THE BUILDING UNES HEREIN ESTABUSHED TO CONFORM TO SUCH BUILD- 'j lNG LINES WITIDN FIVE (5) YEARS; DEFINING BUILDING l.JNE AND PRO- VIDING THAT SET BACK REQUIREMENTS UNDER THE CITY'S ZONING ORDINANCE AND AMENDMENTS THERETO BE DETERMINED FROM THE BUILDING LINES HEREIN ESTABLISHED; PROVIDING EXCEPTIONS FOR UTILITY EXTENSIONS A.L\JD PUBLIC IMPROVEMENTS; PROVIDING A SAVINGS CLAUSE. - I WHEREAS, Article 1105a, Revised Civil Statutes of Texas provides for the establishment of building lines on any part or side of any street in the City of Lubbock, said City having a population of more than 15, 000 persons; a nd, WHEREAS, the City Commission finds that public convenience, safety and necessity in the City of Lubbock require that building lines or rights-of-way lines be established on the North and South sides of the Traffic Circle in Survey 2, Block E, Lubbock County, Texas, at the place and location more particularly described by metes and bounds in the body of this ordinance, to prevent repair and replacement of structures and trees in the area between the btilding lines as established, such areas being required in connection with widening, opening and improving that part of the Traffic Circle in Survey 2, Block E, Lubbock County, Texas, as hereinafter described; and, WHEREAS, the widening and improving of the Traffic Circle in Survey 2, I Block E, Lubbock County, Texas, and the establishment of such building lines are necessary and will ultimately provide streets of desirable and adequate width which will aid and relieve heavy traffic in congested areas in accordance with the city's comprehensive plan, and the city's pla;1ning commission has recommended sach plan. The City Commission further finds that such establishment of build- ing lines at this time will promote economy; NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT a building line is hereby established on the North and South sides of the Traffic Circle in Survey Z, Block E, Lubbock County, Texas, at the place and location as hereinafter described and within the corporate bound- aires of the City of Lubbock, Lubbock County, Texas, which building lines are more particularly described as follows, to-wit: North side of the traffic circle in Survey 2, Block E, Lubbock County, Texas: BEGINNING at a point in the North right of way line of u. S. Highway No. 84 (New Slaton Highway), said point being the point of intersection of the tangents of the curve at the Southeast corner of Lot 2-B of the corrected plat of the Subdivision of Tract 2, Soash-White Industrial Addition to the City of Lubbock, Lubbock County, Texas; THENCE North 70°1411011 West along the South line of said Lot 2-B, a distance of 116.86 feet to a point of curvature of a curve to the v THENCE South along the East property line of said Block 1, a distance of 3 7. 67 feet to a point, said point being the beginting point of a curve to the right whose beginning tangent makes an angle of 32°33'2411 with the West property line of Avenue H; THENCE along a curve to the right having a radius of 70 feet, angle of intersection of 70°33 14111 and a tangent distance of 49.53 feet for an arc length distance of 86. 21 feet to a point of tangency; THENCE North 7 6 ° 521 55" West a distance of 4 8. 54 feet to a point of curvature of a curve to the right having a radius of 1136. 28 feet, angle of intersection of 15°09' 2011 , and a tangent distance of 151.16 feet; THENCE along said curve to the right an arc length distance of 300.65 feet to a point in the Northeast right of way line of u. S. Highway No. 84, {Avenue Q South Drive) said point being 91.23 feet (Measured along said ·Northeast right of way line) from the most westerly corner of Block 1, Circle View Addition No. 2; THENCE Northwesterly along the Northeast right of way line of U. S., Highway No. 84 (Avenue Q South Drive) a distance of 720 feet; South side of the Traffic Circle in Survey 2, Block E, Lubbock County, Texas: BEGINNING at a point in the South right of way line of u. s. Highway No. 84 (New Slaton Highway) said point being 506. 1 feet {measured along said South right of way line) from the most easterly corner of Lot 12, Block 15, Willona Village Addition to the City of Lubbock, Lubbock County, Texas; -------THENClt Northwesterly along the South right of way line of u. S. Highway No. 84 (New Slaton Highway) a distance of 680 feet to a point of curvature.. in the North line of Lot 12, Block 15, Willona Villa~ Addition; THENCE along a curve to the left having a. radius of 180 feet, to a point of tangency in the East right of way line of Avenue H, said point being in the West line of Lot 13-A of the Subdivision of Lot 13, Block 15, Willona Village Addition. The abovementioned curve being the property line of Lot 12, Block 15, Will.ona Vil1a.ge and Lot 13~A, Block 15, of the Subdivision of Lot 13, Block 15, Willona Village Addition; THENCE West (perpendicular to Avenue H) a dista.-1ce of 160 feet to a point in the West right of way line of Avenue H, said point being 76.19 feet South of the most southerly corner of Block 10, McLarty Circle View Addition; THENCE North a distance of 28.82 feet to a point of curvature of a curve to the left having a radius of 70 feet, angle of intersection of 9-3°0010011 , and a tangent distance of 73.76 feet; ,_ THENCE along said curve to the left an arc length distance of 113.62 feet to a point of reverse curve; THENCE along a curve to the right having a radius of 205 feet, angle of intersection of 49°451 00", and a tangent distance of 95. 05 feet, for an arc length distance of 178.00 feet to a point of tangency; THENCE North 46°45'0011 West a distance of 88.36 feet to a point in. the front line of Lot 6, Block 8, McLarty Circle View Addition, said point being 21.08 feet (Measured along the front of aaid lot) from the most easterly corner of said lot; THENCE continuing on a straight line a distance of 44.28 feet to a point in the South right of way line of Wolfforth Road, said point being 7. 57 feet (Measured along said South right of way line) from the most northerly corner of Lot 8, Block 8, McLarty Circle View Addition; THENCE North 78°2710011 East a distance of 3. 92 feet; THENCE North 28°23 159" West a distance of 12.5.37 feet to a point in the North right of way line of Wolfforth Road, said point being 325.95 feet{measured along the North right of way line of Wolfforth Road) from the intersection of the extensions of the North right of way ,line of Wolfforth Road and the Southwest right of way line of u. S •• Highway No. 84 (Avenue Q South Drive). THENCE continuing North 28°23159" West a distance of 1244.27 feet to a point in the Southwest right of way line· of u. s. Highway No. 84 (Avenue Q South Drive) said point being 1380 feet (Measured along said Southwest Right of way line of u. s. Highway No. 84) from the intersection of the extensions of the North right of way line of Wolf- forth Road and the Southwest right of way line of U. S. Highway No. 84 '(Avenue Q South Driv·eJ. . . SECTION 2. THAT no building or other structure shall hereafter be erected, re-erected or substantially repaired and no new structure or parts thereof shall be erected on that part of the street or land herein designated within said building lines hereinabove described. I SECTION 3. THAT all structures on or between the building lines established! by this Ordinance or extending in whole or in part within such building lines a.re hereby required to conform to the new building lines established in Section One {1) of this Ordinance within five (5) years from the effective date of this ordinance. SECTION 4. .THAT the term "Building Line11 as herein used shall be con- strued to mean "street right of way line ... 11 , and the setback requirements under the City's Zoning Ordinance and all amendments theeeto shall apply in addition to the right of way lines or building lines herein established, it being the intent and purpose of this Ordinance to preserve all land within the building lines herein established for ultimate staeet purposes. SECTIONs. THAT The provisions of this Ordinance shall not apply to any officer, agent, employee or oth:er person duly authorized by the State of Texas and/or the City of Lubbock when performing any employment pursuant to the widening, straightening or extension of the street and/or the right of way con- templated by this Ordinance or authorized utility extensions VJ.!thin the right of way herein described. SECTION 6. If any section, paragraph, subdivision, clause, phrase or pro- vision of this Ordinance shall be judged invalid or held anconstitutional, the same shall not affect the validity of the remainder of this Ordinance as a whole or any part of the prouisions thereof other than the part so decided to be invalid or un - onstitutional. ri11ht having a radius of 565.00 feet, angle of intersection of z7'015'00" and a tangent distance of 136.94 feet; said point of c~rvature being 210 feet from the most westerly corner of said Lot Z-B; THENCE along said curve a arc length distance of 270.20 feet to a point of tangency; THENCE North 42°59'1011 West a distance of 307.14 feet to a point of curvature of a curve to the left having a radius of 865 feet, angle of intersection of 6°30'0011 , and a tangent distance of 49. 11 feet; THENCE along said curve an arc length distance of 98 .. 13 feet to a point of reverse curve; THENCE along a curve to the right having a radius of 140 feet, angle of intersection of 41°3 9' 0811 , and a tangent distance of 53~ 25 feet, for an arc length distance of 101.77 feet to a point in the Southeast right of way line of U. S. Highway No. 87-(Avenue A South EJrive), said point being in the Northwest property line of Lot 2-A of the corrected plat of the Subdividion of Tratt 2, Soash- White Industrial Addition, said point also being 181.44 feet (Measured along said Southeast right of way line} from the most northerly cor.1er of said Lot 2 -A; THENCE North 50°0014011 West (Perpendicular to u. S. Highway No. 87) a distance of 150 feet to a point in the Northwest right of way li~ of u. s. Highway No. 87, said point being in the South- east property line of Block 23, of the Replat of Blocks 14, 22, and 23, Lyndale Acres Addition, and being 305. 96 feet (Measured along said Northwest right of way line) from the point of irtersection of the tangents of the curve at the Northeast corner of said Block 23; THENCE South 39°59'2011 West 17.28 feet to a point of curvature of a curve to the right having a radius of 70 feet, angle of intersection of 70°5813011 , and a tangent distance of 49.91 feet; THENCE along said curve an arc length distance of 86.71 feet to a point of reverse curve; THENCE Along a curve to the left having a radius of 865 feet, angle of intersection of 7°03'2611 , and a tangent distance of 53.34 feet, for an arc length distance of 106.54 feet to a point of reverse curve; -THENCE along a curve to the right having a radius of 70 feet, angle of intersection of 44°19131", and a tangent distance of 28.51 feet, for an ar.c length distance of 54.15 feet to a point in the West line of Block 23, of the Replat of Blocks 14, 22 and 23, Lyndale Acres Addition, said point being in the east line of Avenue Hand being ·371. 61 feet {Measured along said eas·t~right of way line of Avenue H) from the point of intersection of the tangents of the curve at the most Northerly corner of said Block 23; THENCE North along the East right of way line of Avenue H a distance of 113.65 feet; THENCE West {Perpendicular to Avenue H) 120 feet to a point in the West right of way line of Avenue H. said point being 119.50 feet South of the most northerly corner of Block 1, Circle View Addition No. 2 and being in the East property line of said Block 1; . SECTION 7. Any existing building lines which are in conflict with the build- ing lines established by this ordinance are hereby repealed to the extend of such conflict.
