PROVIDING NOTICE TO PARENTS AND JUVENILE OFFICERS: MAKING IT UN- LAWFUL FOR PARENTS AND OPERATORS OF ESTABLISHMENTS TO PERMIT SAID MINORS TO REMAIN IN PUBLIC PLACES DURING PROHIBITED HOURSa ALL AS DEFINED HEREIN;. PROVIDING EXCEPTION~ AND PENALTIES.; CHAPTER 19A: SUB-MINORS -: CURFEW 19A-l Legislative Finqings ~1)· The City Commission finds that: (a) An emergency has been created by a substantial increase in the number and in the seriousness of crimes committed by minors against persons and pro- perty within the Oty, and this has created a menace to the preservation of public peace~ safety, health. morals and welfare; {b). The increase in juvenile delinquency has been caused in part by the large number .of minora who are permitted to remain in public places and in certaines- tablishznents during night hours without adult supervision• (c) The problem of juvenile delinquency can be reduced by regulating the hours during which minors may rem.ain in public places and in certain establish-I ments without adult supervision,. and by imposing certain duties and responsibi- lities upon the parents or other adult persons who ha.ve care and custody of minor • 19A-Z Definitions (1) In this Chapter the following definitions apply: (a), Establishment. Any privately owned place of business carried on for a profit or any place of amusement or entertainment to which the public is invited; (b) Sub-Minor. Any person under the age of 17 years. (c) Operator. Any individual. firm, association, partnership) or corporatio operating, managing or conducting any establishment; and whenever used in any; clause prescribing a penalty the term "operator11 as applied to associations or t partnerships shall include the members or partners thereof and as applied to ~"_ corporationsJ shall include the officers thereof; (d) Parent ... Any natural parent of a sub-minor• a guardian~ or any adult per+ son. 2.1 years of age or over;~~ responsible for the care and custody of a sub ... mino !~ (e) Public Place. Any public street., highway, road, alley., park:» playground~ wharf, dock,. public building or vacant lot; (f) Remain. To loiter• idle, wander~ stroll or play in or upon, or park or cruise in or upon any vehicle. l9A-3 Unlawful Conduct of Sub.."tMipore. Parents. (1) No parent shall knowingly permit any sub•minor to remain in or upon any public place or any establishment between the hours of lZ o'clock P.;M.; and 6 otclock A.;M.-of the following day1111 official City time.., except that on Fridays and saturdays and nights next preceding school holid.ays the hours shall be from 1 olclock A.M.; to 6 otclock A.; M.;; ~Z} The provisions o! this Section shall not apply to any parent who accompani 1 a sub-minor or to a parent who directs a sub-minor upon an errand or other legi .. j timate business or to any parent of a sub•minor engaged in gainful lawful employ- ment d~ing the curfew hours. 19A ... 5 Unlawful Conduct of Owners or Operators of Establishments .U) No operator of an establishment or their ag.ents or employees shall know- ingly permit any sub•minor to remain upon the premises of said establishment between the hours of 12 o'clock P. M. and 6 osclock A. M.; o! the following day • official City time., except that on Fridays and Saturdays and nights aext preceding school holidays the hours shall be from 1 o'clock A• M. to 6 1o!clo.ck A. Me 19A-6 Enforcement and Penalties ~1) Any police officer who finds a sub•minor violating any provisions of Sectio 19A-3 shall obtain information from such sub-minor as to his name and address, age. and the name of his parent or parents. The-sub-minor shall thereupon be instructed to proceed to his home forthwith. The information obtained from the sub-minor shall be forwarded to the Chief of the Juvenile Division of the City Police ])epartm.ent, who shall cause a written notice to be mailed to the parent or parents of the sub-minor.-advising of the violation of Section 19A-3. {Z) Any parent who shall violate any provision of Section 19A-4 after having received notice of a prior viltlation shall be fined upon conviction. any sum not exceeding $200. 00 for each violation. {3} Any operator o! an establishment and any agents or employees of any oper tor who shall violate the provisions of Section 19A-5 shall be fined upon convictio any sum not exceeding $200.00 for each violation • . t4} Each violation of the provisions of this Chapter shall constitute a separate offense.
