LUBBOCK COUNTY, TEXAS, TO-WIT: ON THE EAST SIDE OF AVENUE Q (WHERE AVENUE Q INTERSECTS WITH TRAFFIC CIRCLE) AND EXTENDING NORTH FO o. 823 MILES. AUTHORIZING THE ALTERING AND CHANGING OF THE PRIMA FACIE SPEED LIMIT FOR ALL VEl-ilCLES TO THIRTY-FIVE (35} MILES PER HOUR ON THE FOLLOWING HIGHWAY AND STREET IN THE CORPORATE LIMI S OF THE CITY OF LUBBOCK. LUBBOCK COUNTY, TEXAS, TO-WIT: ON THE EAST SIDE OF AVENUE Q {U.S. HIGHWAY 84) BEGINNING 1. 72.3 MILES NORT OF THE TRAFFIC CIRCLE AND EXTENDING NORTH O. 982 MILES. AUTHORIZ- ING THE PLACING OF SPEED LIMIT SIGNS; PRESCRIBING A PENALTY, PRO- VIDING FOR PUBLICATION; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING THAT STREETS OR .IDGHWAYS NOT SPECIFICALLY SET FORTH HEREIN SHALL NOT BE AFFECTED BY THE PROVISIONS HEREOF AND THAT THIS ORDINANCE BE CUMULATIVE OF ALL OTHER PRIMA FACIE SPEED LIMIT ORDINANCES EXCEPT THOSE WITH WinCH IT SPECIFICALLY CONFLICTS, DECLARING AN EMERGENCY; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the governing body, as authorized by Article 827a, Sec. 8, Veraon' Annotated Penal Code, finds that certain prima facie speed limits on certain high- ways are different from what is reasonable or safe and should be altered and the immediate preservation of public health a na safety requires immediate alteration of said prima facie speed limits as hereafter set forth, which creates an emergen NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. The .prima facie speed limit established, by Article 827a, Sec. 8, Subsection l{b), Vernon's Annotated Penal Code is altered and changed for all vehicles t o thirty-five (35} miles per hour o n the following designated highwayc or streets in the corpora te limits of the City of Lubbock, Lubbock County, Texas, to- wit: On the West side of Avenue Q (u.s. Highway 84) for South-bound Traffic beginni~g at 23rd Street and extending South for o. 982 miles. SECTION z. The prima facie speed limit established, by Article 82 7a, Sec. 8, Subsection ':(b), Vernon's Annotated Penal Code is altered and changed for all vehicles to forty-five {45) miles per hour... on the following designated highway or street in the corporate Limits of the City of Lubbock, Lubbock County, Texas, to- wit: On the West side of Avenue Q (u.s. Highway 84) for Southeast- bound traffic beginning 2. The prima facie speed limit established, by Article 827a, Sec. 8 Subsection l(b), Vernon's Annotated Penal Code is altered and changed for all vehicle·s to forty-five milesper hour on the following designated highway and stree in the corporate limits of the City of Lubbock, Lubbock County, Texas, to ·wit: On the East side of Avenue Q (Where Avenue Q intersects with Traffic Circle } for North-bound traffic and extending North for o. 823 miles. SECTION 4. The prima facie speed limit established by Article 827a, Sec. 8, Subsection l(b), Vernon's Annotated Penal Code is altered and changed for all vehicles to thirty-five (35) milesper hour on the following designated Highway or street in the corporate limits of the City of Lubbock, LubbockCounty, Texas, to- wit: On the East side of Avenue Q(U.S. Highway) for North-bound traffic beginning I. 723 miles North of the Traffic Circle and extending North 0. 982 miles. SECTION 5. The City Manager is authorized and directed to cause the placing of signs so as to clearly define the limits of the prima facie areas set out in this Ordinance. SECTION 6. Any person, firm or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined in any sum not to exceed TWO HUNDRED DOLlARS ($200. 00) and for subsequent violations withi one year thereafter shall be prosecuted as prescribed for such violations by Sec. 15 of Article 827a, Vernon's Annotated Penal Code. SECTION 7. The City Secretary is aut horized and directed to cause the pub- lication of the descriptive caption of this Ordinance together with the penalty pro- vision as an alternative method of publication as provided by law. SECTION 8. That all Ordinances or parts of Ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 9. All highways and streets not specifically set forth in the preceedi sections hereof shall not be affected by the provisions hereof, and this Ordinance shall be cumulative of all other prima facie speed limit ordinances except those wi h which it specifically conflicts. SECTION 10. Should any section, paragraph, sentence, clause, phrase or wor of this Ordinance be declared unconstitutional or invalid for any reason, the re- mainder of this 0\l'."dinance shall not be affected thereby. SECTION 11. The fact that public necessity and convenience requires that this Ordinance be passed as an emergency measure for reasons set forth in the pream e hereof, the rule requiring that no Ordinance shall be finally passed on the day of it introduction be suspended, and this Ordinance is declared to be an emergency measure to take effect for and after its passage.
