posed to the City Commi~sion and agreed to limiting the use
of the premistts to uses incidental to the retail furniture store
operated by applicants in order that. the uses made of the pro-
perty herein concerned will be harmonious with existing develop-
ment in the vicinity=t and have agreed to such limitation by reason
of the fact that some uses otherwise usually permitted in the
nc-311 Zoning District would be inharmonious with development
in the vicinity. The property shall be limited to and by the
following uses and/ or conditions:

An employee t s parking lot.
A small service building for unloading furniture.
A basement foli' inside storage.
A six foot stockac;!e type fence along the West property boundary
line shall be constructed and maintained by property owners in
accordance with Zoning Ordinance No. 1695 with respect to fence •
In the event the property is used by its owners and/or occupants
for uses other than herein permitted and/ or is used or occupied
in violation of this ordinance,. such property shall ipso facto re-
vert back to the 11R-211 Zoning District.
SECTION 2. THAT from and after passage and effective date of this Ordi-
nance said lots~ tracts and parcels of land described in Section 1 hereof shall be
changed to the zoning district indicated and the Official Map is amended in accord
ance herewith.
AND IT IS SO ORDERED
