Acquire By Condemantion Parcel 10 - 05/12/1960FORM L-2 AN APPROPRIATION ORDINANCE os-l;1-l9WO ORDINANCE NOo 3132 WHEREASv the City Comm~ss~on of the City of Lubbock finds it is necessary to appropriate certain specific funds out of bond funds for an a~proved project, and this ordinance deals with the daily operation of City departments in the public interest which creates an emergency; NOW~ THEREFOREj BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK~ There is hereby appropriated out of the following descr~bed bond fund , to-wit : Stree t Improvement Fund THE sum 87,320.00 For the following purpose o Acquire by condemnation Parcel 10, Clovis Highway, from J. D. Prather and others. WHEREAS 9 an emergency exists as shown in the preamble to this ordinance , the enactment of this ordinance is declared to be an emergency measure thereby creating a public necessity that the rule requir~ng proposed ordinances to be presented at two (2) separate commission meetings be dispensed with; and this ordinance shall be effective from the date of its passage. Prather 0.023 of one acre of land, being a s trip of land 10 feet in width lying parallel to t he p resent right~of-way line extending from the eas t property line to the west property line and being a part of Lots 11 & 12, Block 1, Burleson & Osborne Heights Addition to the City of Lubbock, according to a plat recorded in vol. 325, page 293, Deed Records of Lubbock County, Texas, which Lots 11 & 12, Block 1, were conveyed to J. D. Prather by a deed dated 1 May '58, of record in vol. 693, page 671, Deed Records of Lubbock County, Texas, which 0.023 of one acre is more particularly described by metes and bounds as follows: BEGINNING at the northeast corner of Lot 11, Block 1; THENCE S 33°11' W, 10 feet along the east boundary line of said Lot 11, to a point; THENCE N 56°49' W, parallel to the present centerline of US Hwy. 84, 100.0 feet; THENCE N 33°11 1 E, 10 feet; THENCE S 5~049' E, 100.0 feet to the place of beginning.
