D. 57) ~-~a-19(.g I ORDINANCE NO. 3408 AN ORDINANCE AUTHORIZING THE ALTERING AND CHANGING OF THE PRIMA FACIE SPEED LIMIT FR<J4: 30 MILES PER HOUR TO 40 MILES PER HOUR ON TR! T PORTION OF THE STREE'l'S DESCRIBED AS FOLLOWS: On bot h sides of 5oth Street beginning at Indiana Avenue and extending to Slide Road. AUTHORIZING THE PIACING OF SPEED LIMIT SIGNS; PR1!SCRIBING A PENALTY; PROITIDING FOR POBLICATION; AND DEClARING AN EMERGENCY; AND PROVIDING FOR THE EFFECTIVE Dl 'l'E OF miS ORDINANCE. WHEREAS, the governing bo~, as authorized by Article 82?a, Sec. 8, Vernon's Annotated Penal Code, :finds that certain prima .facie speed limits on certain highways are different from what is -reasonable or safe and should be altered and the~diat• preservation o:f public health and safety requires·tm- ~ediate alteration o:f said prima facie speed limits as hereafter set forth,-· which creates an emergency; NOW' THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. The prima facie speed limit established py Article 827a, See. 8, Subsection 1 (b)~ Vernon 8s Annotated penal Code is altered and changed for all vehicles to 40 miles per hour on the foll~ng designated highways or street in the corporate limits of the City of Lubbock, Lubbock County, Texas, to-ldt: On both sides of 50th Street beginning at Indiana Avenue and extending to Slide Road. SECTION 2. The City Manager is authorized and directed to cause the placing of signs so as to clearly define the limit's of the prima facie areas set out in this Ordinance. SECTION 3. An person, firm or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined in any sum not. to ex:ceed TWO HUNDRED DOWRS ($?00o00) and for subsequent viola .. tions within one year thereafter shall be prosecuted as prescribed for such violations by Seco 15 of Article 827a, Vernon's Annotated Penal 9ode. SECTION 4. The City Secretary is authorized and directed to cause the publication ot the descriptive eaption of this Ordinance together with the penalty provieion as an alternative method of publication as provided by law. SECTION 5o The .fact that public necessity and co~enience requires that this Ordinance be passed as an emergenct measu~e for reasons set forth in the preamble hereof, the rule requiring that no Ordinance shall be final~ passed on the day of its introduction be suspended, and this Ordinance is de- clared to be an emergency measure to take effect for and atter its passage. ; ,.
