WHEREAS, the governing body, as authorized by Article 827a, Sec. 8, Vern~ '.e Annotated Penal Code, finds that certain prima facie speed limits on cer1lain high ways are different from what is reasonable or safe and should be altered and the immediate preservation of public health and szty requires immediate alteration of said prima faciespeed limits as hereafter set forth, which creates an emergenc , NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. The prima facie speed limit established, by Article 827a, Sec. 8) Subsection 1 {b), Vernon's ~nnotated Penal Cod.e is altered and changed for all vehicles to thirty (30} miles per hour on the following designated highways or streets in the corporate limits of the City of Lubbock, Lubbock County, Texas, to-wit: On the East side of Avenue Q (u.S. 84} beginning at Fourth Street and extending North for 0. 192 miles. On the South side of Clovis Road {U.S. 84J beginning 3. 189 miles from the Northwest city limits and extending South to Fourth Street. SECTION 2. The prima facie speed limit established, by Article 827a, Sec. 8, Subsection 1 (b), Vernon's Annotated Penal Code is altered and changed for all vehicles to Thirty-five (35) miles per hour on the following designated highways or streets in the corporate limits of the City of Lubbock, Lubbock County, Texas, to-wit: On the North side of the Clovis Road (U.S. 84} beginning 0. 192 miles North and West of Fourth Street and extending Northwest for 0. 550 miles. On the South side of CloVis Road {U.S. 84} beginning 2.619 miles from the Northwest city limits and extending Southeast for o. 570 miles. SECTION 3. The prima facie speed limit established, by Article 827a, Sec. 8, Subsection 1 {b), Vernon's Annotated Penal Code :is altered and changed for all vehicles to forty (40) miles per hour on the following designated highways or street in the corporate limits of the City of Lubbock, Lubbock Couhty, Texas, to-wit: On the North side of the Clovis Road (U.S. 84) beginning 0. 74-2 miles North and West of Fourth Street and Extending Northwest for 0. 800 miles. On the South side of Clovis Road {U.S. 84) beginning 1. 616 miles from the Northwest city limits and extending Southeast for ·1. 003 miles. SECTION 4. The prima facie speed limit established, by Article 827a, Sec. 8, Subsection 1 {b), Vernon's Annotated Penal Code isa.-ltered and changed for all vehicles to forty-five (45) miles per hour on the following designatad'. highway or street in the corporate limits of the city of Lubbock, Lubbock County, Texas, to- wit: On the South side of the Clovis Road (u.S. 84) aeginning 1. 066 miles Southeast of the Northwest city limits and extending South- east for 0. 550 miles. SECTION 5. The prima facie speed limit established, by Article 827a, Sec. 8, Subsection 1 (b), Vernon's Annotated Penal Code is altered and changed for all vehicles to fifty (50} miles per hour on the following de§i.gnated highway or street in the corporate limits of the City of Lubbock, Lubbock County, Texas, to-wit: On theNorth side of Clovis Road (u.s. 84) beginning o. 800 miles from Fourth Street and extending Northwest for 1. 150 miles. SECTION 6. The prima facie speed limit established, by Article 827a, Sec. 8, Subsection 1 (b), Vernon's Annotated Pen'B.l Code is altered and changed for all vehicles to fifty-five (55) miles per hour on the following designated highway or street in the corporate.;limits of the ~ity of Lubbock, Lubbock County, Texas, to- wit: On the South side of Clovis Road (u.S. 84) beginning 0. 666 miles Southeast of the Northwest city limits and extending Southeast for 0. 400 miles. SECTION 7. The prima facie speed limit established, by Article 827a, Sec. 8, Subsection 1 {b), Vernon's Annotated Penal Code is altered and changed for all vehicles to sixty {6.P) r;niles per hour day and fifty-five {55) miles per hour night on the following designated highways or streets in the corporate limits of the I City of Lubbock, Lubbock County, Texas, to-wit: On the So~th side of Clovis Road (U.S. 84) beginning at the Northwest city limits and extending Southeast for 0. 666 miles. On theNorth side of Clovis Road {u.s. 84} beginning 1. 950 miles from Fourth Street and exte·naing Northwest for o. 671 miles or to the Northwest city limits. SECTION 8. The City Manager is authorized ad directed to cause the plai:ing of signs so as to clearly define the limits of the prima facie areas set out in this Ordinance. SECTION 9. Any person, firm or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined in any sum not to ex;ceed TWO HUNDRED DOLlARS ($200. 00) and for subsequent violations within one year thereafter shall be prosecuted as preseribed for such violations by Sec. 15 of Article 827a, Vernon's Annotated Penal.Code. SECTION l 0. The City Secretary is authorized and directed to cause the publicatipn of the descriptive caption of this Ordinance together with the penalty provision as an alternative method of publication as provided by law. SECTION ll. That all Ordinances or parts of Ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 12. All highways or streets not specifically set forth in the.. pre- ceeding sections hereof shall not be affected by the provisions hereof, and this Ordinance shall be cumulative of all other prima facie speed limit Ordinances except those with which it specifically conflicts. SECTION 13. Should any section, paragraph, sentence, clause, phrase or word of this ordinance be declared unconstitutional or invalid for any reason, the remainder of this ordinance shall not be affected thereby. SECTION 14. The fact that public necessity and convenience requires that this Ordinance be passed as an emergency measure for reasons set forth in the preamble hereof, the rule requiring that no Ordinance shall be finally passed on the day of its introduction be suspended, and thi.s Ordinance is declared to be an emergency measure to take effect for and after its passage.
