F :wg Repealed by Ordinance No. 4251 November 26, 1963 -OQ-19U> RDINANCE NO. 342:0 AN ORDINANCE DESIGNATING AND ESTABUSHING SCHOOL ZONES; ESTABLIS!llNG PRIMA FACIE SPEED LIMITS AT 20 :MILES PER HOUR DURING SCHOOL HOURS IN SUCH ZONES; DEFINING "SCHOOL HOURS"; MAKING IT UNLAWFUL TO PASS WITIDN SCHOOL ZONES; PRESCRIBING PENALTY FOR VIOlATIONS, PROVIDING FOR PUBLICATION AND DECLARING AN EMERGEN WHEREAS, the governing body of the City of Lubbock, upon the basis of an Engineering and Traffic investigation finds it necessary to alter prima facie spee limits established by Article 827a, Section 8, Subsection 1 {b) l, Vernon's Annotated Penal Code as amended Acts 1951, 52d Legislature, Page 589 Chapter 346, within the areas anli at the locations named and designated in the body of this Ordinance, all within the corporate limits of the City of Lubbock and in the immediate vicinity of school areas during periods of time· when schools are in seasion and achool children are going to or from schools and playgrounds there- with; and, WHEREAS, the governing body also finds it necessary to make provision for the regulation of moving vehicular traffic within such areas regarding passing and stopping for the protection ana safety of pedestrians crossing the streets within such areas; and, WHEREAS, it is necessary to the immediate preservation cf the public health and safety to provide for the immediate enactment of such measurers constituting an emergency, NOW THEREFORE: 1 BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT from and after the effective date of this Ordinance the following designated locations and areas are declared to be school zones and the prima facie speed limit of thirty (30) miles per hour as established by ARTICLE 827a, Section 8, Subsection 1 {b) 1, is hereby altered and changed to twenty (20} miles per hour for all vehicles, during school hours as herein defined on the following described streets, to-wit: I. On Clovis Road beginning at the Northwest side of the intersection of 2nd Street and extending No:t:thwest for 400 feetf, · 2. On East Broadway beginning at the West side of the intersection of Teak Avenue and extending West for 447 feet. 3. On 34th Street beginning, 130 feet West from the West side of the intersection of Avenue X on the South side of 34th Street and extending East for 566 feet. 4. On Avenue Q beginning f30 feet North from the North side of the intersection of 6th Street and extending SGtuth. for 736 feet. J. On Flint Avenue beginning 160 feet South from the South side of the intersection of 42nd Street and extending North for 1, 218 feet. On Flint Avenue beginning 180 feet North from the North side of the intersection of 26th Street and extending South for 300 feet. On Avenue H beginning 115 feet south of the South side of the intersection of 50th Street and extending South for 65 5 feet. On 34th Street beginning 70 feet East of the East side of the intersection of Toledo Avenue on the North side of 34th Street and extending West for l, 393 feet. On Avenue H beginning at the South side of the intersection of 40th Street and extending South for 720 feet. On Parkway Drive beginning on the East side of the inter- section of Cherry Avenue and extending to the West side of the intersection of Guava Avenue. O n Idalou Road beginning 50 feet West of the West side of the intersection of Spruce Avenue and extending East to 180 feet from the East side of Yanda Avenae. On 1st street beginning 154 feet East of the East side of the intersection of Avenue N and extending West 568 feet. On 34th Street beginning 272 feet West of the West side of the intersection of Avenue N on the South side of 34th Street and extending East for 672 f eet. On A ~enue T beginning at the North side of the intersection of 2Oth Street and extending to the S outh side of the inter- section of 21st Street. On Memphis Avenue beginning 170 feet South of the South side of the intersection of 3Oth Street and extending North for 904 feet. On 23rd Street beginning 25 feet West of the West side of the intersection of Cedar Aven ue and extending East for 760 feet • • ' 21. On Avenue Q beginning 100 feet North of the North side of the intersection of 30th Street and extending South for 1, 03 8 feet. 22. On Quaker Avenue beginning 100 feet North of the North side of the intersection of 29th Street and extending South for 1, 074 feet. 23. On Avenue L beginning 10 feet North of the North side of the intersection of 29th Street and extending South for 572 feet. 24. On Boston Avenue beginning 150 feet South of the South side of the intersection of 1st Place and extending North 680 feet. 25. On 19th Street, beginning at the West side of the inter- section of Avenue T and extending West for 590 feet. 26. On 47th Street beginning at the West side of the intersection of Gary Avenue and extending West to the East side of the intersection of Hartford Avenue. 27. On 14th Street beginning at the West side of the intersection of Avenue T and extending West for 590 feet. 28. On Avenue U beginning at the South side of the intersection of 54th Street and extending South 672 feet. 29. On 50th Street beginning 500 feet East of the East side of the intersection of Vanda Avenue and extending West for 940 feet. 30. On 50th Street beginning 200 feet East bf the East side of the intersection of Orlando Avenue and extending West for 430 feet. 31. On 50th Street beginning at the East side of the intersection of Avenue Nand extending West for 915 feet. 32. On 58th Street beginning at the West side of the intersection of Avenue U and extending West for 625 feet. 33. On Utica Avenue beginning "SO feet North of the North side of the intersection of 46th Street and extending South to the North side of the intersection of 48th Street. SECTION 2. The Traffic Engineer is hereby authorized and directed to cause the placement of traffic control signals and/or portable signs at each approach to each school zone herein designated. The signs shall be placed in the center of the Street or at the most advantageous point within the traffic lanes to be conspciuous to approaching vehicluar traffic. SECTION 3. "School hours" as that term is used lllerein, shall be the hours between 7:30A.M. and 4:30 P.M. of each Monday through Friday throughout the calendar year when the school nearest the school zone is in session. .' SECTION 4. It shall be unlawful for any person to drive or operate a vehicle through a school zone as designated and established herein during school hours in such a manner as to overtake and pass another vehicle by chanse of lane, being driven in the same direction up.on the same street within said school zone by changing traffic lane. SECTION 5. I t shall be unlawful for any person to drive or operate a vehicle through the school zones herein designated during school hours at a rate of speed in excess of the prima facie speed limits herein designated for such school zones. SECTION 6. Any person violating the prima facie speed limit established by this Ordinance shall upon '"lonviction be fined as prescribed by the provision of ~rticle 827a, Vernon's Annotated Penal Code for violations of Section 8 thereof and any person violating any otl:m Section of this Ordinance shall upon conviction be fined in a sum no~ exceeding $200. 00. SECTJ:ON 7. If any part or parts of this Ordinance shall be held unconstitu- tional or invalid by any court of competent jurisdiction, such part or parts shall be deemed a separate, distinct and independent provision and such holding shall not affect the remaining portions hereof. SECTION 8. That all Ordinances or parts of Ordinances conflicting with any of the provisionshe·reof are hereby repealed insofar as such conflict exists. SECTION 9. That the City Secretary is hereby directed to cause publication of the descriptive caption of this Ordinance together with the penalty clause as a n alternative method provided by law. I SECTION 10. That the enactment of this Ordinance being necessary to the public safety and welfare of the of pedestrian use of the streets in the school zones herein designated and established is hereby declared to be an emergency measure ' creating a public necessity that the rule provid£ng that proposed ordinances be I presented at two separate meetings be dispensed with and this Ordinance is de- clared to be an EMERGENCY MEASURE to take effect from and after the date of its first publication.
