AN ORDINANCE AMENDING ZONING ORDINANCE NO.a 1695 AND THE:
OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOW-
ING CHANGE: ZONE CASE NO• 899: CHANGE CERTAIN PROPERTY LOCATE.D
BETWEEN GLOBE A VENUE AND HICKORY SOUTH OF 34TH. STREET FROM A
11C-4" TO AN 11M-I" ZONE; SUBJECT TO CONDITIONS.
WHEREAS., the proposed change in zoning districts as hereinafter made has
been duly presented to the Zoning and Planning Commission for its recommenda ...
tion, which was received by the City Commission and after due consideration..
the City Commission finds that malting the proposed change as hereinafter set out
will be in the public interest; and•
WHEREAS. all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with, as well as giving
notices in compliance with Section 20 of Ordinance No. 1695 as well as notices
provided by Article 1011£~ Vernon's Annotated Civil Statutes~ amended in 1953,
and notice was duly published in the Lubbock Morning Avalanche Journal more
than fifteen (15) days prior to the date of the public hearing before the City Com-
mission on such proposed amendment~ and the public hearing according to said
notice was duly held in the Assembly Roam of the Central Fire Station Building~
located at 503 Avenue Kin Lubbock., Texas~ at which time persons appeared in
support of the proposal; and,. after said hearing:~ it was by the City Commission
determined that it would be in the public interest• ~ue to changed conditions:. that
the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter
set forth in the body of this Ordinance and this Or~nance having been introduced
in final written form prior to first reading hereof; NOW,~ THEREFORE•
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOGK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and
the same are hereby amended as follows.,. to-wit:
ZONE CASE NO.; 899:
Change the following described property,. to-wit:
A tract of land out of the East oneoohalf (El/2) of the Northeast
quarter (NE/4) of the Northwest quarter ,{NW/4) of Section Six
(6)a Block B" Lubbock County., Texas;. and more particularly
described by metes and bounds as follows:
BEGINNING at an iron pipe set at the inter section of the South
line of U. 8.; Highway No. 84 on 34th Street with the East line
of Globe Avenue:.. being 2.055. 00 feet East and 2.6. 91 feet South
of the Northwest corner of Section 6, Block B~t. the beginning and
Northwest corner of this tract;
THENCE North 89°53t· East along the South right-of-way line of
U. s .. Highway No. 84 on 34th Street~ 510 feet to a point in the
West right ... of-way line of Hickory Avenue;
THENCE South along the West line of Hickory Avenue 1286.13
feet to an iron pipe set at the intersection of the North line of a
20-foot alley and the West line of Hickory Avenue,. the Southeast
corner of tlis tract;
THENCE West along the North side of the 20":"foot alley,_ 510
feet to a point in the East right-of-way line of Globe Avenue;
THENCE Northa along the East line of Globe Avenue 1285.09
feet to the PLACE OF BEGINNING,.
from a 11C-411 to an 11M-l 11 zoning district. (.Said property being
located between Globe Avenue and Hickory Avenue South o£ 34th
Street);
SU.l).IEK'X :ro .:nrE FOLLOWING CONDITIONS:
1. That the following permitted uses in the "M-111 zoning district
shall be omitted or modified as follows:
A. The following uses allowed in M-1 zoning district shall be
omitted and the property shall not be u.sed for the purposes re-
flected in the following sub-sections of Zoning Ordinance 16 9 5,
to-wit:
13. 1-4* 13. 1-8, 13. 1-10, 13. 1-11, 13. 1-12;jr 13. l-14,_
13.1-15, 13.1-18, 13.1-19~ 13.1-21, 13.1-24. 13.1-25~
13.1-26, 13.1-29, 13.1-31, 13.1 -38, 13.1-39, 13.1-42,.
13. 1-44, 13. 1-45,. 13. 1-47, 13. 1-55 and 13. 1-60.
B. The following uses permitted in M-1 zoi:dng district of Zoning
Ordinance 1695 shall be qualified as follows, to-wit;
l. . Uses permitted by Sub-section 13. 1-9 shall be permitted
only where the sawdust and :refuse from same shall be con-
trolled so as not to permit same to escape into the air or
from the premises. Use of self contained exhaust system to
control sawdust and debris, or similar effective means,. must be
utilized.
2. Uses permitted by Sub-section 13. 1-30-Lwnber yard with
outside storage. No mill shall be permitted.
3. Uses permitted by Sub-section 13. 1-50-Sash and door
manufacturing shall be permitted only where dust and debris
is controlled and not permitted to escape from premises; or
only as an ascessory to other uses permitted in the M-1 zoning
._~; district. Control of sawdust and debris must be contained as in
No. 1 above.
4. Uses permitted by Sub-section 13. 1-53-Spray painting shall
be permitted only as an accessory to uses permitted in the M-1
zoning district such as Sub-section 13. 1-46 or Sub-section 13. 1-48.
5. Uses permitted by Sub-section 13. 1-54-Store fixture manu-
facturing permitted only where sawdust and debris is contained

and not permitted to escape from the premises; or only
as an accessory to permitted uses in the M-1 zoning dis-
trict. Same control as in No. 1 above.
C. All terms and conditions of zoning ordinances set forth relative
to dusta fwnes~ gas, noxious odors, smoke, glare or other atmos-
pheric disturbances shall be strictly adhered to. ·
2. That the owners and/o·r developers shall make application for and secur
a building permit within ten months after the date of final passage of this ordinanc .
SECTION 2. THAT from and after passage and effective date of this Ordi-
nance said lots~ tracts, and parcels of land described in Section!~ ~ereof shall
be changed to the zoning district indicated and the Official Map is amended in
accordance herewith.
AND IT IS SO ORDERED
