POOLS; REQUIRING THE APPROVAL OF SWIMMING POOL PLANS AND SPECI-
FICATIONS. ESTABLIS'HNG STANDARDS OF OPERATION, WATER QUAUTY
AND PROVIDING FOR LABORATORY CONTROL: DEFINING PUBLICa SEMI-
PUBLIC AND PRIVATE SWIMMING POOLS: PROVIDING PENALTIES FOR ' . VIOLATION: AND DIRECTING PUBLICATION OF THE CAPTION AND PENALTY

WHEREAS, the City Commission finds that it is in the interest of the pub-II
lie safety, health, and general welfare to enact· an ordinance regulating the con-1
struction and operation of swimming pools in the City of Lubbock; NOW THEREFO
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT Chapter 15 of the Lubbock City Code is hereby amended
lby adding thereto a new article to be designated Article VI thereof which shall read la s follows: ,
"ARTICLE VI REGULATION OF SWIMMING
POOlS''
11SEC TION 15-43. GENERAL PROVISIONS
"REGULATION 1. Definitio~~:-------------
(a) HEALTH OFFICER MEANS THE CITY HEALTH OFFICER
of the City of Lubbock or his legally authorized representa-
tive.
(b) CONSTRUCT means and includes building or installing a new
swimming pool or enlarging an existing swimming pool or any
of its facilities.
{c) FILL AND DRAW POOL shall mean a pool whose principal
means of cleansing is the complete removal of the used
water and the replacement ther.eof with clean water.
(d) OPERATE means to conduct, maintain or other wise provide
facilities and appurtenances for bathing at swimming pools.
(e) SWIMMING POOL means and includes fill and draw, flowing
through and recirculating poo'ls, outdoor and ind-oor, which
are artificially constructed and provide recreational facilities
for swimming, bathing or wading, and all connected appur-
tenances, buildings and equipment~ It does not include natural
ponds, rivers or lakes, unaltered by man, or private swim-
ming or wading pools as herein defined nor does it include
baths used for cleansing purposes, hydro-therapy, or for the
healing arts unless such baths consist of a pool or pools used
collectively by a number o£ individuals.
(f) PUBl.JC SWIMMING POOL means a swimming pool, admission
to which may be gained by the general public with or without
. the payment of a fee.

SEMI-PUBLIC POOL means a swimming pool on the premises
of, or part of, a hotel ... motel, trailer court, apartment house,
private club, housing area, association or similar establish-
ment where admission to the use of the pool is included in the
fee or consideration paid or given for the general use of the pre-
mises.
WADING POOL means a shallow pool intended chiefly for use
by children having a separated basin to contain the water and
a maximum water depth of 24 inches.
SPRA. Y POOL means an artificially constructed basin into
which water is sprayed but not allowed to accumulate.
PRIVATE POOL means a pool established or maintained on
any premises by an individual for his own or his family's
use, or for guest of his household ..
A CROSS CONNECTION is any physical connection or arrange-
ment between two otherwise separate piping systems, one of.
which contains potable water and the other sewage water or
water of unknown or questionable quality, through which water
may flow from one system to the other, the direction of flow
depending on the pressure differential between the two systems.
REGUlATION z. Effective Date.
The rules in this regulation referring to construction shall apply to all
I swimming pools constructed on and after the effective date of this regulation and
to any other swimming pool where, in the opinion of the Health Officer, such
application is necessary to eliminate a condition hazardous to health or safety.
The rules pertaining to pool maintenance and sanitation shall apply to all public
and semi-public swimming, wading and spray pools. On and after the date on
which this regulation becomes effective the construction of fill and draw swimming
pools is prohibited and no new permit will be issued for such pools.
REGUlATION 3. Permits, Plans and Specifications.
{a) No public or semi-public swimming pool shall be maintained
or operated in the City of Lubbock without a permit in force
issued by the Health Department, or otherwise than in accor-
dance with the terms of the permit and these regulations. The
permit shall be displayed in the conspicuous place on the pre-
mises where it may be readily observed by patrons.
T e yearly Operating permit fee shaU be $40.00 for public pools and
$1 o. 00 for semi-public pools. Municipally owned pools shall
be exempt from permit fee. all such permits shall expire
December 31 each year.
{b) No swimming pool shall be constructed nor shall any major
alteration or addition be made to any swimming pool until
detailed plans and specifications for the pool have been sub-
mitted to and approved by the health officer. Plans and
specifications shall include layout. construction and dimen-
sions, pool water treatment units, sewage disposal facilities,
piping and pumps, design criteria including maximum pool
load, capacities of the various units, safety equipment. bath
houses, toilet facilities and other_ pool appurtenances such as
recreational facilities. Such plans s·hall be made by a registered
engineer or architect qualified within the state, with his
his seal affixed.
The Health Officer will accept for examination and approval
plans and specifications which include layout, construction
~nd dimensions, pool water treatment units, waste disposal
facilities, piping and pumps and may inspect and approve
that portion of the installation as a separate unit.
The Health Officer shall make such inspections~a:s he de.ems
necessary to determine that the installation and facilities
comply with these regulations before an original permit may
be issued to operate or maintain a swimming pool. The
Health Officer shall also make such additional inspections
as are necessary to assure that the pool is. properly main-
tained.
(c) Should the Health Officer determine that a hazard to the pub-
lic health exists at a swimming pool, he may forthwith suspend
the permit therefor. Thereafter, at his ~equest the permittee
shall be granted a hearing by the Health Officer within 3 days
to show cause why the suspension should be lifted. The Health
Officer shall within 5 days after the hearing confirm or rescind
the suspension and shall notify the permittee of his action, giving
reasons therefor. H the perinittee fails to request a hearing
,. within 30 days after the suspension and the cause for the sus-
. pension has not been removed, the ~ealth Officer may revoke
the Permit. '
(d) Should the Health Officer, after inspection of a swimming pool
find that an extreme safety or health hazard, such as a leaking
gaseous Chlorinator, or other seriously deleterious condition
_ exists, he may order the immediate suspension of the operation
of the establishment. Such suspension of operation shall continue
until in the opinion of the Health Officer, the extreme hazard has
ceased to exists. u
"SECTION 15-44. GENERAL DESIGN, STANDARDS AND

REGULATION I. Public Pools. -
(a) The geeerallayout shall be such that bathers leaving the
dressing room pass the toilets and the shower in sequence
and then go to the pool.·
(b) All materials used in the construction of a swimming pool
shall be sound, durable and waterproof. The bottom and
sides of the pool shall be easily cleanable and finished
either white or Itght colored, and all corners shall be rounded.
Pool sides and bottom shall be smooth and free from cracks
or joints excepting properly designed construction or expan-
sion joints.
(c) For the purposes of this regulation the portion of a swim-
ming pool 5 feet or less than 5 feet deep shall be designated
as the rrnon-swimmer" area. That part of the pool deeper
than 5 feet shall be designated as the "swimming'area. In
designing pools and in computing bathing· loads, minimum

1. 10 square feet of pool surface shall be provided
for each non-swimmer expected at the time of
maximum load.
z. 27 square feet of pool area shall be provided for
each swimmer expected to be preeent at the time
of maximum load•
3. 300 square feet of pool area shall be reserved
around each diving board or diving platform. This
reserved area shall not be included in determin-
ing the area of the swimm ing section.
Depth of water shall be plainly marked at or above the water
surface on the vertical pool wall and/ or on the edge of the
deck or walk next to the pool, at maximum and minimum
points, at the points of break between the deep and shallow
portions and at intermediate increments of depth, spaced
at not more than 65 ft,. intervals. Depth markers shall be
in numerals of 4 11 (inches) minimum height and of a color
contrasting with background. Markers shall be on both
·sides and ends of the pool.
Overflow 11scum" gutters shall (a) extend completely around
the pool except over steps with lip of the gutter level through-
out the perimeter. {b) Provide a hand hold for swimmers,
{c) be provided with sufficient opening at the top, and width
at the bottom, to permit easy cleaning.·
The gutter drainage outlets shall be located not more than
10 feet apart. Outlet piping shall be properly covered by a
drain grate with openings two times the area of the drain
pipe. Gutter drainage may be discharged to sewers, without
direct connection, or into the recirculation system in an
approved manner.
Approved skimmers may be substituted for scum gutters at
the rate of 1 skimmer for each 800 square feet of water sur-
face area or fraction thereof. Including the surface area of
an atta:ched wading pool, excepting that in pools where the
maximum permitted recirculation rate is less than 35 gallons
per minute, a single skimmer will be permitted-Skimmers
shall be. properly installed, with due consideration given to
prevailing wind directions, and properly maintained and
operated. The overflow slot of a skimmer shall be at least
8 inches in width at its narrowest section and shall be auto-
matically adjustable to variations in water level over a range
of at least (3} inches. Skimmers shall operate at a minimum
overflow rate of ZO gallons per minute per lineal foot. The
rate of flow through the skimming device or devises shall not
exceed 750/o of the capacity of the recirculation system. When
the addition of a skimmer as required in this section lowers
the minimum overflow r~~ below 20 gallons per minute per
lineal foot, such additiotQ'skimmer will not be required.
(g) Only water from sources approved by the Health Officer shall
be used in swimming pools.
(h) Cross connection between potable water piping and the
swimming pool recirculation system is prohibited, and
no potable water pipe shall terminate below the overflow
level of a swimming pool. Potable water for make-up
purposes preferably shall be introduced into a float·
controlled tank across an air-gap at least twice the pipe
diameter but not less than 3 inches above the overflow
rim of the tank, or directly into the pool by means of

a safely located pipe (fill spout) turned downward with
an air-gap at least 6 inches above the pool over flow
level.
1. Exception:In cases where such equipment cannot
otherwise operate a potable water connection
to a chlorinator will be permitted provided that
it is properly protected against back siphonage
and back pressure by a check valve and vacuum
breaker.
Walkways immediately adjacent to the pool shall (a) be at
least 10 feet wide for public and 3 feet for semi-public
pools, exclusive of coping, excepting that where diving
stands or platforms are installed the walkway shall extend
at least 5 feet behind the stand or platform but not less
than 15 feet from the pool wall on public pools and (b)
slope away from the pool with a pitch of at least 1/8 inch
·· per foot to properly located deck dt!ains. In general, each
deck drain shall serve an area not greater than 300 square
feet. Walkways shall be constructed of concrete or other
material acceptable to the Health Officer, with non-slip
finish free of sharp or jagged edges or surfaces.
Ladders shall be provided at both sides of the deep section
of the pool and at the di\-dsion between the 11swimmer11 and
"non -swimmer11 areas. If the wall height at the shallow
end is greater than 30 inches, ladders or steps shall be
provided there also. Ladders must have a handrail on
both sides extending 30 inches above the pool wall; ladders
shall have non-slip flat treads.
The public pool and the area immediately surroundin g the
pool used by swimmers shall be separated from observa-
tion or other parts of the premises by a durable fence,
wall or other enclosure for the control of sanitation and
safety.
All pools shall be adequately lighted by natural or artificial
means when in use. Electric wires shall not extend across
a swimming pool. Underwater pool lighting shall be designed,
installed, grounded and maintained so as not to be dangerous
to bathers.
(m) All sewage from plumbing fixtures including, backwash from
filters and wasted swimming pool water, but not limited to
waterclosets, lavators, showers, and floor drains shall be
disposed of in a sanitary manner approved by the Health Officer.
(n) Diving boards shall be of sound construction, free of splinters
or dangerous cracks and shall be capable of supporting the heaviest
load under corrlitions of reasonable use.
(o) ~~least 12 feet of free and unobstructed headroom must
be provided above diving boards and towers.

Diving boards and diving platforms shall be covered or
finished with durable non-slip material.
In pools where a diving board or platform is provided the
depth of water shall be as follows;

(a) Wading pool water shall be cleansed through a swimming
~ool recirculation system as described under paragraph
la), Regulation 3; but if the wading pool is not connected
with a recirculation system then fresh clean water shall
be fed continuously into the pool and continuously wasted.
In either case the water turnover rate for the wading pool
shall not exceed 4 hours. When a wading pool is constructed
as a separate installation suitable provision shall be made
for skimming the water surfaces.
REGULATION 3. Water Circulation System. for public and semi-public pools.
(a) Geaeral -The water recirculation system consisting pri-
marily of piping, pumps, filters, water conditioni:hg-a~nd
disinfecting equipment together with other standard
accessory equipment shall be adequate to clarify and dis-
infect an amount of water equal to the contents of the pool
within 6 hours. The recirculation system shall be kept
in operation to maintain the required sanitary quality of
the water. Water drawn from the pool shall not be returned
to the pool unless it has been filtered and otherwise treated
in an approved manner.
{b) Piping -Piping systems shall be:
1. Designe-d to carry the required quanity of water
at a maximum velocity of 10 feet per second.
2. Of sufficient strength to withstand and sustain
operating presaures readily.
3. Made of non-toxic material.
4. Reasonably resistant to corrosion under condi•
tions of operation
5. So installed and located as to preserve its original
quality, condition and capacity.
Pipe and fittings which pass through the pool structure
shall terminate flush with inside pool walls or bottom.

Piping systems shall be identified by tags and numbers or
appropriate colors painted or located at conspicuous points.
Hair strainer ~ The recirculation system shall include a
suitable strainer to prevent hair, lint, etc., from reach~
ing pump and filters. The provision of spare strainer
baskets is recommended. Strainers shall be of corrosion~
resistant material, with openings having a total area at
least 4 times the area of the recirculation suction pump
pipe. Hair strainers shall not be required on vacuum filters.
Vacuum cleaner - a pool water vacuum cleaning system shall
be provided. In integral systems, connections shall be in
sufficient number, located in the wall of the pool, at least
10 inches below the water line, Section hose and equipment
handles of such length as to reach all parts of the pool shall
. be available for use. Fixed pipe connections shall be adequately
sized and shall be connected to the pump suction. Exception:
An approved portable vacuum cleaning system may· be sub-
stituted for the above.
Fixed or adjustable inlets of proper numbers, size, design,
and spacing in relation to the outlets and to the size and shape
of the pool to facilitate uniform circulation of water through-
out the pool without excessive pressure, shall be provided.
Drains ~ Svmnming pools shall be equiped with 1 or more main
drains located at the deepest part and shall be capable of drain-
in the pool completely.. Drains shall be covered by gratings
which are not easily retnoveable by bathers, and which have
safe openings at least 4 times the area of the drain pipe. Main
drains shall be located within 10 feet of any side wall. Multiple
drains shall not be more than 20 feet apart •.
Pressure ~auges shall be installed on the inlet and outlet main-
Hold of filters. Such gauges shall read at 1 pound pressure in-
tervals or in inches of vacuum.
Flowmeter -An accurate rate-of-flow device, shall be installed
and located so that the rate of recirculation and rate of back-
washing will be indicated.. Indicators shall be accurate to S%
under all conditions of flow. The indicator shall have a range of
at least 150o/o of the normal flow rate, including backwash.
In newly installed pressure said filters, and in existing pressure
sand filters aecrequired. the rate of filtration shall not exceed
3 gallons per minute per square foot and sufficient surface area
of filter medium shall be provided to achieve this rate. Such
filters shall be backwashed at a rate of at least 12 gallons per
minute per square foot, but preferably 15 gallons per minute
per square foot.
Pressure filter systems shall be equipped with a sight glass
installed on the waste discharge pipe. Such sight glass shall
be readily removeable for cleaning.

Air relief valves -Each pressure filter shall be equipped
with an air relief piping system connected at an accessible
point near the crown.
Access to equipment -filters shall be designed, located and
constructed to permit removal of filter manhole covers or
·heads for inspection purposes, replacement or repair of the
filter elements or media. No filter or filtration system shall
be installed beneath the surface of the ground without ade-
quate provision for access for inspection, maintenance and
. control.
Filter media: These minimum standarlls shall apply, where
applicable, to either gravity or pressure said filters. The
filter bed shall consist of suitable grades of filter aand and
asupporting bed of graded gravel or other porous material
which shall serve tp support the filter bed and distribute
both filtered and backwash water uniformly. The supporting
bed consisting of graded gravel or other material shall
support not less than 1811 of filter media consisting of silica
sand or other durable, inert material with an effective size
between o. 4 and o. 55 mm, and a uniformity coefficient not
exceeding 1. 70. The minimum freeboard to the draw-of£
point of backwash water shall not be less than 1011 above the
normal level-of the top of the filter bed., Freeboard shall in
cases be at least 1/2 of sand depth plus cme inch.
(o) Where diatomacious earth is used as the filter media, the
filtering rate shall not exceed 2. 5 gallons per minute per
square foot of effective filter surface area. The septum
shall be of corrosion-resistant material and shall be so
designed as to prevent the passage of filter media into the
pool. The filters shall be designed, installed, and ope::rated
to maintain the required purity and clarity of the pool water
under all operating conditions.
(p) All filters shall be backwashed or otherwise cleansed when
the reading on the rate of flow indicators falls below
minimum turnover rate •
. 1 REGUI.ATI<?N 4. Disinfection.of Public and Semi-Public Pools
{a) Di'-sinfecting agents -Effective water disinfection shall be
provided and maintained in all pools. This shall be accom-
plished by mechanical chlorination or other method approved
by the Health Officer that will maintain in the pool wate:r an
adequate, readily measurable residual amount of the disin-
fectant to counteract pollution introduced into the water.
The use of chlorine-am.monia disinfection treatment shall
not be permitted without special approval of the Health
Officer. The addition of undissolved disinfection agents
directly into the pool is prohibited..,
(b) Gaseous disinfectants -A device feeding gaseous disinfectants
shall not be readily accessible to patrons or the public and
shall be placed in a well-ventilated area tind preferably in a
separate room with an outside entrance. Such room shall be

provided with mechanical ventilators with intake near
floor level and which discharge directly to the outside
air. Operating switches shall be clearly marked and
located outside of, and near the entrance. Liquid
chlorine c·ontainers shall be ridigly anchored.
REGULATIONs. Water Standartis.of Public and Semi-Public Pools.
(a) Quality of water -Swimming pool water shall be so treated
and maintained whenever the swimming pool is open for use
that the bacterial, chemical and physical quality of the water
meets the standards set forth in recommended practice of
the American Public Health Association Revised.
-(b) Bacterial Slandards -Not more than 15% of the samples
covering any considerable period of time shall show
positive confirmed test in any of five 10 ml. portions of
water at times when the pool is in use.
(c) Chemical Standards -Whenever chlorine or a chlorine com-
pound is employed for swimming pool disinfection the.::amount
of available or excess chlorine in the water as shown by the
ortho-tolidine test shall not be less than 0.4 ppm: nor shall
the pH of the water be less than 7. o •
. (d) Physical standards -The surface of the pool water shall be kept
free of scum and foreign floating matter. Tae bottom and sides
of the pool shall be maintained free of sediment, dirt, slime and
algae. Water in the pool shall be maintained !ree of turbidity
and sufficiently clear so that the main drai·n grille is clearly
visible from the side of the pool.
(e} Tests -Tests of the residual disinfectant, pH and cleanli-
ness of the water shall be made by the operator as frequently
as necessary to maintain the standards provided in this regu-
lation. ·The· pool operators shall use approved equipment
suitable for the performance of these tests and shall maintain
daily operating records on forms supplied by the Health
Officer. Such records shall be readily available to the Health
Officer.
REGUlATION 6. Accessory Appurtenances.
(a) In all public swimming pools:

Dressing rooms: Dressing rooms shall be provided
for pools where bathing suits and towels are maintained
for loan o~-'~ental.
z. All ent;rances to and exits from the dressing room$.
shall be effectively screened to interrupt the line of
sight of persons outside the dressing rooms.
3. Walls and partitions of dressing rooms and locker rooms
shall be of smooth material with a finish impervious to
moisture_.

4. The lower edge of partitions between dressing
compartments shall terminate not less than six
, (6) inches above the floor. ·
s. Floors shall be of non-slip construction, free
of open cracks and sloped to adequate drains.
6. All furniture shall be of simple character~ easily
cleanable and wherever possible~ locker com-
partments~ furniture and other appurtenances
in dressing rooms shall be so installed or raised
above the floor as to permit thorough cleaning
and flushing of the floor.
7. Dressing rooms shall be adequately ventilated and
so located as to facilitate the proper use of toilets
by bathers.
s. Adequate and proper toilet facilities conveniently
located in properly ventilated compartments shall
be provided for each sex: the number of units
provided shall be sufficient with reference to the
maximum number of patrons using the establishment,
but in no case shall there be less than 2 units for
each sex. · ·
9. A sufficient number of shower baths with hot water
supply shall be provided at each swimming pool but
in no case shall there be less than 2 units for each
sex. Provision shall be made to temper hot water
supplied to bathers to prevert the possi1::ility of
scaldings.
1 o. Suitable and adequate hot water supplied hand washing
facilities shall be provided in or adjacent to toilet
rc;>oms.
11. An adequate supply of safe drinking water shall be
'provided by means of sanitary drinking fountains which
sha;ll be conveniently located.
12. An adequate number 'of lifeguards or other attendants,
tr ained in rescue and resuscitation shall be in constant
attendance, during bathing hours, and no bather shall
be permitted in a pool area unless such lifeguard or
attendant is present.
13. Safety equipment consisting of ring buoys, shepherd's
crooks, lifelines, of number and type approved by the
Health Officer shall be provided.
14; The provision of towels~ drinking cups, combs, hair
brushes, or soap for use in common by patrons is
prohibited.
1$. Bathing suits, towels, linen or similar articles pro-
vided for patrons shall be properly washed, sterilized
and thoroughly dried after each individual use and before
another use.

There shall be provided for emergency use, a tele-
phone, a standard first aid kit, and at public pools
only, a standard stretcher and two blanke~s. shall
also be provided,.
All persons shall be instr_~~~d by means of suitable,
adequate, clearly lettere4¥·'Properly located, to use
the toilet and particularly to empty the bladder and
then take a cleansing shower before entering the pool.
Semi-Public Pools which provide clean and sanitary private
rooms, including toilet, body washing, and drinking water
facilities for all bathers shall be deemed to have complied
with (a) paragraphs 1, Z, 3, 4, 5, 6, 7, 8, 9, 10, 11, & 12.
Every S\vimming pool shall be operated and maintained in a clean
and sanitary condition at all times.
Persons with sore or inflamed eyes, colds, nasal or ear dis-
charges, boils or other acute or obvious skin or body infections
or cuts shall be excluded from the pool. No person in or at a
swimming pool shall commit or be permitted to commit any
form of nuisance prejudicial to the life or health of any person
using the pool.
REGUlATION 7. Alternate Design.for public and Semi-Public Pools
Where the provisions of these regulations do not permit the install.a-
tion of a new design for a pool or water purification system, a design
conforming with the Texas State Department of Health standards
revised may be approved.

Before construction is started on any swimming pool within the City
Limits of Lubbock, a permit shall be secured from the building in-
spector subject to compliance with all zoning, buildng, plumbing,
electric and other ordinances enforceable by his department."
"SECTION 15-46 PENALTY
Any person, firm, or corporation violating any provision of this ordinance
or violating any order, decision, or requirement as made by the City
Health Officer or the Building Inspector pursuant to this ordinance, shall
upon conviction thereof be fined in any sum not to exceed TWO HUNDRED
($200. 00) DO~S, each day any such violation shall continue saall
constitute a separate offense. 11

SECTION z. The City Secretary shall cause the publication of the caption
and penalty clause of this ordinance ance a week fot" two consecutive weeks in a
newspaper regularly published in the City of Lubbock as an alternate method
of publication as provided by law, and this ordinance shall become effective
ten days after its last publHlation.
