OR APPURTENANCES THEREOF'l FOR THE PURPOSE OF ATTRACT- ING,. ENTICING OR LURING ANY SCHOOL CHILD OR CHILDREN TO ENGAGE IN TRUANCY OR TO COMMIT, PARTICIPATE IN OR VIEW ANY IMMORAL OR UNLAWFUL ACT; DECLARING SUCH ACT TO BE A MISDEMEANOR AND PRO- VIDING A PENALTY THEREFOR; PROVIDING A SEVERABILITY CLAUSE; DIRECTING PUBLICATION OF THIS ORDINANCE AND PROVIDING AN EFFEC- TIVE DATE. II WHEREAS• the association of out-of-s-chool youths and unscrupulous adults with school children in the vicinity of the school grounds has been a contributing factor in the commission of acts of truancy on the part of such school children an has led to the commission• and engagement in, of immoral and unlawful activities by school children; and WHEREAS,. the City Commission finds that the remedy to this dangerous condition lies in the prohibition of loitering and loafing by such persons in the vicinity of school grounds• and that such remedy is necessary and essential and is in the best interest of the health. safety? and welfare of the citizens of the City of Lubbock; NOW THEREFORE• BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Chapter 19 of the Code of Ordinances of the City of Lubbock, Texas be and the same is hereby amended by the addition of the follow- ing new Article and Sections thereunder,. which shall read as follows, to-wit: "Article Ill -Loafing or Loitering Near Schools. Sec. 19-26. Loitering or Loafing Within 250 Yards of School Buildings etc.~. Prohibited. It shall be Wllawful for any per son, during school hours or during the time pupils are gathering at school or leaving school,.. to loaf or loiter on the streets• alleys. sidewalks or any other public place. or in any building or structure open to the public, within 250 yards of any public,. private or parochial school including but not limited to universities, colleges, high schools:t junior high schools~. or ele- mentary schools~ or any combination thereof,_ or within 250 yards of any real estate used~ occupied). or in any manner dedicated to exclu- s~ve use or occupancy as a school, or as a part or appurtenance thereof• including but not limited to buildings. dormitories. campuses, athletic fields.,, tennis courts and playgrounds• for the p1 rpose of attzact- ing~ enticing or luring any school child or children to engage in truancy or to commit• participate in or view any immoral or unlawful act. ' ., - -· -/ .I. SECTION 2.. Any person violating the provisions of Sec. 19-2;6 above shall be guilty of a misaemeanor and shall upon conviction be fined in any sum not ex- ceeding $2.00. 00. SECTION 3. Should any section~ paragraph. sentence2 c!ause1-phrase or word of this ordinance be declared unconstitutional or invalid for any reason._ the remainder of this ordinance shall not be affected thereby. SECTION 4. The City Secretary shall cause the publication of this Ordinan4 e once a week for two consecutive weeks in a newspaper regularly published in the City of Lubbock, and this ordinance shall become effective 10 days after its last publication.
