L~ Dl 57) 0~ -.:;ro -I LP ORDINANCE N • 3409 AN ORDINANCE AUTHORIZING THE ALTERING AND CHANGING OF THE PRIMA FACIE SPEED LIMIT FRa-t .30,_ MIU:S PER HOUR TO 3.5 MILES PER HOUR ON THAT PORTION OF THE STREETS DESCRIBED AS FO~: On both sides of 50th Street beginning at Avenue Q and extending to Avenue A. AUTHORIZING THE PlACING OF SPEED LIMIT SIGNS; PRESCRIBING A PENALTY; PROVIDING FOR PUBLICATION; AND DEClARING AN EMERGENCY; AND PROVIDING FOR THE EFFECTIVE Dl TE OF THIS ORDINANCE. ~S, the governing bo~, as authorized by Article S27a, Sec. S, Vernonia Annotated Penal Code, finds that certain prima facie speed limits on certain highways are different from what is reasonable or safe and should be altered and tbe~diat• preservation of public health and safety requires im- ~ediate alteration of said prima facie speed limits as hereafter set forth, · which creates an emergency; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. The prima facie speed limit established by Article S27a, See. 81 Subsection 1 (b), Vernon's Annotated Penal Code is altered and changed for all vehicles to J$ miles per hour on the following designated highways or street in the corporate limits of the City of Lubbock, Lubbock County, Texas, to-wit: On both sides of 50th Street beginning at Avenue Q and extending to Avenue A. SECTION 2o The City Manager is authorized and directed to cause the placing of' signs so as to clearly define the limits of the prima tacie areas set out in this Ordinance. SECTION 3o An person, firm or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined in any sum no'J; to ex:ceed TWO HUNDRED DOLlARS (8200o00) and for subsequent viola+- tions within one year thereafter shall be prosecuted as prescribed for sueh violations by Seco 15 of Article 827a, Vernonia Annotated Penal Code. SECTION 4. The City Secretary is authorized and directed to cause the publication of the descriptive eaption of this Ordinance together with the penalty provieion as an alternative method of publication as provided by law. SECTION 5. The fact that public necessity and co~enience requires that this Ordinance be passed as an emergency measure for reasons set forth in the preamble hereof, the rule requiring that no Ordinance shall be final~ passed on the day of its introduction be suspended, and this Ordinance is de- clared to be an emergenqy meaeure to take effect for and after its passage. ~seed unanimously by AND IT IS SO ORDEREDo . the City Commission this ~ ot Feb~ar:; 1961_. ;/t?..
