HI.GHWA Y 82) FOR SOUTH-BOUND TRAFFIC BEGIN- NING AT SECOND .STREET AND EX'tENDING SOUTH FOR 2. 32.3 MILES. A UTH RIZING THE PLACING OF SPEED LIMIT SIGNS; PRESCRIBING A PENALTY, PROViDING FOR. PUBLICATIONi REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING THAT STREETS OR HIGHWAYS NOT SPECIFICALLY SET FORTH HEREIN SHALL NOT BE AFFECTED BY THE PROVISIONS HEREO AND THAT THIS ORDINANCE BE CUMULATIVE OF ALL OTHER PRIMA FACIE SPEED LLMIT ORDINANCES EXCEPT THOSE WITH WHICH IT SPECIFICALLY CONFLICTS. DECLARlNG AN EMERGENCY; AND PROVIDING FOR THE EFFEC TIVE DATE OF THIS ORDINANCE. WHEREA~ the governing body, as authorized by Article 827a~ Sec. 8~ Vernon•s Annotated Penal Code~ finds that certain prima facie speed limits on certain highways are different from what is reasonable or safe and should be altered and the immediate preservation of public health and safety requires im- mediate alteration of said prima facie speed limits as hereafter set forth$ which creates an emergency; NOW. THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. The prima facie speed limit established,. by Article 827a, Sec 8t Subsection l(b), Vernon• s Annotated Penal Code is altered and changed for all vehicles to fort~ (40) miles per hour on the following designated highway or stree in the corporate limits of the City of Lubboclc, Lubbock Cotmty~ Texas, to-wit: On the East side of Avenue A{ U.; s. Highway 82) for North-Botmd traffic beginning at 37th Street and extending North for 0. 068 miles. SECTION 2. The prima facie speed limit establishe~ by Article 827aa Sec. 8, Subsection l(B)~ Vernon 1 s Annotated Penal Code is altered and changed for all vehicles to thirty~five (35) miles per hour on the following designated high way or street in the corporate limits of the City of Lubbock~ Lubbock Cotmty;a. Texas, to-wit: On the East side of Avenue A (U.S. Highway 82) for North- Bound traffic beginning 0. 068 miles from 37th Street and ex- tending North 2. 323 miles. ~ , .... SECTION 3. The prima facie speed limit e etabli she~ by Article 82. 7a~ Sec. 8, Subsecti on l(b)~ Vernon's Annotated Penal Code is altered and changed for all vehicles to thirty-five (35) miles per hour on the following designated highway~ or street in the corporate limits of the City of Lubbock, Lubbock County Texas, to-wit: On the West side of Avenue A (U.S.; Highway 82.) for South-bound traffic beginning at Second Street and extending South for 2.. 323 miles. SECTION 4. The City Manager is authorized and directed to cause the placing of signs so as to clearly define the limits of the prima facie areas set out in this Ordinance. SECTION 5. Any person~ firm or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined in any sum not to exceed TWO HUNDRED DOLLARS ($2.00. 00) and for subsequent vio- lations within one year thereafter shall be presecuted as prescribed for such violations by Sec. 15 of Article 82.7a». Vernon's Annotated Penal Code. SECTION 6. The City Secretary is authorized and directed to cause the publication of the descriptive caption of this Ordinanee together with the penalty provision as an alternative method of publication as provided by law. SE.C TION 7. That all 0 rdinance s or parts of Ordinance s conflicting with any of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 8. All highways or streets not specifically set forth in the pre- ceeding sections hereof shall not be affected by the provisions hereof,. and this Ordinance shall be cumulative of all other prima facie speed limit Ordinances except those with which it specifically conflicts. SECTION 9. Should any section. paragraph. sentence• clause;~. phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 10. The fact that public necessity and convenience requires that this Ordinance be passed as an emergency measure for reasons set forth in the preamble hereof~ the rule requiring that no Ordinance shall be finally passed on the day of its inh :oduction be suspended• and this Ordinance is declared to be an emergency maasure to take affect for and after its passage.
