HomeMy WebLinkAboutOrdinance - 3395-1961 - Amending Zoning Ordinance 1695 And Official Map 902, Lot 67 - 02/23/1961, .. ,"'WF g ,.... 0 ;:z. -:;J.3-}gtp I I ORDINANCE NO. 3395 o ~ -o.9 -l..9l.D { AN ORDINANCE AMENDING ZONING ORDINANCE NO. 16l;J5'"" AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 902 : CHANGE THAT PORTION OF LOT 67, WHEELOCK'S SECOND ADDITION TO THE CITY OF LUBBOCK. LUBBOCK COUNTY, TEXAS, LYING NORTH OF THE RAILROAD RIGHT-OF-WAY FROM AN 11R-2" TO AN 11 M-1" ZONING DISTRICT. (SAID PROPERTY BEING LOCATE BETWEEN DATE AND ELM AVENUES SOUTH OF EAST 28TH STREET); SUB- JECT TO THE FOLLOWING CONW'ION: THAT THE OWNERS AND/OR DEVEL- OPERS SHALL MAKE APPUCATION FOR AND SECURE A BUILDING PERMIT WITHIN TEN MONTHS AFTER THE DATE OF FINAL PASSAGE OF THIS ORDINANCE. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recornmenda tion, which was received by the City Commission and after due consideration, the City Commission finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section20 of Ordinance No. 1695 as well as notices provided by Article 1011£, Vernon's Annotated Civil Statutes, amended in 1953, and notice was duly published in the Lubbock Morning Avalanche Journal more than fifte·en {15) days prior to the date of the public hearing before the City Corn- mission on such proposed amendment, and the public hearing accor?ing to said notice was duly held in the Assembly Room of the Central Fire Station Building, located at 503 Avenue K inLubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Commission determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced in final written form prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OFLUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 902 C b.ange that portion of Lot 6 7, Wheelock's Second Addition to the City of Lubbock, Lubbock County, Texas, lying North of the railroad right-of-way from an 11R-211 to an "M-111 zoning district. (Said property .being located between Date and Elm Avenues South of East 28th Street); Subject to the following condition: THAT the owners and/or devetopers shall make application for and secure a building permit within ten months after the date of final passage of this ordinance. SECTION 2. THAT from and after passage and effective date of this Ordin- ance said lotsj tracts, and parcels of land described in Section 1, hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance herewith. / AND IT IS SO ORDERED Passed by the Commission on first reading this 23rd day of Februar~ 1961.. . . .
