HomeMy WebLinkAboutOrdinance - 2886-1959 - Amending Zoning Ordinance And The Official Map Of The City - 08/17/1959'• J a-t:z-t.9 ORDINANCE NO. 2886 0~ -;;)./-19 59 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE OFFI- CIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 793 : CHAl'GE CERTAIN PROPERTY LYING SOUT · OF 19TH STREET AND WEST OF YELLOWHOUSE CREEK IN YELLOWHOUSE CANYON FROM AN 11R-111 TO AN ttM-111 ZONING DISTRICT, SUBJECT TO THE FOLLOWING CONDITION: THAT THE OWNERS AND/OR DEVELOPERS SHALL MAKE APPLICATION FOR AND SECURE A BUILDING PERMIT WITinN TEN MONTHS AFTER THE DATE OF FINAL PASSAGE OF TIDS ORDINANCE.· WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommenda- tion, which was received by the City Commission and after due consideration, the City Commission finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giv.ing notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article lOll£, Vernon's Annotated Civil Statutes, amended in 1953, an notice was duly publishedin.the Lubbock Morning Avalanche more than fifteen (15) days prior to the date of the public hearing before the City Commission on such proposed amendment, and the public hearing according to said notice was duly held in the City Commission Room on the first floor of the City ·Hall, Lubbock, Te s at which ·time persons appeared in csupport of the proposal; and, after said hearing, it was by the City Commission determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amend in the manner hereinafter set forth in the body of this Ordinance and this Ord.inanc hav.ing been introduced in final written form prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: ..... SECTION 1.. THAT Ordinance No. 1695 and the Official Zoning Map BE an<\<th same are hereby amended as follows,: to-wit:. J ZONE CASE NO. 793 Change the following described property, to-wit: BEGINNING at a point 2495. 8 feet West of the Northeast corner of Section 5, Block B, Lubbock County, Texas; THENCE South 29°231 East 240 feet to a point in the zone division line as established by Ordinance No. 1695 of the City of Lubbock for the beginning point of this tract; THENCE continuing South 29°23' East 183 feet to a point; THENCE South 34°42' West 377.4 feet to a point in the North line of the Panhandle & Santa Fe Railway right-Of- way; 0 THENCE North 39 461 West 610 feet more or le~s to a point in said zone division linej THENCE East along said zone division' line to the point and place of beginning for this tract; · .,_ ~I from an 11R-111 to an "M-111 zoning district. (Said property being located in the 800 Block of East 19th Street)i Subject to the following condition: THAT the owners and/or developers shall make application for and secure a building permit within ten months after the date of final passage of this Ordinance. SECTION 2.. THAT from and after passage and effective date of this Ordinan e said lots, tracts, and parcles... of land described in Section 1, hereof shall be chan.ged to the zoning district indicated and the Official Map is amended in accord ance herewith.
