AN ORDINANCE AUTHORIZING THE ALTERING~~ -~~Rt~LG OF THE
PRIMA FACIE SPEED LIMITS FROM TI-URTY (30) MILES PER HOUR ON THE
FOLLOWING HIGHWAYS, STREETS AND/OR PARTS OF HIGHWAYS AND STREE
IN THE CORPORATE LIMITS OF THE CITY OF LUBBOCK, LUBBOCK COUNTY,
TEXAS, TO-WIT: TO FORTY-FIVE (45) MILES PER HOUR ON THAT PORTION
OF THE IUGHWAYS AND STREETS DESCRIBED AS THE WEST SIDE OF HIGHW
U. S. 87 {AVENUE 11 H11 ) BEGINNING AT THE TRAFFIC CIRCLE INTERSECTION
WITH I-llGHWAY U. S. 84 SOUTH AND EXTENDING SOUTH FOR O. 250 MILES T
THE POINT 106 FEET SOUTH OF THE CENTER LINE OF 66TH STREET; AND
INCREASING THE PRIMA FACIE SPEED LIMIT TO FIFTY {50) MILES PER HOU
ON THAT PORTION OF THE .HIGHWAYS AND STREETS DESCRIBED AS THE WE
SIDE OF IDGHWAY U. S. 87 {AVENUE "H"} BEGINNING O. 250 MILES SOUTH OF
THE TRAFFIC CIRCLE INTERSECTION WITH IDGHWAY U. S. 84 AND EXTEND
ING SOUTH FORO. 991 MILES TO THE POINT OF SOUTH CITY LIMITS; AND
INCREASING THE PRIMA FACIE SPEED LIMIT TO FIFTY-FIVE (5.6) MILES PE
HOUR ON THAT PORTION OF THE HIGHWAYS AND STREETS DESCRIBED AS

HOUR ON THAT PORTION OF THE IDGHWAYS AND STREETS DESCRIBED AS
THE EAST SIDE OF HIGHWAY U. S. 87 {AVENUE 11 H11} BEGINNING AT A POINT
O. 991 MILES FROM THE SOUTH CITY LIMITS AND EXTENDING NORTH FOR
O. 250 MILES TO THE TRAFFIC CIRCLE INTERSECTION WITH HIGHWAY U. S.
84; AUTIDRIZING THE PLACING OF SPEED LI:MIT SIGNS; PRESCRIBING A
PENALTY; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVID-
ING THAT HIGHWAYS, STREETS AND/OR PAR,'l'S OF lUGHWAYS AND STREETS
NOT SPECIFICALLY SET FORTH HEREIN SHALL NOT BE AFFECTED BY THE
PROVISIONS HEREOF AND THAT TillS ORDINANCE BE CUMULATIVE OF ALL
OTHER PRIMA FACIE SPEED LIMIT ORDINANCES EXCEPT THOSE WITH
WHICH IT CONFLICTS; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR
PUBLICATION; DEClARING AN EMERGENCY; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the governing body of the City of Lubbock has determined upon the
basis of an engineering and traffic investigation that the prima facie speed limits
set forth and established by Article 827a, Section 8, Vernonts Annotated Penal . .J
Code, as amended Acts 1951, 52 Leg., p. 589, ch. 346, Section 1, are less.-lthan
is reasonable and safe under the conditions fonnd to exist upon certain highways,
streets and/or parts of highways and streets at the locations named and designated
in the body of this Ordinance and in the corporate limits of the City of Lubbock, I
taking into consideration the width and conditions of the pavement and other cir-
cumstances on such certain highways, streets and/or parts of highways and street ,
as well as the usual traffic thereon; and,
BE IT ORDAINED BY THE CITY COMM.LSSION OF THE CITY OF LUBBOCK:
I SECTION 1. THAT from and after the effective date of this Ordinance the
prima facie speed limit established by Article 827a, Section 8, sub-section 1 (b)
(1), Vernon's Annotated Penal Code, as amended Acts 1951, 52 Leg., p. 589,
ch. 346, Section 1, is altered and increased for all vehicles to forty-five (45)
miles per hour on the following designated highways and streets in the corporate
limits of the City of Lubbock, Lubbock County, Texas, to-wit:
On the West side of Hi hwa U.S. 87 Avenue 11H'. beginning at
the Tr f1c ircle intersect10n with United States Highway 84
South and extending South 0. 250 miles to the point 106 feet South
of the center line of 66th Stree t. ·
SECTION 2. THAT from and after the effective date of this Ordinance the
~rima facie speed limit established by Article 827a, S e ction 8, sub-section 1 (b)
l1), Vernonts Annotated Penal Code, as amended Acts 1951, 5~ Leg., P• 589,
ch. 346, Section 1, is altered and increased for all vehicles to fifty (50) ~_iles
per hour on the following designated highways and streets in the corporate limits
Of the City of Lubbock, Lubbock County, Texas, to-wit:
SECTION 3. THAT from and after the effective date of this Ordinance the
prima facie speed limit established by Article 827a, Section 8, sub-section 1 (b)
(1), V:e rnonts Annotated Penal Code, as amended Acts 1951, 52 Leg., p. 589,
ch. 346, Section 1, is altered and increased for all vehicles to fifty-five (55)
I miles per hour on the following designated highways and streets in the corporate
limits of the Clty of Lubbock, Lubbock County, Texas, to-wit:
On the East Side of Highway . U.S. 87 Avenue "H11 beginning at the
South City limits and extending North or • miles.
SECTION 4. THAT from and after the effective date of this Ordinance the
prima facie speed limit established by Article 827a, Sect ion 8, sub-section 1 (b)
(1), Vernon's Annotated Penal Code, as amended Acts 1951, 52 Leg., p. 589.
ch. 346, Section 1, is altered and increased for all vehicles to fortl·five {45)
miles per hour on the following designated highway and streets in t e corporate
limits of the City of Lubbock, Lubbock County, Texas, to-wit:
SECTION 5. The City Manager is authorized and directed to cau~e the placing!
of signs so as to clearly define the limits of the prima facie areas set out in this
Ordinance.
SECTION 6. Any person, firm or corporation in violation of the prima facie
speed limits established by this Ordinance shall upon conviction be punished by a
fine not to exceed TWO HUNDRED ($200. 00) DOLLARS and for subsequent viola-
tions within one year thereafter shall be prosecuted as prescribed for such viola-
ltions by Article 827a, Section 15, Vernon's Annotated Penal Code.
SECTION 7 . That all Ordinances or parts of Ordinances conflicting with any
lof the provisions hereof are hereby repealed insofar as such conflict exists.
SECTION 8. All highways, streets and/or ;parts of highways and streets not
specifically set forth in the preceeding sections hereof shall not be affected by the
provisions hereof, and this Ordinance shall be cumulative of all other prima facie
speed limit Ordinances except those with which it specifically conflicts.
SECTION 9. Should any section, paragraph, sentence, clause, phrase or war
this Ordinance, or the application the reof to any person or circumstance~ be de-
lared unconstitutional or invalid for any reason, the remainder of this Ordinance
hall not be affected thereby.
SECTION 10. The City Secretary is authorized and directed to cause the pub-
. cation of the descriptive caption of the Ordinance together with the penalty provi-
ions as an alte rnative method of publication as prescribed by Article ll76b, ,

SECTION 11. The fact that a public necessity exists and convenience requir ~
that this Ordinance be passed aa an emergency measure for reasons that the
heavy flow of vehicular traffic through the highways, streets and/or parts of
highw~ys and streets herein designated constitutes a hazar~, dangerous to the
safety of persons and property, requiring all rules that no Ordinance be finally
passed on the date of its introduction be suspended; and this Ordinance is det.lare
to be an emergency measure, to take effect from and after the date of its
passage.
AND IT IS SO ORDERED
