LUBBOCK COUNTY, TEXAS• TO-WIT: ON THE SOUTHEAST SIDE OFBROWNFIELDHlGHWAY(U.;S.HIGHWAY 62), FORNORTH- EAST BOUBD TRAFFIC BEGINNING 1. 020 MILES NORTHEAST OF THE PRESEN ~ CITY LIMITS AND EXTENDING 1. 300 MILES NORTHEAST; AUTHORIZING THE ALTERING AND CHANGING OF THE PRIMA FACIE SPEED LIMIT FOR ALL VE- HICLES TO SIXTY (60) MILES PER HOUR DAY AND FIFTY -FIVE (55) MILES PER HOUR NIGHT. ON THE FOLLOWING DESIGNATED InGHWAY AND THE CORPORATE LIMJ:TS OF THE CITY OF LUBBOCK. LUBBOCK COUNTY• TEXAS TO-WIT: ON THE SOUTHEAST SIDE OF BROWNFIELD HIGHWAY (U. S.; HIGH- WAY 62). FOR NORTHEAST BOUND TRAFFIC• BEGINNING AT THE PRESENT CITY LIMITS AND EXTENDING NORTHEAST 1. 020 MILES. AUTHORIZING THE PLACING OF SPEED LIMIT SIGNS; REPEALING ALL ORDINANCES IN CONFLIC HEREWITH; PROVIDING THAT InGHWAYS OR STREETS NOT SPECIFICALLY SET FORTH HEREIN SHALL NOT BE AFFECTED BY THE PROVISIONS HEREOF AND THAT THE ORDINANCE BE CUMULATIVE OF ALL OTHER PRIMA FACIE SPEED LIMIT ORDINANCES EXCEPT THOSE WITH WinCH IT SPECIFICALLY CONFLICTS; DECLARING AN EMERGENCY; AND PROVIDING FOR THE EFFEC TIVE DATE OF THIS ORDINANCE .. AND PROVIDING A PEN:ALTY. Wl:IEREAS, the governing body, as authorized by Article 827a, Sec. 8, Ver- non's Annotated Penal Code~ finds that certain prima facie speed limits on certain highways are different from what is reasonable or safe and should be altered and the immediate preservation of public health and safety rE:quire s immediate altera- tion of said prima facie speed limits as hereafter set forth, which creates an emergency, NOW THEREFORE• BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. The prima facie speed limit established, by Article 827a, Sec. 8, Subsection l(b), Vernon's Annotated Penal Code is altered and changed for all vehicles to fifty-five {55) miles per hour on the following designated highway or street in the corporate limits of the City of Lubbock, Lubbock Cowt ty, Texas, to-wit: ' On the Southeast side of Brownfield Highway (U.S. Inghway 62.)• for Northeast bound traffic, beginning 1. 020 miles Northeast of the pre- sent city limits and extending I. 300 miles Northeast. SECTION 2. The prima facie speed limit established, by Article 827a, Sec. 8:~~ Subsection l(b), Vernon's Annotated Penal Code is altered and changed for all vehicles to sixty (60) miles per hour day and fifty-five (55) miles per hour night, on the following designated highway or street in the corporate limits of the City of Lubbock~ Lubbock Coub.ty1 Texas, to-wit: On the Southeast side of Brownfield Highway (U.S. Highway 62), for . Northeast bound traffic, beginning at the present city limits and ex- tending Northeast 1. 020 miles. SECTION 3. The City Manager is authorized and directed to cause the placi g of signs so as to clearly define the limits of the prima facie areas set out in this Ordinance. ·'· ,. SECTION 4. Any person~ firm or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined in any sum not to exceed TWO HUNDRED DOLLARS ($200. 00) and for subsequent viola- tions within one year thereafter shall be prosecuted as prescribed for such viola- tions by Sec. 15 of Article 827a~ Ve.aon1s Annotated Penal Code. SECTION 5. The City Secretary is authorized and directed to cause the pub lication of the descriptive caption of this Ordinance together with the penalty pro- vision as an alternative method of publication as provided by law. SECTION 6. That all ordinances or parts of ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 7. All highways or streets not specifically set forth in the pre- ceeding sections hex;eo£ shall not be affected by the provisions hereof~ and this or- dinance shall be cumulative of all other prima facie speed limit ordinances except those with which it specifically conflicts. SECTION 8. Should any section, paragraph, sentence, clause, phrase or word of this ordinance be declared nnconstitutional or invalid for any reason~ the remainder of this ordinance shall not be affected there by. SECTION 9. The fact that public necessity and convenience requires that this Ordinance be passed as an emergency measure for reasons set forth in the preamble hereof, the rule requiring that no Ordinance shall be finally passed on the day of its introduction be suspended, and this Ordinance is declared to be an emergency measure to take effect for and after its passage.
