HomeMy WebLinkAboutOrdinance - 3213-1960 - Ameded By Ordinance 4317A - 07/13/1960JWF: c ... 3213 ~ . ==-' .... ='--' Amended by Ordinance No. 4317A AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 850: CHANGE LOTS 1 AND 2., BLOCK 13, O•NEILL TERRACE ANNEX AN ADDII!ON TO THE CITY OF LUBBOCK11 LUBBOCK COUNTY~ TEXASa FROM AN 11R-211 TO.A "C-3u ZONING DISTRICT (SAID PRO- PERTY BE:NG LOCATED AT THE SOUTHWEST CORNER OF THE INTERSECTIOL OF AVENUE Q AND 27TH STREET); SUBJECT TO CONDITIONS. WHEREAS. the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommendatio which recommendation against the proposed change was received by the City Com- mission and after due consideration, the City Commission finds that making the zone change as hereinafter set out will be in the public interest; and, )PX FURNISHeO WHERE~S11 all conditions precedent required by law for a valid amendment f.,db. · ,to the Zoning Ordinance and Map have been fully complied with, as well as giving ..p !J notices in compliance with Section 20 of Ordinance No. 1695 as well as notices pro- ~tt~k'..'~' vided by .Article 1011£, Vernon1 s Annotated Civil Statutes, amended in 1953, and 49. notice was duly published in the Lubbock Morning Avalanche more than fifteen (15) days prior to the date of the public hearing before the City Commission on such proposed amendmentlt and the public hearing according to said notice was duly held in the City Commission Room .on. the first floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal and all interested parties were given a chance to be heard; and. after said hearing.~ it was by the City Com- mission determined that it would be in the public interest, due to changed conditions that the Zoning Ordinance and Zoning Map be amended in the manner hereinafter se forth .in the body of this Ordinance and this Ordinance having been introduced in fina V written form prior to first reading hereof; NOW, THEREFORE~ BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning BE and the same are hereby amended as follows~ to-wit: ZONE CASE NO. 850 Change Lots 1 and 2~ Block 13:. 0 1Nei11 Terrace Annex:~ an addition to the City of Lubbocka Lubboc~County~ Texas, from an '1R-2.11 to a 11C-311 ·zoning District (Said property being located at the Southwest corner of the intersection of Avenue Q and 27th Street) Subject to the following conditions: Applicants for Zone Change in Zone Case No. 850 have proposed to the City Commission and agreed to limiting the use of the premises to a building for office use only in order that the u~ to be made of the property will be harmonious with existing development in the vicinityJ and agreed to such limitation of use by reason of the fact that some uses otherwise usually permitted in the 11C-311 Zoning would be 'nharmonious with development in the vicinity. The following conditiom shall apply: (1) Building shall be .fOlJ_office use only. (Z) Building shall be a maximum of 2 stolie s ·n heighth. (3) Total floor space of building shall not exceed approximately 9000 square feet. (4) The building set-back shall be 2.5 feet from the 2.7th street propert ine and 43 feet from the Avenue Q property line. (5) A minimum of 25 off-street arking spaces shall be provided (6) A minimum 6 foot screening fence shall be con structed and maintained along the West side of the property extending no further No th han the building setback line provideft for in condition 4 above for 2.7th Street. . . 7) In the event the property is used by its owner and/ or occupant for uses other han herein permitted and/or is used or occupied in violation of this ordinance, uch property shall ipso facto revert back to the '·.'R-211 Zoning District. SECTION 2. THAT from and after passage and effective date of this Ordi- nance, said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accor- dance herewith.
