LUBBOCK COUNTY, TEXAS, TO-WIT: ON THE WEST SIDE OF AVENUE Q BEGINNING O. 674 MILES FROM U.S. 87 AND EXTENDING SOUTH 0. 523 MILES; AUTHORIZING THE ALTERING AND CHA.NGING OF THE PRIMA FACzy: SPEED LIMIT FOR ALL VEHICLES TO FORTY (40) MILES PER HOUR I ON THE FOLLOWING HIGHWAY A ND STREET IN THE CORPORATE LIMITS OF THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS. TO-WIT: ON THE WEST SIDE OF AVENUE Q BEGINNING 1.197 MILES FROM U.S. 87 AND EXTENDING SOUTH O. 200 MILES; AUTHORIZING THE PLACING OF SPEED UMIT SIGNS; PRESCRIBING A PENALTY; PROVIDING FOR PUBLICATION; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING THAT STREETS OR HIQ}i- WAYS NOT SPECIFICALLY SET FORTH HEREIN SHALL NOT BE AFFECTED BY THE PROVISIONS S!EREOF AND THAT THIS ORDINANCE BE CUMUlATIVE OF ALL OTHER PRIMA FACIE SPEED Ll:MIT ORDINANCES EXCEPT THOSE WITH WffiCH IT SPECIFICALLY CONFLICTS; DECLARING AN EMERGENCY; AND PROVIDING FOR THE EFFECTIVE DATE OF TillS ORDINANCE. WHEREAS, the governing body, as authorized by Article 827a, Sec. 8, ern~n's .Annotated Pe~al Code, finds that certain prima facie speed limits on certa1n highways are different from what is reasonable or safe and should be altere n.d the im~edi~te pre~ervation of public health and safety requires immediate alte - bon of sa1d pnma fac1e speed limits as hereafter set forth, which creates an mergency; NOW THEREFORE: E IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SEC~ION I. The prima facie speed limit established by Article 827a, Sec. , Subsection 1 (b), Vernon's Annotated Penal Code. is altered and changed for all _) vehicles to forty (40) miles per hour on the following designated highways or streets in the corporate limits of the City of Lubbock, Lubbock County, Texas, to-wit: On the East side of Avenue Q beginning at Clovis Road and extending North 0. 2 miles. On the East side of Avenue Q beginning 0. 723 miles North of of Clovis Road and extending North 0. 653 miles. On the West side of Avenue Q beginning 0. 374 miles from U.S. 87 and extending South 0. 300 miles. On the West side of Avenue Q beginning 1. 197 miles from U.S. 87 and extending South 0. 200 miles. SECTION 2. The· prima facie speed limit established, by Article 827a, Sec. 8, Subsection 1 (b), Vernon's Annotated Penal Code is altered and changed for all vehicles to Fifty (50) miles per hour on the following designated highways or streets in the corporate limits of the City of Lubbock, Lubbock County, Texas, to-wit: On the East side of Avenue Q beginning 0. 2 miles North of Clovis Road and extending North 0. 523 ~~niles. On the West side of Avenue Q beginning 0. 674 miles from U.S. 87 and extending South 0. 523 miles. SECTION 3. The prima facie speed limit established, by Article 827a, Sec. 8, Subsection 1 ,(b), Vernon's Annotated Penal Code is altered and changed for all vehicles to Forty-five (45) miles per hour on the following designated highways or streets in the corporate limits of the City of Lubbock, Lubbock Count , Texas, to-wit: On the West side of A venue Q beginning at U.S. 87 and ext ending 0. 374 miles South. SECTION 4. The City Manager is authorized and directed to cause the placing of signs so as to clearly define the limits of the prima facie areas set out in this Ordinance. SECTION 5. Any person, firm or corporation violating theprima facie spee limit established by this Ordinance shall upon conviction be fined in any sum not to exceed TWO HUNDRED DOLLARS ($200. 00) and for subsequent violations with- in one year thereafter shall be prosecuted as prescribed for such violations by Sec. 15 of Article 827a, Vernon's Annotated Penal Code. SECTION 6. The C ity Secretary is authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty provision as an alternative method of publication as provided by law. SECTION 7. That all Ordinances or parts of Ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 8. All highways or streets not specifically set forth in the pre- ceeding sections htreof shall not be affected by the provisions hereof, and this Ordinance shall be cumulative of all other prima facie speed limit Ordinances except tho~ with which it specifiaally conflicts. .. SECTION 9. Should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any · reason, the remainder of this Ordinance shall not be affected thereby. SECTION 10. The fact that public necessity and convenience requires that this Ordinance be passed as an emergency measure for reasons set forth in the preamble hereof, the rule requiring that no Ordinance shall be finally passed on the day of its introduction be suspended, and this Ordinance is declared to be an emergency measure to take effect fran and after its passage.
