AN 11R-111 TO A "C-411 ZONING DISTRICT: SUBJECT TO THE FOLLOWING
CONDITION: THAT THE OWNERS AND/OR DEVELOPERS SHALL MAKE APPU
CATION FOR. AND SECURE A BUILDING PERMIT WITHIN TEN MONTHS AFTER
THE DATE OF FINAL PASSAGE OF THIS ORDINANCE.
WHEREAS. the proposed change in zoning districts as hereinafter made has
been duly presented to the Zoning and Planning Commission ti::>r its recommenda-
tion, which was received by the City Commission and after due consideration, the
City Commission finds that making the proposed change as hereinafter set out
will be in the public interestj and,
WHEREAS, all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with, as well as giving
notices in compliance with Section 2.0 of Ordinance No. 1695 as well as notices
provided by Article IOllf, Vernon's Annotated Civil Statutes, amended .in 1953,
and notice was duly published in the Lubbock Morning Avalanche more than fifteen I
(15} days prior to the date of the public hearing before the City Commi~:~sion on su r
proposed amendment, and the public hearing according to said notice was duly hel
in the City Commission Room on the first floor of the City Hall, Lubbock, Texas,
at which time persons appeared in support of the proposal; and, after said hearing
it was by the City Commission determined that it would be in the public interest, d e
to changed conditions, that the Zoning Ordinance and the Zoning Map be amended
in the manner hereinafter set forth in the body of this Ordinance and this Ordinanc
having been introduced in final written form prior to first reading hereof; NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION I. THAT Ordinance No. 1695 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
ZONE CASE NO. 825
Change the following described property, to-wit:
BEGINNING at a 3/4" 1-. P. set 979.29 f~et West and 40.0
feet South of the Northeast corner of Section 6, Block E-2,
Lubbock County, Texas, for the Northeast and beginning
corner of this tract;
THENCE South 2.41. 51 feet to a 3/411 I.P. set in the North-
west R. 0. W. line of the S., P., &. s. F. Railroad for the South-
east corner of this tract;
THENCE South 53°54' West, along said Railroad R. o. W. line
49. 04 feet to a 3/411 I. P. set for the Southwest corner of this
tract;
THENCE North 270.41 feet to a 3/411 I.P. set in the South
line of 34th Street for the Northwest corner of this tract;
THENCE East 39.63 feet to the PlACE OF BEGINNING•
from an nR-111 to a -11C-411 zoning district. (Said property being
located in the 5200 Block of 34th Street); Subject to the follow-
ing condition: THAT the owners and/or developers shall make
application for and secure a building permit within ten months
after the date of final passage of this Ordinance.
SECTION z. THAT from and after passage and effective date of this Ordinan
said lots, tracts, and parcels of land described in Section 1, hereof shall be
changed to the z oning district indicated ani the Official Map if amended in accor-
dance herewith.
AND IT IS SO ORDERED
