AN ORDINANCE AUTHORIZING THE CORRECTION OF"'ERRORS" IN A
PROPERTY DESCRIPTION OF SUB-UNIT NO. 12, UNIT NO •. 1985 OF PAVING
ORDINANCE NO. 3047 AS FINALLY PASSED FEBRUARY 25, 19601 AUTHORIZIN
THE ISSUANCE OF A NEW CERTIFICATE OF ASSESSMENTJ AUTHORIZING THE
CITY SECRETARY TO NOTE THE CHANGE MADE BY THIS ORDINANCE; AND
DECLARING AN EMERGENCY AND THE EFFECTIVE DATE OF THIS ORDINANC ,.
WHEREAS, in Paragraph m of Ordinance No., 3047 wherein certain assess-
ments were made against named persons and property in certain stated amounts;
and,
WHEREAS, there was an error in the description of the property which was
assessed for street improvementsJ and,
WHEREAS, Ordinance No .. 3047 prorided in Paragraph IX hereof that any
error in description of property could be corrected at any time by the cityJ and,
WHEREAS, notice ~nd hearing were duly made and had in the time .and manner
required by law and which notice was sufficient in all respects to give full notice to
property owners of property abutting the portions of streets to be improved; and,
' WHEREAS, the power to correct errors in street improvement~ proceedings
is authorized by Article 1105b Vernon's Revised Civil Statutes of Texas; and,
WHEREAS, this Ordinance affects the daily operation of the Paving Section of
the Engineering Department which creates an emergency, requiring the suspen-
sion of all rules providing for the several readings .of an ordinance before final
pasaage thereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK;
SECTION 1.-THAT Paragraph ni, OJ:dinance No. 3047, as finally passed
February 25, 1960, be amended so as to change that part of the paving assesa-
ment rolls for Sub-Unit No.-12 of Unit No. 1985 which reads:
Otis Taylor -Lot 1, Block 6, Li££ Sanders Addition
so as to read hereafter as follows:
Otis T~ylor -Lot 1, Block 7, Liff Sanders Addition
SECTION 2. THAT the Mayor is authorized to execute and theSecretary to
attest paving certificates containing the correction herein noted to repLace the
certificates which contained the incorrect property description.
SECTION 3., The City Secretary is authorized to note the amendment to
Ordinance No. 304 7 in the margin of the Ordinance records o£ the C ity of Lubbock.
SECTION 4 •. This ordinance is hereby declared to be an emergency measure
for the reasons set forth in the preamble hereof, and the rule requiring two read-
ings of an ordinance is suspended• and this ordinance shaU take effect immediately
from and after its passage.
