NEW SECTION 34-95.,2 TO PROVIDE SANITARY REGULATIONS, STANDARDS
A ND SPECIFICATIO:P~S WITH RESPECT TO TOILETS AT CONSTRUCTION JOB
SrTES AND COMMUNlT Y GATHERING PLACES; PRESCRIBING NOTICE OF AND
PENALTY fOR VIOlATIONS; PROVIDING FOR APPEALS; AND PROVIDING FOR
PUBLICA'IXN AND EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the City Commission finds that numerous complaints have been
received by the Health Department of the City of Lubbock from Citizens oLsaid 1
City relating to sanitary conditions prevailing at various toilets located at constru i~
jobs and community gathering places creating fly and odor nuisances which are
injurious to the health and welfare of the general public; and,
WHEREAS, the City Commission finds that health and welfare of the Citizens of
the City of Lubbock would be benefited by the enactment of regulations to regulate
and control such conditions as aforesaid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION I. That Division 2 of Chapter 34, Volume I of the Lubbock
City Code is hereby amended by adding thereto a new section to be designated
"Section 34-95.2H thereof which shall read as follows:
.. 11Section 34-95.2 FURTHER ADDITIONAL REGULATIONS:
The following further additional regulations are hereby added to
this division, to-wit: ·
(A) TOILET FACILITIES AT CONSTRUCTION JOBS AND COMMUNITY
GATHERINGS.
Regulation I. Definitions.
(a) Water Flush toilet means a toilet meeting the requirements
of the Lubbock Plumbing Ordinance for material and work-
man-ship installed for the period of construction or assembly
and connected with the City Sewer or an approved septic tank.
(b) Chemical toilet means a toilet structure equipped with a
water-tight, impervious container which receives waste
discharged through a hopper, seat, urinal, or similar
device and into which container may be placed disinfecting
or deodorizing chemicals. .
(c) OFF-SITE TOILET means a water flush~d or chemical
toilet" located on ground not specified in a building permit,
which is within 200 feet ·of the construction job site ..
Regulation 2. Toilet Locations.
No person shall initiate or proceed with a construction, erection,
alteration, repair or razing project without first having provided
an adequate number of suitable sanitary toilet facilities for the .
use of employees on the project1 if such· project has three or more
employees on the job at any time. Such toilet facilities ~hall be
·of the water-flushed or chemical type, located o n or within 200
feet of the site o£ the project and approved by the Health Officer.
Regulation 3. Toilets at All Public Gatherings. •
At any public gathering for any commercial, religious or public
event where adequate toilet facilities are not provided on the
imme:di:a..te premises, suitable appro.ve<i sanitary toilet facilities
of the water flushed or chemical type, adequate fo.r the estimated
attendance, shall be located within ZOO feet of such gathering.· .

STANDARDS AND REQUIREMENTS
Regulation 1. Off-Site Facilities.
The \lSe of off-site toilet facilities is permitted providing
-the holder of the building permit has secured written
permission for such use from the owner of the toilets
and providing further that employees on the project are
permitted free and reasonable use of the facilities during
workip.g hours.
Regulation z. Location and Condition.
No chemical toilet shall be installed within 20 feet of
occupied premises nor within 10 feet of a public thorough-
fare or sidewalk, unless authorized by the Health Officer.
Toilet facilities shall be of sanitary construction and
maintained in a clean and sanitary condition by their owner.
Toilet paper shall be available at all times.
Regulation 3., Construction and Specifications.
(a) Toilet structures Qhall be enclosed on 4 sides and top.
excepting for ventilation openings which shall be covered
with 16 gauge or fine~:. screens to exclude insects, and -
shall be fitted with a self-closing door equipped with a
durable latch. Toilet rooms shall be well lighted and ventilat
and shall not be directly connected with living or working
quarters.
(b) The floors of water-flushed type toilets may be of earth,
but the floors of chemical toilEts shall be of smooth·
·finished, non-absorbent material. Seats, walls and
ceilings shall bl! of smooth, easily cleanable, light
colored finish ..
(c) In chemical toilets, seats shall be so :installed as to
insure that wastes drop unimpeded into a receiving tank.
The receiving tank shall be of impervious, corrosion-
,resistant material with an easily accessible opening
for cleaning. The thickness of the tank material shall
be not less than 12 gau&e• The tank and bowl shall be
ventilated by means of a screened pipe at least 4 11 in
diameter, which shall extend to outside air.
(d} The receiving tank shall be charged with an adequate
quanity of a chemical having a high phenol coefficient,
properly diluted with water, capable of reducing and
liquefying wastes and preventing of:Lensive odors. The
chemical shall be renewed or the contents of the tank
properly removed.
Regulation 4. Identification.
Every chemical toilet structure shall have painted thereon
in clear letters the name and telephone number of the owner ..
PENALTY
Any person found to be violating any prQvision of this section
shall be serYed by the Health Officer with written notice stating
the nature of the violation and providing a reasonable time limit
for the satisfactory correction thereof. Any person failing to
correct such violation within the time specified in the written
notice, or within such extended period of time as may be granted
by the Health Officer shall be deemed to be maintaining a public
nuisance. and shall be guilty of a misdemeanor, and may be
punished by a fine in any sum not to exceed $2.00. oo. Each day
such vidJ.ation continues to remain uncorrected shall constitute
a separate offense.
llT WF:cb h=-(D) APPEAL.
The right .of appeal provided for in Section 34-95.1 (J) of
this Division shall apply also to this section.
(E) CONSTRUCTION OF PROVISIONS·.
The provisions of this section shall be liberally admini$tered
and construed by the Health officer or his authorized representative
to secure substantial compliance with public health needs.11
I SECTION 2. If any phrase, clause, sentence, paragraph, or provision of ~his ordinance is judicially declare<;! to be invalid or unconstitutional for any reason
r uch declaration shall not affect the remainder of this ordinance.
SECTION 3. The City Secretary is hereby authorized and directed to cause
he publication of the caption and penalty clause (said penalty clause being amendato y
ection 34-95.2 (C) set forth in Section 1 of this ordinance) as an alternative metho
f publication as provided by law, once a week for two consecutive weeks in a
ewspaper regularly published in the City of Lubbock, and this ordina nc~· s hall beco e
ffective ten days after its last publication.
