ORDINANCE NO .. 1243
AN APPROPRIATION ORDINANCE
WHEREAS, the City Comm~ssion of the City of Lubbock finds it is
necessary to appropriate certain specific funds out of bond funds for
an a~proved project , and this ordinance deals with the daily operation
of City departments in the public interest which creates an emergency ;
NOW~ THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCKg
There is hereby appropriated out of the following described bond
fund, to-wit : Street Improvement Fund
THE sum l3 ,600
For the following purpose:
Acquire Parcel 9 A-G, Clovis Road from M. L. Gardner
· and others, by condemnation proceedings. This incl udes
an additional jury award of $3,350, interest of $150,
and filing and legal fees of $100.
WHEREAS , an emergency exists as shown in the preamble to this
ordinance, the enactment of th~s ord~nance is declared to be an
emergency measure thereby creating a public necessity that the rule .
requiring proposed ordinances to be presented at two (2) separate
commission meetings be dispensed with; and this ord~nance shall be
effective from the date of its passage~

Parcel 9 A-G, Clovis Road, M. L. Gardner
0.122 of one acre of land, being a strip of land 10 feet in width lying parallel
to the present right-of-way line extending from the east property line to the
west property line and being a part of Lots 1 through 10, Block 1, Burleson-
Osborn aaghts Addition to the City of Lubbock, Texas, according to a plat
recorded in vol. ~25, page 293, Deed Records of Lubbock County, Texas, which
Lots 1 through 10, Block 1, were conveyed to M. L. Gardner by a deed dated
16 Dec. '47 and 30 Nov. •48, of record in vols. 349, page 124, and vo1. 385,
page 526, Deed Records of Lubbock County, Texas, which 0.122 of one acre is
more particularly described by metes and bounds as follows:

THENCE S 56°49' E, 100 feet along the northeast boundary line of said
Lot 1, to a point;
THENCE S 33°11' W, 10 feet along the southeast property line of said
Gardner lots.;

westerly from' t·he present southwest right-of-way line, to a point in the
northwest boundary line of said Lot l;
