AN oaDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING
CHANGE: ZONE CASE NO. 855 : CHANGE THE EAST ONE-HALF (El/Z)
OF THE NORTH THREE-HUNDRED (N. 300) FEET OF BLOCK7Z. WHEELOCK'S
SECOND ADDITION TO THE CITY OF LUBBOCK. LUBBOCK COUNTY, TEXAS,
'FROM AN "R-2" TO AN 91 R·3u ZONING DISTRICT. (SAID PROPERTY BEING
j..OCATED AT THE SOUTHWEST CORNER OF THE INTERSECTION OF EAST
28TH STREET AND JUNIPER AVENUE); SUB.JECT TO THE FOLLOWING CON ..
DITION: 1. THAT DEED RESTRICTIONS BE PLACED OF RECORD ON THIS
PROPERTY PRIOR TO SECOND READING OF AN ORDINANCE EFFECTING
THE CHANGE IN ZONING. SAID DEED RESTRICTIONS TO BE APPROVED BY
THE CITY ATTORNEY AND INCLUDE FOLLOWING: A. A STATEMENT
RESTRICTING THE MINIMUM LOT AREA PER APARTMENT UNIT "'F THE
PROJECT TO 1,500 SQUARE FEET4 B. A STATEMENT REQUIRING THAT OFF
STREET PARKING BE PROVIDED FOR THE PROJECT WITH A RATIO OF ONE
PARKING SPACE FOR EACH APARTMENT 11NIT~ WlTinN THE PROJECT•' C.
A STATEMENT RESTRICTING THE USE OF THE PROPERTY TO ONE-FAMILY
DWELLINGS, TWO-FAMILY DWELLINGS, OR MULTI-FAMILY DWELLINGS
AND APARTMENT HOUSES.
WHEREAS, the proposed change in zoning districts as hereinafter made has
been duly presented to the Zoning and Planning Commission for its recommenda-
tion, which was received by the City Commission and after due consideration, the
City Commission finds that making the proposed change as hereinafter set out will
be in the public interest; and,
WHEREAS, all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with, as well as giving
notices in compliance with Section ZO of Ordinance No. 1695 as well as notices
provided by Article 1011£, Vernon's Annotated Civil Statutes, amended in 1953,
and notice was duly published in the Lubbock Morning Avalanche Journal more thai\
fifteen {15) days prior to the date of the public hearing before the City Commission!
on such proposed amendment, and the public hearing according to said notice was
duly held in the City Commission Room on the first floor of the City Hall, Luli>ock$
Texas, at which time persons appeared in support of the proposal; and, after said
hearing, it was by the City Commission determined that it would be in the public
interest, due to changed conditions, that the Zoning Ordinance a:1.d the Zoning Map
be amended in the manner hereinafter set forth in the body of this Ordinance and
this Ordinance having been introduced in final written form prior to first reading
hereof; NOW. THEREFORE:
BE IT ORDAINED BY l'HE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION I. THAT Ordinance No. 1695 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
ZONE CASE NO. 855
Change the East one-half (E 1/Z) of the North three-hundred
{N. 300) feet of Block 72, Wheelock's Second Addition to the
City of Lubbock, Lubbock County, Texas, from an 11R-Z11 to
an "R-3" Zoning District. (Said prcgerty being located at the
Southwest corner of the intersection of East 28th Street and
Juniper Avenue);
Subject to the following condition:
1. That deed restrictions be placed of record on this property
prior to second reading of an Ordinance effecting the change
in zoning, said eeed restrictions to be approved by the City
Attorney and inclu~e the following:
a. A statement restricting the minimum lot area per
apartment unit of the project to 1, 500 square feet.
b. A statement refl_uiring that off-street parking be
provided for the project with a ratio of one parking
space for each apartment unit within the project.
c. A statement restricting the use of the property to one-
family dwellings, two-family dwe llings, or multi-
family dwellings and apartment J houses.
SECTION 2. THAT from and after passage and effective date of this Ordina
said lots, tracts and parcels of land described in Section 1 hereof shall be change
to the zoning district indicated and the Official Map is amended in accordance her
with.
AND IT IS SO ORDERED
